JOINT RESOLUTION
Submitting to the qualified voters of Missouri, an amendment to article XI of the Constitution of
Missouri, by adding thereto one new section relating to prohibiting charges for
construction in progress by public utilities.
Be it resolved by the Senate, the House of Representatives concurring therein:
That at the next general election to be held in the 1
state of Missouri, on Tuesday next following the first Monday 2
in November, 2026, or at a special election to be called by 3
the governor for that purpose, there is hereby submitted to 4
the qualified voters of this state, for adoption or 5
rejection, the following amendment to article XI of the 6
Constitution of the state of Missouri:7
Section A. Article XI, Constitution of Missouri, is 1
amended by adding thereto one new section, to be known as 2
section 14, to read as follows:3
Section 14. Any public utility under the jurisdiction 1
of the public service commission shall not make or demand 2
any charge that is based on the costs of construction in 3
progress of any existing or new facility by the public 4
utility, or any other cost associated with owning, 5
operating, maintaining, or financing any property by the 6
public utility before the property is fully operational and 7
used to provide service to customers. 8
