AN ACT relating to governmental administration; providing that a
governmental entity is exempt from providing a copy of a
public book or record if the governmental entity is
authorized to dispose of the public book or record
pursuant to a schedule of retention; and providing other
matters properly relating thereto.
Legislative Counsel’s Digest:
Under existing law, with certain exceptions, all public books and public records 1
of a governmental entity are required to be open at all times during office hours for 2
the public to in spect, copy or receive a copy thereof. (NRS 239.010) Existing law: 3
(1) establishes the Committee to Approve Schedules for the Retention and 4
Disposition of Official State Records, which is required to review and approve or 5
disapprove the schedules for the r etention and disposition of the official state 6
records of certain agencies, boards and commissions; and (2) provides that an 7
official state record may be disposed of only in accordance with a schedule for the 8
retention and disposition which has been approv ed by the Committee. (NRS 9
239.073-239.080) Existing law further authorizes a local governmental entity to 10
establish a program for the management of records, including the adoption of a 11
schedule for the retention of records. The program must be approved by the 12
governing body of the local governmental entity and comply with certain 13
requirements. (NRS 239.125) 14
Section 1 of this bill provides that: (1) a state g overnmental entity is exempt 15
from providing a copy of any public book or record that the state governmental 16
entity is authorized to dispose of pursuant to a schedule for the retention and 17
disposition of official state records which is approved by the Commi ttee; and (2) a 18
local governmental entity is exempt from providing a copy of any public book or 19
record that the local governmental entity is authorized to dispose of pursuant to a 20
schedule for the retention and disposition of public books and records which is 21
approved by the governing body of the local governmental entity. 22

Section 2 of this bill makes a conforming change to create an exception to the 23
general requirement that all public books and public records of a governmental 24
entity are required to be open at all times during office hours for the public to 25
inspect, copy or receive a copy thereof. 26

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 239 of NRS is hereby amended by adding 1
thereto a new section to read as follows: 2
1. A state governmental entity is exempt from providing a 3
copy of any public book or record that the state governmental 4
entity may dispose of pursuant to a schedule for the retention and 5
disposition of official s tate records which is approved by the 6
Committee pursuant to NRS 239.080. 7
2. A local governmental entity is exempt from providing a 8
copy of any public book or record that the local governmental 9
entity may dispose of pursuant to a schedule for the retentio n and 10
disposition of public books and records which is approved by the 11
governing body of the local governmental entity pursuant to 12
NRS 239.125. 13

confidential, all public books and public records of a governmental 26
entity must be open at all times during office hours to inspection by 27
any person, and may be fully copied or an abstract or memorandum 28
may be prepared from those public books and public records. Any 29
such copies, abstracts or memoranda may be u sed to supply the 30
general public with copies, abstracts or memoranda of the records or 31
may be used in any other way to the advantage of the governmental 32
entity or of the general public. This section does not supersede or in 33
any manner affect the federal la ws governing copyrights or enlarge, 34
diminish or affect in any other manner the rights of a person in any 35
written book or record which is copyrighted pursuant to federal law. 36
2. A governmental entity may not reject a book or record 37
which is copyrighted solely because it is copyrighted. 38
3. A governmental entity that has legal custody or control of a 39
public book or record shall not deny a request made pursuant to 40
subsection 1 to inspect or copy or receive a copy of a public book or 41
record on the basis that the requested public book or record contains 42
information that is confidential if the governmental entity can 43
redact, delete, conceal or separate , including, without limitation, 44
electronically, the confidential information from the information 45

included in the public book or record that is not otherwise 1
confidential. 2
4. If requested, a governmental entity shall provide a copy of a 3
public record in an electronic format by means of an electronic 4
medium. Nothing in this subsection requires a governmental enti ty 5
to provide a copy of a public record in an electronic format or by 6
means of an electronic medium if: 7
(a) The public record: 8
(1) Was not created or prepared in an electronic format; and 9
(2) Is not available in an electronic format; or 10
(b) Providing the public record in an electronic format or by 11
means of an electronic medium would: 12
(1) Give access to proprietary software; or 13
(2) Require the production of information that is confidential 14
and that cannot be redacted, deleted, concealed or separate d from 15
information that is not otherwise confidential. 16
5. An officer, employee or agent of a governmental entity who 17
has legal custody or control of a public record: 18
(a) Shall not refuse to provide a copy of that public record in the 19
medium that is requested because the officer, employee or agent has 20
already prepared or would prefer to provide the copy in a different 21
medium. 22
(b) Except as otherwise provided in NRS 239.030, shall, upon 23
request, prepare the copy of the public record and shall not require 24
the person who has requested the copy to prepare the copy himself 25
or herself. 26
