6 A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF
7 MONTANA APPLYING FOR A CONVENTION OF THE STATES UNDER ARTICLE V OF THE
8 CONSTITUTION OF THE UNITED STATES FOR THE PURPOSE OF PROPOSING AN AMENDMENT TO
9 THE CONSTITUTION TO SET TERM LIMITS ON MEMBERS OF CONGRESS.

11 WHEREAS, Article V of the Constitution of the United States provides the states with the authority to
12 call an amendment convention for the purpose of proposing an amendment to the Constitution of the United
13 States on application by at least two-thirds of the states; and
14 WHEREAS, this power provides the states with the leverage needed to force Congress to act when it
15 otherwise does not want to; and
16 WHEREAS, the citizens of Montana overwhelmingly support term limits on members of Congress; and
17 WHEREAS, the Legislature of the State of Montana hereby joins with other states in instructing
18 Congress to draft a term limits amendment and send it to the states for ratification, failing which the states will
19 act on their own; and
20 WHEREAS, the Montana Legislature, a body of citizen legislators, desires to restore rotation in office
21 for members serving in the United States Congress.

23 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF
24 THE STATE OF MONTANA:
25 (1) That pursuant to Article V of the Constitution of the United States, the Legislature of the State
26 of Montana formally applies to the United States Congress to call a convention limited to proposing an
27 amendment to the Constitution of the United States to set a limit on the number of terms a person may be
28 elected as a member of the United States House of Representatives and as a member of the United States

1 Senate.
2 (2) That the Secretary of State of the State of Montana transmit copies of this resolution to the
3 President of the United States Senate, the Speaker of the United States House of Representatives, the
4 Secretary of the United States Senate, the Clerk of the United States House of Representatives, the
5 Chairperson of the House Committee on the Judiciary, each member of Congress from the State of Montana,
6 and the presiding officer of each legislative house in each state, requesting their cooperation.
7 (3) That this application be considered as covering the same subject matter as the applications
8 from other states to Congress to call a convention to set a limit on the number of terms that a person may be
9 elected to the United States House of Representatives and the United States Senate, and that this application
10 be aggregated with the applications of other states for the purpose of attaining the two-thirds of states
11 necessary to require Congress to call a limited convention for the purpose of setting term limits on the members
12 of Congress, but that this application not be aggregated with any other application on any other subject.
13 (4) That this resolution constitutes a continuing application in accordance with Article V of the
14 Constitution of the United States until the legislatures of at least two-thirds of the states have made applications
15 on the same subject.
