AN ACT relating to civil immunity; providing immunity from civil
liability to licensed firearm dealer s under certain
circumstances; and providing other matters properly
relating thereto.
Legislative Counsel’s Digest:
Existing law provides immunity f rom civil liability to certain persons for acts 1
or omissions under certain circumstances. (Chapter 41 of NRS) This bill extends 2
immunity from civil liability to a licensed firearm dealer who returns a firearm to 3
the owner of the firearm pursuant to a firearm hold agreement wherein the licensed 4
firearm dealer: (1) takes physical possession of the owner’s lawfully possessed 5
firearm at the request of the owner; (2) holds the firearm for an agreed period; and 6
(3) returns the firearm to the owner according to the terms of the agreement. 7

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 41 of NRS is hereby amended by adding 1
thereto a new section to read as follows: 2
1. Except as otherwise provided in subsection 2, a licensed 3
firearm dealer is immune from civil liability for any act or 4
omission arising from a firearm hold agreement and resulting in 5
personal injury or death, including the return of any firearm to 6
the firearm owner by a licensed firearm dealer at the termination 7
of a firearm hold agreement. 8

2. A licensed firearm dealer is not immune from civil liability 1
pursuant to subsection 1 if any action arising from a firearm hold 2
agreement was the result of other wise unlawful conduct on the 3
part of the licensed firearm dealer. 4
3. As used in this section: 5
(a) “Firearm hold agreement” means a written or oral 6
agreement between an owner of a firearm and a licensed firearm 7
dealer in which a licensed firearm dealer: 8
(1) Takes physical possession of the owner’s lawfully 9
possessed firearm at the request of the owner; 10
(2) Holds the firearm for an agreed period; and 11
(3) Returns the firearm to the owner according to the terms 12
of the agreement. 13
(b) “Licensed firearm dealer” means a person licensed 14
pursuant to 18 U.S.C. § 923(a). 15
Sec. 2. The amendatory provisions of this act apply to a cause 16
of action that accrues on or after October 1, 2025. 17
