SJR 100 - This constitutional amendment, if adopted by the voters, prohibits the passage or implementation of any law, order, ordinance, regulation, or public policy of the state or any political subdivision of the state, including schools and institutions of higher education that receive public funds, that infringes upon the unquestionable right of individuals to refuse any medical procedure or treatment, including, but not limited to, injections, vaccines, or prophylactics. JOINT RESOLUTION
Submitting to the qualified voters of Missouri, an amendment to article I of the Constitution of
Missouri, by adding thereto one new section relating to the right to refuse any medical
procedure or treatment.
Be it resolved by the Senate, the House of Representatives concurring therein:
That at the next general election to be held in the 1
state of Missouri, on Tuesday next following the first Monday 2
in November, 2026, or at a special election to be called by 3
the governor for that purpose, there is hereby submitted to 4
the qualified voters of this state, for adoption or 5
rejection, the following amendment to article I of the 6
Constitution of the state of Missouri:7
Section A. Article I, Constitution of Missouri, is amended 1
by adding thereto one new section, to be known as section 37, 2
to read as follows:3
Section 37. That no law, order, ordinance, regulation, 1
or public policy shall be passed or implemented by the state 2
or any political subdivision of the state, including, but 3
not limited to, schools and institutions of higher education 4
receiving public funds, that infringes upon the 5
unquestionable right of individuals to refuse any medical 6
procedure or treatment, including, but not limited to, 7
injections, vaccines, or prophylactics. Equality of rights 8
under the law shall not be denied or abridged to any person 9
in this state because of the exercise of the right under 10

this section. Nothing in this section shall be interpreted 11
to infringe upon a parent's right to exercise control over 12
their minor, unemancipated child's physical and mental care. 13
Section B. Pursuant to chapter 116, and other 1
applicable constitutional provisions and laws of this state 2
allowing the general assembly to adopt ballot language for 3
the submission of this joint resolution to the voters of 4
this state, the official summary statement of this 5
resolution shall be as follows: 6
"Shall the Missouri Constitution be amended to 7
prohibit any laws, orders, ordinances, 8
regulations, or public policies that infringe 9
upon the unquestionable right of individuals to 10
refuse any medical procedure or treatment, 11
including injections, vaccines, or 12
prophylactics?" 13
