JOINT RESOLUTION
Submitting to the qualified voters of Missouri, an amendment repealing section 13 of article I of
the Constitution of Missouri, and adopting one new section in lieu thereof relating to
statutes of limitations.
Be it resolved by the Senate, the House of Representatives concurring therein:
That at the next general election to be held in the 1
state of Missouri, on Tuesday next following the first Monday 2
in November, 2026, or at a special election to be called by 3
the governor for that purpose, there is hereby submitted to 4
the qualified voters of this state, for adoption or 5
rejection, the following amendment to article I of the 6
Constitution of the state of Missouri:7
Section A. Section 13, article I, Constitution of 1
Missouri, is repealed and one new section adopted in lieu 2
thereof, to be known as section 13, to read as follows:3
Section 13. 1. That no ex post facto law, nor law 1
impairing the obligation of contracts, or retrospective in 2
its operation, or making any irrevocable grant of special 3
privileges or immunities, can be enacted. 4
2. Notwithstanding subsection 1 of this section to the 5
contrary, civil actions relating to any injury or illness 6
caused by rape or forcible sodomy of any person, any injury 7
or illness caused by childhood sexual abuse of any person 8
under the age of eighteen, or any tortious conduct that 9
caused a person to be a victim of rape, forcible sodomy, or 10

childhood sexual abuse shall have no statute of limitation 11
and may be commenced by the victim of such rape, forcible 12
sodomy, or childhood sexual abuse, or the victim's guardian, 13
against the party committing the rape, forcible sodomy, 14
childhood sexual abuse, or tortious conduct at any time, 15
including any action that would be barred by the application 16
of the existing statute of limitation as of the effective 17
date of this subsection. 18
