Allow for automatic return of certain unclaimed property

This law allows the Department of Revenue to automatically return unclaimed property worth $1,000 or less directly to its owner if certain conditions are met.

What This Bill Does

  • Changes a rule so that small amounts of unclaimed property can be returned without needing a claim form.
  • Requires the Department of Revenue to validate the identity and address of the person receiving the property before returning it.
  • Keeps records of how the property was returned, including proof of ownership and identity verification.

Who It Names or Affects

  • People who have unclaimed property worth $1,000 or less that is being held by the state.
  • The Department of Revenue in Montana.

Terms To Know

Unclaimed Property
Money or items that belong to someone but haven't been claimed for a long time, often because the owner can't be found.
Administrator
The person in charge of managing unclaimed property and returning it to its rightful owners.

Limits and Unknowns

  • This law only applies to property worth $1,000 or less.
  • It does not change how larger amounts of unclaimed property are returned.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

COMMITTEE

Plain English: Amendment 1 allows the Department of Revenue to automatically return unclaimed property worth $1,000 or less directly to apparent owners if certain conditions are met.

  • Adds a new subsection (5) that permits the administrator to waive claim requirements and return property valued at $1,000 or less directly to an apparent owner under specific circumstances.
  • The amendment does not specify how the Department of Revenue will validate identity and address of the person receiving the payment or property.
