AN ACT relating to employment; establishing and revising
restrictions on the number of hours that a child under the
age of 18 years may work; limiting the times of day that a
child under the age of 18 years who is enrolled in a public
school or private school may work on any day in whic h,
or any day immediately preceding a day in which, the
school is in session ; and providing other matters properly
relating thereto.
Legislative Counsel’s Digest:
Existing law, in general, prohibits employing, permitting or requiring a child 1
under the age of 16 years to work in any occupation, other than as a performer in 2
the production of a motion picture or work on a farm, for more than 48 hours in any 3
1 week or more than 8 hours in any 1 day. (NRS 609.240) This bill expands that 4
prohibition to include c hildren under the age of 18 years and reduces, from 48 to 5
40, the maximum number of hours per week that a child under the age of 18 years 6
may work. Additionally, if a child under the age of 18 years is enrolled in a public 7
school or private school, this bi ll prohibits employing, permitting or requiring the 8
child to work before 5 a.m. on any day in which the school is in session and after 9
10 p.m. on any day immediately preceding such a day. This bill maintains the 10
exception from those restrictions provided u nder existing law for work as a 11
performer in the production of a motion picture or work on a farm. 12

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 609.240 is hereby amended to read as follows: 1
609.240 1. No child under the age of [16] 18 years may be 2
employed, permitted or suffered to work at any gainful occupation, 3
other than employment as a performer in the production of a motion 4
picture or work on a farm [, more] : 5
(a) More than [48] 40 hours in any 1 week [, or more] ; 6
(b) More than 8 hours in any 1 day [.] ; and 7
(c) If the child is a pupil, before 5 a.m. on any day in which the 8
school at which the pupil is enrolled is in session and after 10 p.m. 9
on any day immediately preceding such a day. 10
2. The presence of a child in any establishment during working 11
hours is prima facie evidence of employment of the child therein. 12
3. As used in this section, “pupil” means a child enrolled for 13
the current academic year in a public school , as defined in NRS 14
385.007, or a private school, as defined in NRS 394.103. 15
