Existing law provides for the issuance of cannabis establishment agent 1
registration cards, cannabis establishment agent registration cards for cannabis 2
executives and cannabis establishment agent registration cards for cannabis 3
receivers by the Cannabis Compliance Board. (NRS 678B.340, 678B.350, 4
678B.355) Existing law defines “cannabis establishment agent” to mean an owner, 5
officer, board member, employee or volunteer of a cannabis establishment, an 6
independent contractor who provides labor rela ting to the cultivation or processing 7
of cannabis or the production of usable cannabis or cannabis products for a 8
cannabis establishment or an employee of such an independent contractor. (NRS 9
678A.100) Existing law defines “cannabis establishment agent reg istration card” to 10
mean a registration card that is issued by the Board to authorize a person: (1) to be 11
an owner, officer or board member of a cannabis establishment; or (2) to volunteer 12

or work at or contract to provide labor for a cannabis establishment . (NRS 13
678A.105) Section 2 of this bill clarifies the procedures by which a cannabis 14
establishment agent registration card may be issued to an owner, office r or board 15
member of a cannabis establishment. 16
Existing law requires a person who holds an ownership interest in a cannabis 17
establishment of 5 percent or more to obtain a cannabis establishment agent 18
registration card for a cannabis executive. (NRS 678B.3 50) Section 1 of this bill 19
authorizes the Board, in accordance with policies and procedures established by the 20
Board by regulation, to waive any requirement to obtain a registration card for any 21
person who holds an ownership interest of 5 percent or more in a cannabis 22
establishment. 23
Existing law provides that a cannabis establishment agent registration card, 24
cannabis establishment agent registration card for a cannabis executive and 25
cannabis establishment agent registration card for a cannabis receiver expires 2 26
years after issuance and may be renewed upon the submission to the Board of 27
certain information and the payment of a renewal fee. (NRS 678B.340, 678B. 350, 28
678B.355) Sections 2-4 of this bill revise the date on which such a registration card 29
expires. Under sections 2-4, the initial registration card expires 2 years after 30
issuance and any renewed registration card expires 2 years after the expiration date 31
of the most recent registration card issued to or renewed by the person. Sections 2-32
4 additionally require, in order to renew a registration card, the required 33
information and payment to be submitted on or before the date on which the 34
registration card expires. 35
Sections 2-4 also eliminate provisions requiring a person to whom a 36
registration card is issued or for whom a registration card is renewed to submit to 37
the Board an affidavit on the first anniversary of the issuance or renewal attesting to 38
certain matters. 39
Existing l aw requires the Board to adopt regulations establishing different 40
categories of cannabis establishment agent registration cards. (NRS 678B.650) 41
Under existing law, a cannabis establishment agent registration card authorizes the 42
person to whom it is issued to volunteer or work at any cannabis establishment in 43
this State for which the category of the registration card authorizes the person to 44
volunteer or work. (NRS 678B.340) Section 6 of this bill eliminates the 45
requirement that the Board establish categories of cannabis establishment agent 46
registration cards. Section 2 instead establishes two categories of cannabis 47
establishment registration cards to be issued to a person who wishes to serve as an 48
owner, officer or board member of or volunteer or work at a cannabis 49
establishment. Under section 2, a cannabis establishment agent registration card 50
issued to a person who wishes to serve as an owner, officer or board member of or 51
volunteer or work at: (1) a cannabis establ ishment other than a cannabis 52
independent testing laboratory authorizes the person to serve as an owner, officer or 53
board member of or volunteer or work at any cannabis establishment in this State 54
other than a cannabis independent testing laboratory; and ( 2) a cannabis 55
independent testing laboratory authorizes the person to serve as an owner, officer or 56
board member of or volunteer or work at any cannabis independent testing 57
laboratory in this State. 58
Existing law establishes a fee of $150 for the initial i ssuance and renewal of a 59
cannabis establishment agent registration card. (NRS 678B.390) Section 5 of this 60
bill increases that fee to $400 for the initial iss uance and renewal of: (1) a cannabis 61
establishment agent registration card to an owner, officer or board member of a 62
cannabis establishment; (2) a cannabis establishment agent registration card for 63
a cannabis executive; and (3) a cannabis establishment age nt registration card for a 64
cannabis receiver. 65

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 678B of NRS is hereby amended by adding 1
thereto a new section to read as follows: 2
The Board may, in accordance with policies and procedures 3
established by the Board by regulation, waive any requirement to 4
obtain a registration card pursuant to this title for any person who 5
holds an ownership interest of 5 percent or more in a cannabis 6
establishment. 7
Sec. 2. NRS 678B.340 is hereby amended to read as follows: 8
678B.340 1. [A] Except as otherwise provided in this 9
section and section 1 of this act, a person shall not serve as an 10
owner, officer or board member of, volunteer or work at, contract 11
to provide labor to or be employed by an independent contractor to 12
provide labor to a cannabis establishment as a cannabis 13
establishment agent unless the person is registered wi th the Board 14
pursuant to this section. 15
2. A person who wishes to serve as an owner, officer or board 16
member of or volunteer or work at a cannabis establishment shall 17
submit to the Board an application on a form prescribed by the 18
Board. The application must be accompanied by: 19
(a) The name, address and date of birth of the prospective 20
cannabis establishment agent; 21
(b) A statement signed by the prospective cannabis 22
establishment agent pledging not to dispense or otherwise divert 23
cannabis to any person who is not authorized to possess cannabis in 24
accordance with the provisions of this title; 25
(c) A statement signed by the prospective cannabis 26
establishment agent asserting that he or she has not previously had a 27
cannabis establishment agent registration card revoked; 28
(d) The application fee, as set forth in NRS 678B.390; and 29
(e) Such other information as the Board may require by 30
regulation. 31
3. A person who wishes to contract to provide labor to or be 32
employed by an independent contractor to provide labor to a 33
cannabis establishment shall submit to the Board an application on a 34
form prescribed by the Board for the registration of the independent 35
contractor and each employee of the independent contractor who 36
will provide labor as a cannabis establishment ag ent. The 37
application must be accompanied by: 38
(a) The name, address and, if the prospective cannabis 39
establishment agent has a state business license, the business 40
identification number assigned by the Secretary of State upon 41
compliance with the provisions of chapter 76 of NRS; 42

(b) The name, address and date of birth of each employee of the 1
prospective cannabis establishment agent who will provide labor as 2
a cannabis establishment agent; 3
(c) A statement signed by the prospective cannabis 4
establishment age nt pledging not to dispense or otherwise divert 5
cannabis to, or allow any of its employees to dispense or otherwise 6
divert cannabis to, any person who is not authorized to possess 7
cannabis in accordance with the provisions of this title; 8
(d) A statement s igned by the prospective cannabis 9
establishment agent asserting that it has not previously had a 10
cannabis establishment agent registration card revoked and that 11
none of its employees who will provide labor as a cannabis 12
establishment agent have previously had a cannabis establishment 13
agent registration card revoked; 14
(e) The application fee, as set forth in NRS 678B.390; and 15
(f) Such other information as the Board may require by 16
regulation. 17
4. The Board may conduct any investigation of a prospective 18
cannabis establishment agent and, for an independent contractor, 19
each employee of the prospective cannabis establishment agent who 20
will provide labor as a cannabis establishment agent, that the Board 21
deems appropriate. In connection with such an investigation, the 22
Board may: 23
(a) Conduct or accept any background check the Board 24
determines to be reliable and expedient to determine the criminal 25
history of the prospective cannabis establishment agent or the 26
employee; 27
(b) Require a prospective cannabis establishme nt agent, if a 28
natural person, and each employee of a prospective cannabis 29
establishment agent who will provide labor as a cannabis 30
establishment agent to submit to the Board a complete set of 31
fingerprints and written permission authorizing the Board to forward 32
the fingerprints to the Central Repository for Nevada Records of 33
Criminal History for submission to the Federal Bureau of 34
Investigation for its report; and 35
(c) If the Board imposes the requirement described in paragraph 36
(b), submit the fingerprints of the prospective cannabis 37
establishment agent and each employee of the prospective 38
cannabis establishment agent who will provide labor as a cannabis 39
establishment agent to the Central Repository for Nevada Records 40
of Criminal History for submission to th e Federal Bureau of 41
Investigation for its report. 42
5. A cannabis establishment shall notify the Board within 10 43
business days after a cannabis establishment agent ceases to be 44

employed by, volunteer at or provide labor as a cannabis 1
establishment agent to the cannabis establishment. 2
6. Except as otherwise provided in NRS 678B.633, a person 3
who: 4
(a) Has been convicted of an excluded felony offense; 5
(b) Is less than 21 years of age; or 6
(c) Is not qualified, in the determination of the Board pursuant to 7
NRS 678B.200, 8
 shall not serve as a cannabis establishment agent. 9
7. The provisions of this section do not require a person who is 10
an owner, officer or board member of a cannabis establishment to 11
resubmit information already furnished to the Board at th e time the 12
establishment was licensed with the Board. 13
8. If an applicant for registration as a cannabis establishment 14
agent satisfies the requirements of this section, is found to be 15
qualified by the Board pursuant to NRS 678B.200 and is not 16
disqualified from serving as such an agent pursuant to this section or 17
any other applicable law, the Board shall issue to the person and, for 18
an independent contractor, to each person identified in the 19
independent contractor’s application for registration as an employee 20
who will provide labor as a cannabis establishment agent, a cannabis 21
establishment agent registration card. If the Board does not act upon 22
an application for a cannabis establishment agent registration card 23
within 45 days after the date on which the application is received, 24
the application shall be deemed c onditionally approved until such 25
time as the Board acts upon the application. [A] An initial cannabis 26
establishment agent registration card expires 2 years after the date of 27
issuance and may be renewed . [upon:] Any renewed cannabis 28
establishment agent reg istration card expires 2 years after the 29
expiration date of the most recent cannabis establishment agent 30
registration card issued to or renewed by the person pursuant to 31
this section. 32
9. To renew a cannabis establishment agent registration card, 33
a perso n must, on or before the date on which the registration 34
card expires: 35
(a) [Resubmission of] Resubmit the information set forth in this 36
section; and 37
(b) [Payment of ] Pay the renewal fee set forth in 38
NRS 678B.390. 39
[9. A person to whom a cannabis establis hment agent 40
registration card is issued or for whom such a registration card is 41
renewed shall submit to the Board on the date of the first 42
anniversary of the issuance or renewal an affidavit attesting that in 43
the preceding year there has been no change in the information 44

previously provided to the Board which would subject the person to 1
disciplinary action by the Board.] 2
10. A cannabis establishment agent registration card issued 3
pursuant to this section to an independent contractor or an employee 4
of an independent contractor authorizes the independent contractor 5
or employee to provide labor to any cannabis establishment in this 6
State. 7
11. A cannabis establishment agent registration card issued 8
pursuant to this section to a person who wishes to serve as an 9
owner, officer or board member of or volunteer or work at a 10
cannabis establishment other than a cannabis independent testing 11
laboratory authorizes the person to serve as an owner, officer or 12
board member of or volunteer or work at any cannabis 13
establishment in this State [for which the category of the cannabis 14
establishment agent registration card authorizes the person to 15
volunteer or work. ] other than a cannabis independent testing 16
laboratory. 17
12. A cannabis establishment agent registration card issued 18
pursuant to this section to a person who wishes to serve as an 19
owner, officer or board member of or volunteer or work at a 20
cannabis independent testing laboratory authorizes the person to 21
serve as an owner, officer or board member of or volunteer or 22
work at any cannabis independent testing laboratory in this State. 23
13. Except as otherwise prescribed by regulation of the Board, 24
an applicant for registration or renewal of registration as a cannabis 25
establishment agent is deemed temporarily registered as a cannabis 26
establishment agent on the date on which a complete application for 27
registration or renewal of registration is submitted to the Board. A 28
temporary registration as a cannabis establishment agen t expires 45 29
days after the date upon which the application is received. 30
[13.] 14. A person who holds an ownership interest of less 31
than 5 percent in a cannabis establishment is not required to obtain a 32
cannabis establishment agent registration card purs uant to this 33
section. The Board may, in connection with the issuance or renewal 34
of a license pursuant to NRS 678B.210 or 678B.250, conduct such 35
investigations of such a person as the Board determines to be 36
necessary. 37
Sec. 3. NRS 678B.350 is hereby amended to read as follows: 38
678B.350 1. [In] Except as otherwise provided in section 1 39
of this act, in addition to the requirements set forth in NRS 40
678B.340, a person shall not hold an ownership interest in a 41
cannabis establishment of 5 percent or more unless the person first 42
secures a cannabis establishment agent registration card for a 43
cannabis executive issued by the Board. 44

2. A person who wishes to hold an ownership interest in a 1
cannabis establishment of 5 percent or more shall submit to the 2
Board an application on a form prescri bed by the Board. The 3
application must be accompanied by: 4
(a) The name, address and date of birth of the applicant; 5
(b) A statement signed by the applicant asserting that he or she 6
has not previously had a cannabis establishment agent registration 7
card for a cannabis executive revoked; 8
(c) A complete set of the fingerprints and written permission of 9
the applicant authorizing the Board to forward the fingerprints to the 10
Central Repository for Nevada Records of Criminal History for 11
submission to the Federal Bureau of Investigation for its report; 12
(d) Any information required by the Board to complete an 13
investigation into the background of the applicant, including, 14
without limitation, financial records and other information relating 15
to the business affairs of the applicant; 16
(e) The application fee, as set forth in NRS 678B.390; and 17
(f) Such other information as the Board may require by 18
regulation. 19
3. If the Board determines the applicant is qualified to receive a 20
cannabis establishment agent registration card for a cannabis 21
executive pursuant to NRS 678B.200, the Board shall issue to the 22
person a cannabis establishment agent registration card for a 23
cannabis executive. 24
4. [A] An initial cannabis establishment agent registration card 25
for a cannabis executive expires 2 years after the date of issuance 26
and may be renewed . [upon:] Any renewed cannabis establishment 27
agent registration card for a cannabis executive expires 2 years 28
after the expiration date of the most recent cannabis establishment 29
agent registration card for a cannabis executive issued to or 30
renewed by the person pursuant to this section. 31
5. To renew a cannabis establishment agent registration card 32
for a cannabis executive, a person must, on or before the date the 33
registration card expires: 34

Sec. 4. NRS 678B.355 is hereby amended to read as follows: 1
678B.355 1. In addition to the requirements set forth in NRS 2
678B.340, a person shall not act as a receiver for a cannabis 3
establishment subject to a receivership unless the person first 4
secures a cannabis establishment agent registration card for a 5
cannabis receiver issued by the Board. 6
2. A person who wishes to act as a receiver for a cannabis 7
establishment subject to a receivership shall submit to the Board an 8
application on a form prescribed by the Board. The application must 9
be accompanied by: 10
(a) The name, address and date of birth of the applicant; 11
(b) A statement signed by the applicant asserting that he or she 12
has not previously had a cannabis establishment agent registration 13
card for a cannabis receiver revoked; 14
(c) A complete set of the fingerprints an d written permission of 15
the applicant authorizing the Board to forward the fingerprints to the 16
Central Repository for Nevada Records of Criminal History for 17
submission to the Federal Bureau of Investigation for its report; 18
(d) Any information required by the Board to complete an 19
investigation into the background of the applicant; 20
(e) Proof satisfactory to the Board that the applicant has: 21
(1) Experience in or knowledge of the cannabis industry; 22
(2) Experience as a receiver appointed by a court; 23
(3) The knowledge and skills necessary to make reasonable 24
financial decisions with respect to the finances of a cannabis 25
establishment subject to a receivership; and 26
(4) Adequate financial capacity to fulfill the duties of a 27
receiver; 28
(f) The application fee, as set forth in NRS 678B.390; and 29
(g) Such other information as the Board may require by 30
regulation. 31
3. If the Board determines the applicant is qualified to receive a 32
cannabis establishment agent registration card for a cannabis 33
receiver pur suant to NRS 678B.200, the Board shall issue to the 34
person a cannabis establishment agent registration card for a 35
cannabis receiver. 36

for a cannabis receiver expires 2 years after the date of issuance and 38

2. The Board may by regulation establish reduced fees for: 32
(a) The initial issuance and renewal of an adult -use cannabis 33
establishment license for an independent cannabis consumption 34
lounge; and 35
(b) The application fee set forth in subsection 3, 36
 for a social equity applicant. Such a reduction must not reduce 37
the fee paid by a social equity applicant by more t han 75 percent of 38
the fee paid by an applicant who is not a social equity applicant. 39
3. Except as otherwise provided in subsection 2, in addition to 40
the fees described in subsection 1, each applicant for a medical 41
cannabis establishment license pursuant to NRS 678B.210 or adult -42
use cannabis establishment license pursuant to NRS 678B.250 must 43
pay to the Board: 44

(a) For an application for a license other than an adult -use 1
cannabis establishment license for a retail cannabis consumption 2
lounge or independent cannabis consumption lounge, a one -time, 3
nonrefundable application fee of $5,000; 4
(b) For an application for an adult -use cannabis establishment 5
license for a retail cannabis consumption lounge, a one -time, 6
nonrefundable application fee of $100,000; 7
(c) For an application for an adult -use cannabis establishment 8
license for an independent cannabis consumption lounge, a one -9
time, nonrefundable application fee of $10,000; and 10
(d) The actual costs paid by the Board to a law enforcement 11
agency or other person who is not an employee of the Board to 12
conduct any background checks in connection with the application. 13
4. The Board may charge a cannabis establishment for the 14
actual costs paid by the Board to a law enforcement agency or other 15
person who is not an employee of the Board to conduct any 16
background checks in connection with a transfer of ownership 17
interest in the cannabis establishment pursuant to the regulations 18
adopted by the Board pursuant to NRS 678B.380. 19
5. In addition to any other appl icable fees described in 20
subsections 1, 3 and 4, the Board may charge a licensee or an 21
applicant for a license the amounts specified in subsection 6 for the 22
costs incurred by the Board and its staff for an investigation 23
conducted in connection with: 24
(a) A transfer of ownership interest in a cannabis establishment 25
pursuant to the regulations adopted by the Board pursuant to 26
NRS 678B.380; 27
(b) An application for the initial issuance of a license; 28
(c) A request to obtain any approval that may be required by the 29
Board to enter into an agreement to provide management services to 30
a cannabis establishment; or 31
(d) A waiver that is requested pursuant to the provisions of this 32
title or the regulations adopted pursuant thereto. 33
6. The charges authorized by subsection 5 must be limited to: 34
(a) A reasonable hourly fee at a rate established by the Board by 35
regulation for each hour spent by agents of the Board in conducting 36
the investigation; and 37
(b) Costs for the travel expenses and per diem allowances of the 38
agents of the Board conducting the investigation. The per diem 39
allowances and travel expenses must be assessed at the rate 40
established by the State Board of Examiners for state officers and 41
employees generally. 42
7. Any revenue generated from the fees impose d pursuant to 43
this section: 44

(a) Must be expended first to pay the costs of the Board in 1
carrying out the provisions of this title; and 2
(b) If any excess revenue remains after paying the costs 3
described in paragraph (a), such excess revenue must be paid over to 4
the State Treasurer to be deposited to the credit of the State 5
Education Fund. 6
8. The Board shall not charge a licensee, registrant or applicant 7
for a license or registration card any fee, cost, fine or other charge 8
that is not expressly authorize d by the provisions of this title. Such 9
prohibited charges include, without limitation, any charge for the 10
costs of ongoing activities of the Board relating to the oversight of a 11
cannabis establishment, including, without limitation, any charge for 12
costs relating to: 13
(a) Except as otherwise provided in subsection 5, travel or 14
lodging for an agent of the Board; 15
(b) Any routine inspection or audit; 16
(c) The preparation for and attendance at a hearing by an agent 17
of the Board; 18
(d) An investigation of a c omplaint submitted to the Board by a 19
person who is not associated with the Board; or 20
(e) Except as otherwise provided in subsections 3, 4 and 5, any 21
other type of inspection, audit or investigation. 22
Sec. 6. NRS 678B.650 is hereby amended to read as follows: 23
678B.650 The Board shall adopt such regulations as it 24
determines to be necessary or advisable to carry out the provisions 25
of this chapter. Such regulations are in addition to any requirements 26
set forth in statute and must, without limitation: 27
1. Prescribe the form and any additional required content of 28
applications for licenses or registration cards issued pursuant to this 29
chapter; 30
2. Establish procedures for the suspension or revocation of a 31
license or registration card or other disciplinary action to be taken 32
against a licensee or registrant; 33
3. Set forth rules pertaining to the safe and healthful operation 34
of cannabis establishments, including, without limitation: 35
(a) The manner of protecting against diversion and theft without 36
imposing an undue burden on cannabis establishments or 37
compromising the confidentiality of consumers and holders of 38
registry identification cards and letters of approval, as those terms 39
are defined in NRS 678C.080 and 678C.070, respectively; 40
(b) Minimum requirements for the oversight of cannabis 41
establishments; 42
(c) Minimum requirements for the keeping of records by 43
cannabis establishments; 44

(d) Provisions for the security of cannabis establishments, 1
including, without limitation, requirements for the protection by a 2
fully operational security alarm system of each cannabis 3
establishment; and 4
(e) Procedures pursuant to which cannabis establishments must 5
use the services of cannabis independent testing laboratories to 6
ensure that any cannabis or cannabis product or commodity or 7
product made from hemp, as defined in NRS 557.160, sold by a 8
cannabis sales facility to an end user is tested for content, quality 9
and potency in accordance with standards established by the Board; 10
4. Establish circumstances and procedures pursuant to which 11
the maximum fees set forth in NRS 678B.390 may be reduced over 12
time to ensure that the fees imposed pursuant to NRS 678B.390 are, 13
insofar as may be practicable, revenue neutral; 14
5. Establish [different ca tegories of cannabis establishment 15
agent registration cards, including, without limitation, ] criteria for 16
issuance of a [cannabis establishment agent registration card for a 17
cannabis executive and a cannabis establishment agent ] registration 18
card [for a ca nnabis receiver ] and criteria for training and 19
certification, for each of the different types of cannabis 20
establishments at which such an agent may be employed or 21
volunteer or provide labor as a cannabis establishment agent; 22
6. As far as possible while m aintaining accountability, protect 23
the identity and personal identifying information of each person who 24
receives, facilitates or delivers services in accordance with this 25
chapter; 26
7. Establish procedures and requirements to enable a dual 27
licensee to oper ate a medical cannabis establishment and an adult -28
use cannabis establishment at the same location; 29
8. Determine whether any provision of this chapter or chapter 30
678C or 678D of NRS would make the operation of a cannabis 31
establishment by a dual licensee unreasonably impracticable; 32
9. Allow for any record relating to the delivery of cannabis or 33
cannabis products that is required to be kept by a cannabis 34
establishment to be created and maintained in an electronic format; 35
10. Prescribe the manner in which the Board will determine 36
whether a person who holds an adult -use cannabis establishment 37
license is ineligible to hold additional licenses pursuant to NRS 38
678B.325 and 678B.328; 39
11. Set forth rules pertaining to the safe and healthful operation 40
of cannabis consumption lounges, including, without limitation: 41
(a) Standards for the air quality in a cannabis consumption 42
lounge; 43

(b) Procedures and requirements for the collection and disposal 1
of cannabis and cannabis products which are left at a cannabi s 2
consumption lounge; and 3
(c) Requirements for the training of employees of a cannabis 4
consumption lounge in the sale and safe consumption of single -use 5
cannabis products and ready-to-consume cannabis products; and 6
12. Address such other matters as the Board deems necessary 7
to carry out the provisions of this title. 8
Sec. 7. The amendatory provisions of this act apply to a 9
registration card, as defined in NRS 678A.235, issued or renewed on 10
or after October 1, 2025. 11
