4 A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF
5 MONTANA REQUESTING AN INTERIM STUDY OF THE SHARING OF PERSONAL INFORMATION FROM
6 MONTANA DRIVER RECORDS BY THE DEPARTMENT OF JUSTICE; AND REQUIRING THAT THE FINAL
7 RESULTS OF THE STUDY BE REPORTED TO THE 70TH LEGISLATURE.

9 WHEREAS, the purpose of the Montana Driver Privacy Protection Act, passed in 2001, is to "create a
10 more restrictive state version of the federal prohibition on release and use of certain personal information from
11 state motor vehicle records, found in 18 U.S.C. 2721, to protect an individual's privacy, consistent with the
12 Montana constitution, by prohibiting the disclosure and use of personal information contained in Montana motor
13 vehicle records, except when that use may be authorized by law"; and
14 WHEREAS, according to the Act and pursuant to certain restrictions, the Montana Department of
15 Justice may disclose certain personal information from a person's driving record to a federal, state, or local
16 government agency, or to a legitimate business or its agents, employees, or contractors; and
17 WHEREAS, to continue to protect and safeguard the privacy of Montanans, it is important to
18 understand more about the process and impacts of the release of personal information from driving records by
19 the Department of Justice.

21 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF
22 THE STATE OF MONTANA:
23 That the Legislative Council be requested to designate an appropriate interim committee or statutory
24 committee, pursuant to section 5-5-217, MCA, or direct sufficient staff resources to examine the release of
25 personal information by the Department of Justice in relation to:
26 (1) why personal information is shared and whether it is necessary;
27 (2) what personal information is shared and where that data is sent;
28 (3) how the personal information is used by the entities that receive it;

1 (4) how the sharing of personal information impacts individual Montanans;
2 (5) whether personal information sharing provides a source of revenue for the Department of
3 Justice;
4 (6) how the Department of Justice tracks personal information sharing, including which
5 organizations receive a person's data; and
6 (7) any information that can assist in understanding the process and impact of personal
7 information sharing on the department and on individual Montanans.
8 BE IT FURTHER RESOLVED, that if the study is assigned to staff, any findings or conclusions be
9 presented to and reviewed by an appropriate committee designated by the Legislative Council.
10 BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review
11 requirements, be concluded prior to September 15, 2026.
12 BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions,
13 comments, or recommendations of the appropriate committee, be reported to the 70th Legislature.
