Legislative Counsel’s Digest:
Existing law requires the Superintendent of Public Instruction to: (1) establish 1
certain metrics of performance for public schools for each grade; and (2) on or 2
before October 1 of each year, report data relating to each metric to th e Governor, 3
the State Board of Education and the Director of the Legislative Counsel Bureau for 4
transmission to the Joint Interim Standing Committee on Education. (NRS 5
385A.080) In addition, existing law requires: (1) the Commission on School 6

Funding to re view the academic progress made by pupils in each public school 7
since the implementation of the Pupil -Centered Funding Plan and use certain 8
metrics in performing that review; and (2) each school district and charter school to 9
submit to the Commission a qua rterly report of data and metrics collected by the 10
school district or charter school to identify areas of improvement in academic 11
performance and the progress of pupils. (NRS 387.12463) Section 5 of this bill 12
removes the requirement for each school district and charter school to submit to the 13
Commission a quarterly report of such data and metrics and, instead, requires the 14
Commission to conduct an annual review of data and metrics to identify how 15
funding from the Pupil -Centered Funding Plan is being used to improve the 16
academic performance and progress of pupils. Under section 5: (1) the annual 17
review may include, without limitation, a review of data and metrics submitted to 18
the Commission by school districts and charter schools and data and metrics 19
previously reported to the Superintendent of Public Instruction or the Department 20
of Education; and (2) data and metrics previously reported by school districts and 21
charter schools to the Superintendent of Public Instruction or the Department are 22
not required to a lso be submitted to the Commission. Finally, section 1 of this bill 23
similarly requires that, to the greatest extent possible, the Superintendent of Public 24
Instruction use information previously submitted to the Superintendent or the 25
Department to prepare reports of data concerning metrics of performance for public 26
schools and to avoid duplicative requests for information. 27
Existing law requires the Department to establish and maintain an automated 28
system of accountability information for Nevada that has the capacity to provide 29
and report certain information concerning pupils in this State. (NRS 385A.800) To 30
carry out the automated system of accountability, the Superintendent of Public 31
Instruction is required to prescribe a uniform program throughout this Sta te for the 32
collection, maintenance and transfer of data, which must include standardized 33
software, and each school district is required to adopt and maintain that uniform 34
program, including, without limitation, by providing electronic data concerning 35
pupils as required by the Superintendent. (NRS 385A.810, 385A.820) Sections 2 36
and 3 of this bill clarify that this uniform program must include the collection, 37
validation and maintenance of electronic records concerning pupils and the transfer 38
of data to the De partment from electronic records maintained by each school 39
district, sponsor of a charter school and university school for profoundly gifted 40
pupils in this State. Section 3 authorizes the Superintendent of Public Instruction to 41
deduct money from certain apportionments from the State Education Fund 42
otherwise owed to a school district, charter school or university school for 43
profoundly gifted pupils to compensate the Department for costs to collect, validate 44
and maintain electronic records concerning pupils and financial accountability 45
information as necessary to report on pupil achievement and financial 46
accountability on behalf of the school district, charter school or univers ity school 47
for profoundly gifted pupils. 48
Existing law requires the Commission on Innovation and Excellence in 49
Education to develop a statewide vision and implementation plan to improve the 50
public education system in this State. (NRS 385.920) Section 4 of this bill 51
additionally requires the Commission to: (1) review the reporting, tracking, 52
monitoring, analyzing and dissemination of data relating to pupil achievement to 53
identify and recommend the elimination of reporting requirements that are 54
redundant or d o not effectively provide measurable and informative data with 55
which to assess and improve educational programs and priorities in this State; and 56
(2) present any recommendations made by the Commission to the Joint Interim 57
Standing Committee on Education an d annually transmit such recommendations to 58
the Governor and the Legislature. Section 4 also requires the Commission to: (1) 59
collaborate with the Department of Education to gather input on the reporting, 60
tracking, monitoring , analyzing and dissemination of data relating to pupil 61

achievement and financial accountability ; (2) collaborate with the Department to 62
establish a centralized repository of all reports of data relating to pupil achievement 63
and financial accountability and make the repository easily acc essible on the 64
Internet website of the Department; and (3) develop a framework for the reporting 65
of data relating to pupil achievement and financial accountability that ensures that 66
data reported to the Department identifies areas of proficiency and growth of pupils 67
in this State, identifies gaps in achievement among groups of pupils in this State 68
and provides clear, actionable data to enable the development of policies and 69
practices to improve educational outcomes in this State. 70
Section 6 this bill: (1) r epeals the requirement for the board of trustees of a 71
county school district to publish a quarterly expenditure report for the school 72
district in a newspaper that meets certain requirements; and (2) instead requires the 73
board of trustees of a county school district to publish the quarterly expenditure 74
report on the Internet website of the county school district. (NRS 387.320) 75
Existing law prohibits the ratio of pupils per licensed teacher in certain classes 76
from exceeding certain ratios during each school quarter of a school year. (NRS 77
388.700) Existing law requires the board of trustees of each school district to report 78
to the Department, on a quarterly basis, the average daily enrollment of pupils and 79
the ratio of pupils per licensed teacher for certain g rade levels. (NRS 388.725) If 80
the ratio of pupils per licensed teacher at one or more elementary schools in a 81
school district exceeds the ratio prescribed by statute during any quarter of a school 82
year, existing law requires the school district to request a variance from the State 83
Board for each such school for the subsequent quarter. (NRS 388.700) Section 7 of 84
this bill provides that: (1) the prohibition against exceeding the prescribed ratio of 85
pupils per licensed teacher in certain classes is measured fo r the entire school year 86
rather than each school quarter of a school year; and (2) a school district is required 87
to request a variance only if the ratio measured for one or more elementary schools 88
for the entire school year exceeds the prescribed ratio. Section 9 of this bill requires 89
annual reports, rather than quarterly reports, regarding the average daily enrollment 90
of pupils and the ratio of pupils per licensed teacher for certain grade levels. 91
Section 8 of this bill makes a conforming change to remove references to such 92
quarterly reports. 93
Existing law requires the governing body of each local government to: (1) 94
submit a fiscal report of the local government to the Department of Taxation in 95
accordance with the requirements prescribed by the Committee on Local 96
Government Finance; and (2) publish a summary of the fiscal report in a newspaper 97
that meets certain requirements. Under existing regulations, the summary of the 98
fiscal report published in a newspaper is: (1) required to contain certain information 99
concerning the revenues and expenditures of the general fund of the local 100
government and any proprietary fund of the local government; and (2) authorized to 101
contain such information for any other fund of the local government. Section 10 of 102
this bill elimin ates the requirement for the board of trustees of a county school 103
district to prepare and publish a summary of the fiscal report of the county school 104
district. 105
Section 11 of this bill repeals the requirement for the Department, in 106
consultation with the Bu dget Division of the Office of Finance and the Fiscal 107
Analysis Division of the Legislative Counsel Bureau, to: (1) recommend a 108
minimum amount of money to be spent during each fiscal year of the biennium on 109
textbooks, instructional supplies, instructional s oftware and instructional hardware 110
by school districts, charter schools and university schools for profoundly gifted 111
pupils; and (2) publish a report concerning school districts, charter schools and 112
university schools for profoundly gifted pupils that did not spend the recommended 113
minimum amount. (NRS 387.206, 387.2062) 114

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 385A.080 is hereby amended to read as 1
follows: 2
385A.080 1. The Superintendent of Public Instruction shall: 3
(a) Prescribe forms for the reports required pursuant to NRS 4
385A.070 and provide the forms to the respective school districts, 5
the State Public Charter School Authority, each college or university 6
within the Nevada System of Higher Education and each cit y or 7
county that sponsors a charter school. 8
(b) Provide statistical information and technical assistance to the 9
school districts, the State Public Charter School Authority, each 10
college or university within the Nevada System of Higher Education 11
and each city or county that sponsors a charter school to ensure that 12
the reports provide comparable information with respect to each 13
school in each district, each charter school and among the districts 14
and charter schools throughout this State. 15
(c) Consult with a representative of the: 16
(1) Nevada State Education Association; 17
(2) Nevada Association of School Boards; 18
(3) Nevada Association of School Administrators; 19
(4) Nevada Parent Teacher Association; 20
(5) Budget Division of the Office of Finance; 21
(6) Legislative Counsel Bureau; and 22
(7) Charter School Association of Nevada, 23
 concerning the program adopted pursuant to subsection 1 of NRS 24
385A.070 and consider any advice or recommendations submitted 25
by the representatives with respect to the program. 26
(d) Establish metrics of performance for public schools for each 27
grade which include, without limitation, metrics for: 28
(1) The growth and proficiency of pupils in literacy, 29
mathematics and science; 30
(2) The engagement and proficiency of pupils in course s for 31
college and career readiness; and 32
(3) The retention and recruitment of teachers and education 33
support professionals. 34
2. The Superintendent of Public Instruction may consult with 35
representatives of parent groups other than the Nevada Parent 36
Teacher Association concerning the program adopted pursuant to 37
subsection 1 of NRS 385A.070 and consider any advice or 38
recommendations submitted by the representatives with respect to 39
the program. 40
3. The Superintendent of Public Instruction and each school 41
district and charter school shall: 42

(a) Publish the metrics established pursuant to paragraph (d) of 1
subsection 1 on their respective Internet websites; and 2
(b) On or before October 1 of each year, report data relating to 3
each metric established pursuant to paragraph (d) of subsection 1 to 4
the Governor, the State Board and the Director of the Legislative 5
Counsel Bureau for transmission to the Joint Interim Standing 6
Committee on Education. 7
4. To obtain the information necessary to report data on 8
metrics of p erformance for public schools, the Superintendent of 9
Public Instruction shall, to the greatest extent possible, use 10
information that has previously been submitted to the 11
Superintendent or the Department and avoid duplicative requests 12
for information. 13
Sec. 2. NRS 385A.810 is hereby amended to read as follows: 14
385A.810 The board of trustees of each school district shall: 15
1. Adopt and maintain the program prescribed by the 16
Superintendent of Public Instruction pursuant to NR S 385A.820 for 17
the collection, validation and maintenance of electronic records of 18
individual pupils and the transfer of data from [the] such electronic 19
records [of individual pupils ] by the school district, the sponsor of 20
each charter school and each university school for profoundly 21
gifted pupils to the automated system of information [, including, 22
without limitation, the development of plans for the educational 23
technology which is nec essary to adopt and maintain the program; ] 24
established by the Department pursuant to NRS 385A.800; 25
2. Provide to the Department electronic data concerning pupils 26
[as required ] in accordance with the program prescribed by the 27
Superintendent of Public Instruction pursuant to NRS 385A.820 [;] , 28
including, without limitation, the data required to be reported 29
pursuant to NRS 385A.840 and any other data requested by the 30
Department to carry out its functions or required to be reported to 31
the Department by state or federal law or regulations; and 32
3. Ensure that an electronic record is maintained in accordance 33
with subsection 3 of NRS 385A.830. 34
Sec. 3. NRS 385A.820 is hereby amended to read as follows: 35
385A.820 1. The Superintendent of Public Instruction shall: 36
[1.] (a) Prescribe a uniform program throughout this State for 37
the collection, validation and maintenance of electronic records of 38
individual pupils and the transfer of data [that] from such 39
electronic records, which each school district must adopt [,] and 40
which must include standardized software; 41
[2.] (b) Prescribe the data to be collected and reported to the 42
Department by each school district and each sponsor of a charter 43
school pursuant to NRS 385A.810 and by each university school for 44
profoundly gifted pupils; 45

[3.] (c) Prescribe the format for the data; 1
[4.] (d) Prescribe the date by which each school district shall 2
report the data to the Department; 3
[5.] (e) Prescribe the dat e by which each charter school shall 4
report the data to the sponsor of the charter school; 5
[6.] (f) Prescribe the date by which each university school for 6
profoundly gifted pupils shall report the data to the Department; 7
[7.] (g) Prescribe standardized codes for all data elements used 8
within the automated system and all exchanges of data within the 9
automated system, including, without limitation, data concerning: 10
[(a)] (1) Individual pupils; 11
[(b)] (2) Individual teachers; 12
[(c)] (3) Individual schools and school districts; and 13
[(d)] (4) Programs and financial information; 14
[8.] (h) Provide technical assistance to each school district to 15
ensure that the data from each public school in the school district, 16
including, without limitation, each charter scho ol and university 17
school for profoundly gifted pupils located within the school 18
district, is compatible with the automated system of information and 19
comparable to the data reported by other school districts; and 20
[9.] (i) Provide for the analysis and reporting of the data in the 21
automated system of information. 22
2. The Superintendent of Public Instruction may deduct 23
money from the apportionment otherwise due to a school district, 24
charter school or university school for profoundly gifted pupils 25
pursuant to NRS 387.124 to compensate the Department for costs 26
to collect, validate and maintain electronic records of individual 27
pupils and financial accountability information as necessary to 28
report on pupil achievement and financial accountability on 29
behalf of the school district, charter school or university school for 30
profoundly gifted pupils , including, without limitation, costs to 31
purchase license s for software to collect, validate and maintain 32
such electronic records and financial accountability information. 33
Sec. 4. Chapter 387 of NRS is hereby amended by adding 34
thereto a new section to read as follows: 35
1. The Commission on Innovation and Excellence in 36
Education created by NRS 385.910 shall: 37
(a) Review the reporting, trac king, monitoring, analyzing and 38
dissemination of data relating to pupil achievement and financial 39
accountability for the purpose of identifying and recommending 40
the elimination of any reporting that is redundant or does not 41
effectively provide measurable and informative data with which to 42
assess and improve the educational programs and priorities of this 43
State. 44
(b) Collaborate with the Department to: 45

(1) Gather input relating to paragraph (a) from all 1
interested persons and entities; and 2
(2) Establish a centralized repository of all reports of data 3
relating to pupil achievement and financial accountability and 4
make the centralized repository easily accessible on the Internet 5
website of the Department. 6
(c) Develop a framework for the reporti ng of data relating to 7
pupil achievement and financial accountability that ensures that 8
data reported to the Department: 9
(1) Identifies areas of proficiency and growth of pupils in 10
this State; 11
(2) Identifies gaps in achievement among groups of pupils; 12
(3) Provides clear, actionable data to enable the 13
development of policies and practices to improve educational 14
outcomes in this State; and 15
(4) Is incorporated into the centralized repository 16
established pursuant to paragraph (b) and is organized into 17
portals or tabs that feature information of interest and value to 18
interested parties, including, without limitation, the Department, 19
school districts, schools, administrators, teachers and support 20
staff, elected officials and parents. 21
2. The Commission shall: 22
(a) Present any recommendations developed pursuant to 23
paragraph (a) of subsection 1 at a meeting of the Joint Interim 24
Standing Committee on Education for consideration and comment 25
by the Committee. The recommendations must include, without 26
limitation, recommendations for: 27
(1) The elimination of any requirements for the reporting 28
of data that are redundant or do not effectively provide 29
measurable and informative data with which to assess and 30
improve the educational programs and priorities of this State; and 31
(2) Any amendments of existing requirements for the 32
reporting of data that will enhance the effectiveness and 33
alignment of the reporting with the educational programs and 34
priorities of this State. 35
(b) On or before September 30 of each year, aft er 36
consideration of any comments on the recommendations made by 37
the Joint Interim Standing Committee on Education, transmit the 38
recommendations developed pursuant to paragraph (a) of 39
subsection 1 or a revised version of such recommendations to the 40
Governor and the Director of the Legislative Counsel Bureau for 41
distribution to the Legislature. 42
3. Upon the request of the Chair of the Senate Standing 43
Committee on Education or the Assembly Standing Committee on 44
Education, the Commission shall present the reco mmendations 45

developed pursuant to paragraph (a) of subsection 1 to the 1
applicable Committee for the purpose of informing legislative 2
decision-making and policy development. 3
Sec. 5. NRS 387.12463 is hereby amended to read as follows: 4
387.12463 1. The Commission shall: 5
(a) Provide guidance to school districts and the Department on 6
the implementation of the Pupil-Centered Funding Plan. 7
(b) Monitor the implementation of the Pupil -Centered Funding 8
Plan and make any recommend ations to the Joint Interim Standing 9
Committee on Education that the Commission determines would, 10
within the limits of appropriated funding, improve the 11
implementation of the Pupil -Centered Funding Plan or correct any 12
deficiencies of the Department or any school district or public 13
school in carrying out the Pupil-Centered Funding Plan. 14
(c) Review the statewide base per pupil funding amount, the 15
adjusted base per pupil funding for each school district and the 16
multiplier for weighted funding for each categor y of pupils 17
appropriated by law pursuant to NRS 387.1214 for each biennium 18
and recommend any revisions the Commission determines to be 19
appropriate to create an optimal level of funding for the public 20
schools in this State, including, without limitation, by 21
recommending the creation or elimination of one or more categories 22
of pupils to receive additional weighted funding. If the Commission 23
makes a recommendation pursuant to this paragraph which would 24
require more money to implement than was appropriated from the 25
State Education Fund in the immediately preceding biennium, the 26
Commission shall also identify a method to fully fund 27
the recommendation within 10 years after the date of the 28
recommendation. 29
(d) Review the laws and regulations of this State relating to 30
education, make recommendations to the Joint Interim Standing 31
Committee on Education for any revision of such laws and 32
regulations that the Commission determines would improve the 33
efficiency or effectiveness of public education in this State and 34
notify each school district of each such recommendation. 35
(e) Review and recommend to the Department revisions of the 36
cost adjustment factors for each county established pursuant to NRS 37
387.1215 and the method for calculating the attendance area 38
adjustment established pursuant to NRS 387.1218. 39
(f) Review the academic progress made by pupils in each public 40
school since the implementation of the Pupil -Centered Funding 41
Plan, including, without limitation, any changes to the academic 42
progress of such pupils as the r esult of any additional money 43
provided to each such school by the Pupil -Centered Funding Plan. 44
In performing such a review, the Commission shall: 45

(1) Use metrics to measure the academic achievement of 1
pupils which include, without limitation: 2
(I) The rate of graduation of pupils from high school by 3
type of diploma; 4
(II) The performance of pupils on standardized 5
examinations in math, reading and science; 6
(III) The number of credentials or other certifications in 7
fields of career and technical education earned by pupils; 8
(IV) The number of pupils who earn a passing score on an 9
advanced placement examination; 10
(V) The number of pupils who earn a passing score on an 11
international baccalaureate examination; 12
(VI) The percentage of pupils in each school who lack a 13
sufficient number of credits to graduate by the end of their 12th 14
grade year; 15
(VII) The percentage of pupils in each school who drop 16
out; 17
(VIII) The number of pupils who enroll in higher 18
education upon graduation; 19
(IX) The number of pupils who enroll in a vocational or 20
technical school or apprenticeship training program; 21
(X) The attendance rate for pupils; 22
(XI) The number of violent acts by pupils and 23
disciplinary actions against pupils; and 24
(XII) Any other metric prescribed by the Commission; 25
(2) Use metrics to measure the improvement of pupils 26
enrolled in elementary school in literacy which include, without 27
limitation: 28
(I) The literacy rate for pupils in the first, third and fifth 29
grades; 30
(II) The number of pupils in elementary school who were 31
promoted to the next grade after testing below proficient in reading 32
in the immediately preceding school year, separated by grade level 33
and by level of performance on the relevant test; 34
(III) The number of schools that employ a licensed 35
teacher designated to serve as a literacy specialist pursuant to NRS 36
388.159 and the number of schools that fail to employ and designate 37
such a licensed teacher; and 38
(IV) Any other metric prescribed by the Commission; 39
(3) Use metrics to measure the ability of public schools to 40
hire and retain sufficient staff to meet the needs of the public 41
schools which include, without limitation: 42
(I) The rate of vacancies in positions for teachers, support 43
staff and administrators; 44
(II) The attendance rate for teachers; 45

(III) The retention rate for teachers; 1
(IV) The number of schools and classrooms within each 2
school in which the number of pupils in attendance exceeds the 3
designed capacity for the school or classroom; 4
(V) The number of classes taught by a substitute teacher 5
for more than 25 percent of the school year; and 6
(VI) Any other metric prescribed by the Commission; 7
(4) Use metrics to measure the extent to which schools meet 8
the needs and expectations of pupils, par ents or legal guardians of 9
pupils, teachers and administrators which include, without 10
limitation: 11
(I) The results of an annual survey of satisfaction of 12
school employees; 13
(II) The results of an annual survey of satisfaction of 14
pupils, parents or legal guardians of pupils and graduates; and 15
(III) Any other metric prescribed by the Commission; 16
(5) Identify the progress made by each school, school district 17
and charter school on improving the literacy of pupils enrolled in 18
elementary school; 19
(6) Make recommendations for strategies to increase the 20
efficacy, efficiency, transparency and accountability of public 21
schools; and 22
(7) Make recommendations to the Department, school 23
districts and charter schools to improve the reporting, tracking, 24
monitoring, analyzing and dissemination of data relating to pupil 25
achievement and financial accountability, including, without 26
limitation, revisions to the metrics identified in subparagraphs (1) to 27
(4), inclusive. 28
(g) Review and consider strategies to improve the accessibility 29
and ensure the equitability of existing and new programs for pupils 30
within and between public schools, including, without limitation, 31
open zoning. 32
2. [Each school district and each charter school shall submit a 33
quarterly report to ] On an an nual basis, the Commission [that 34
identifies] shall review data and metrics to identify how funding 35
from the Pupil-Centered Funding Plan is being used to improve the 36
academic performance and progress of pupils . [and includes,] The 37
data and metrics reviewed pursuant to this subsection may 38
include, without limitation, all data or metrics collected and 39
submitted by [the] a school district or charter school , and all data 40
or metrics previously reported by a school district or charter 41
school to the Superintenden t of Public Instruction or the 42
Department, to demonstrate such improvement. A school district or 43
charter school must not be required to submit data or metrics for a 44
review pursuant to this subsection if the school district or charter 45

school has previously reported the data or metrics to the 1
Superintendent of Public Instruction or the Department. The 2
Commission shall [review the reports submitted pursuant to this 3
subsection and transmit the reports, ] report the results of a review 4
pursuant to this subsection , along with any commentary or 5
recommendations relating to the [reports,] review, to the Governor, 6
the Director of the Legislative Counsel Bureau, the Joint Interim 7
Standing Committee on Education and the Interim Finance 8
Committee. 9
3. After receiving [the reports ] a report submitted to the 10
Commission pursuant to subsection 2, the Governor may, with the 11
approval of the Legislature or Interim Finance Committee if the 12
Legislature is not in session, direct a school district or charter school 13
to take such re medial actions as the Governor determines to be 14
necessary and appropriate to address any deficiency identified in the 15
[reports] report submitted pursuant to subsection 2. 16
4. The Commission shall: 17
(a) Present any recommendations pursuant to paragraphs (a ) to 18
(g), inclusive, of subsection 1 at a meeting of the Joint Interim 19
Standing Committee on Education for consideration and 20
recommendations by the Committee; and 21
(b) After consideration of the recommendations of the Joint 22
Interim Standing Committee on Ed ucation, transmit the 23
recommendations or a revised version of the recommendations to 24
the Governor and the Director of the Legislative Counsel Bureau for 25
distribution to the Legislature. 26
Sec. 6. NRS 387.320 is hereby amended to read as follows: 27
387.320 [1.] During each quarter of each school year, the 28
clerk of the board of trustees of a county school district shall cause 29
to be published on the Internet website of the county school district 30
a list of expenditures of the county school district made during the 31
previous quarter school year. The published list of expenditures 32
shall be in the form prescribed by the Superintendent of Public 33
Instruction. 34
[2. The publication required by subsection 1 shall be printed in 35
some newspaper published and of general circulation in the county 36
the boundaries of which are conterminous with the boundaries of the 37
county school district. 38
3. The newspaper described in subsection 2 must possess the 39
qualifications prescribed in chapter 238 of NRS. 40
4. If no qualified newspaper is published within a county, then 41
the required publication shall be printed in some qualified 42
newspaper printed in the State of Nevada and having a general 43
circulation within the county.] 44

Sec. 7. NRS 388.700 is hereby amended to read as follows: 1
388.700 1. Except as otherwise provided in this section, for 2
[each school quarter of ] a school year, the ratio in each school 3
district of pupils per licensed teacher designated to teach, on a full-4
time basis, in classes where core curriculum is taught: 5
(a) In kindergarten and grades 1 and 2, must not exceed 16 to 1, 6
and in grade 3, must not exceed 18 to 1; or 7
(b) If a plan is approved pursuant to subsection 3 of NRS 8
388.720, must not exceed the ratio set forth in that plan for the grade 9
levels specified in the plan. 10
 In determining this ratio, all licensed educational personnel who 11
teach a grade level specified in paragraph (a) or a grade level 12
specified in a plan that is approved pursuant to subsection 3 of NRS 13
388.720, as applicable for the school district, must be counted 14
except teachers of art, music, physical education or special 15
education, teachers who teach one or two specific subject areas to 16
more than one classroom of pupils, counselors, librarians, 17
administrators, deans , specialists, any administrators or other 18
licensed educational personnel, including, without limitation, 19
counselors, coaches and special education teachers, who may be 20
present in a classroom but do not teach every pupil in the classroom 21
and teachers who are not actively teaching pupils during a class 22
period or who do not teach a subject area for which the ratio of 23
pupils per licensed teacher is being determined. 24
2. A school district may, within the limits of any plan adopted 25
pursuant to NRS 388.720, assign a pupil whose enrollment in a 26
grade occurs after the [end of a quarter during the ] beginning of a 27
school year to any existing class regardless of the number of pupils 28
in the class if the school district requests and is approved for a 29
variance from the State Board pursuant to subsection 4 [.] for the 30
school year. 31
3. Each school district that includes one or more elementary 32
schools which exceed the ratio of pupils per class during any 33
[quarter of a] school year, as reported to the Department pursuant to 34
NRS 388.725: 35
(a) Set forth in subsection 1; 36
(b) Prescribed in conjunction with a legislative appropriation for 37
the support of the class-size reduction program; or 38
(c) Defined by a legislatively approved alternative class -size 39
reduction plan, if applicable to that school district, 40
 must request a variance for each such school for [the next quarter 41
of the current school year if a quarter remains in that school year or 42
for the next quarter of ] the succeeding school year [, as applicable,] 43
from the State Board by providing a written statement that includes 44
the reasons for the request, the justification for exceeding t he 45

applicable prescribed ratio of pupils per class and a plan of actions 1
that the school district will take to reduce the ratio of pupils per 2
class. 3
4. The State Board may grant to a school district a variance 4
from the limitation on the number of pupils per class set forth in 5
paragraph (a), (b) or (c) of subsection 3 for good cause, including 6
the lack of available financial support specifically set aside for the 7
reduction of pupil-teacher ratios. 8
5. The State Board shall, on [a quarterly ] an annual basis, 9
submit a report to the Interim Finance Committee on each variance 10
requested by a school district pursuant to subsection 4 during the 11
preceding [quarter] school year and, if a variance was granted, an 12
identification of each elementary school for whic h a variance was 13
granted and the specific justification for the variance. 14
6. [The State Board shall, on or before February 1 of each odd -15
numbered year, submit a report to the Legislature on: 16
(a) Each variance requested by a school district pursuant to 17
subsection 4 during the preceding biennium and, if a variance was 18
granted, an identification of each elementary school for which 19
variance was granted and the specific justification for the variance. 20
(b) The data reported to it by the various school distric ts 21
pursuant to subsection 2 of NRS 388.710, including an explanation 22
of that data, and the current pupil -teacher ratios per class in the 23
grade levels specified in paragraph (a) of subsection 1 or the grade 24
levels specified in a plan that is approved pursua nt to subsection 3 25
of NRS 388.720, as applicable for the school district. 26
7.] The Department shall, on or before November 15 of each 27
year, report to the Chief of the Budget Division of the Office of 28
Finance and the Fiscal Analysis Division of the Legisla tive Counsel 29
Bureau: 30
(a) The number of teachers employed full-time; 31
(b) The number of teachers employed in order to attain the ratio 32
required by subsection 1; 33
(c) The number of substitute teachers filling vacancies or long -34
term positions; 35
(d) The number of pupils enrolled; and 36
(e) The number of teachers assigned to teach in the same 37
classroom with another teacher or in any other arrangement other 38
than one teacher assigned to one classroom of pupils, 39
 during the current school year in the grade levels specified in 40
paragraph (a) of subsection 1 or the grade levels specified in a plan 41
that is approved pursuant to subsection 3 of NRS 388.720, as 42
applicable, for each school district. 43

[8.] 7. The provisions of this section do not apply to a charter 1
school or to a program of distance education provided pursuant to 2
NRS 388.820 to 388.874, inclusive. 3
Sec. 8. NRS 388.723 is hereby amended to read as follows: 4
388.723 The Department shall: 5
1. Develop policies and procedures for: 6
(a) Monitoring the plan of each school district to reduce the 7
pupil-teacher ratio per class developed pursuant to NRS 388.720, 8
which must include, without limitation, provisions for: 9
(1) The review of each plan submitted to the State Board to 10
ensure the adequacy of such plans; and 11
(2) The review of any data submitted to the State Board 12
pursuant to NRS 388.710. 13
(b) Monitoring the [quarterly] reports concerning the average 14
daily enrollment of pupils and the pupil-teacher ratios in each school 15
district submitted by the board of trustees of the school district 16
pursuant to NRS 388.725 to ensure the completeness and accuracy 17
of such reports. 18
(c) The review of any requests for a variance submitted to the 19
State Board pursuant to NRS 388.700, which must include, without 20
limitation, provisions to verify the information in such requests to 21
ensure the accuracy of the reports on variances submitted by th e 22
State Board to the [Legislature] Interim Finance Committee 23
pursuant to that section. 24
(d) The distribution of money to each school district for the 25
reduction of pupil -teacher ratios, which must include, without 26
limitation, provisions for: 27
(1) The retention of all documents and records related to the 28
distribution; and 29
(2) The review of the work performed to determine the 30
distribution of such money to ensure the accuracy of supporting 31
information and the calculations used in making such 32
determinations. 33
2. Provide guidance to the school districts on: 34
(a) The development of a plan to reduce the pupil -teacher ratio 35
per class pursuant to NRS 388.720. In developing such guidance, 36
the Department shall: 37
(1) Outline the criteria that each plan must include to meet 38
the requirements of NRS 388.720. 39
(2) Provide examples of policies, plans or strategies adopted 40
by other states to reduce class sizes. 41
(b) The requirements for reporting information related to the 42
reduction of pupil-teacher ratios. 43

(c) The dat a that must be monitored pursuant to NRS 388.710 1
by each school district and used to measure the effectiveness of the 2
implementation of any plan to reduce pupil-teacher ratios. 3
3. Communicate with the board of trustees of each school 4
district regarding the expectations of the Department for the use of 5
any money distributed to reduce pupil -teacher ratios in the school 6
district, including, without limitation, the minimum number of 7
teachers the school district is expected to employ. 8
Sec. 9. NRS 388.725 is hereby amended to read as follows: 9
388.725 1. On or before August 1 [, November 1, February 1 10
and May 1] of each year, the board of trustees of each school district 11
shall report to the Department for the preceding [quarter:] school 12
year: 13
(a) Except as otherwise provided in paragraph (b), the average 14
daily enrollment of pupils and the ratio of pupils per licensed 15
teacher for grades 1, 2 and 3 for each elementary school in the 16
school district. 17
(b) If the State Board has approved an alternative class -size 18
reduction plan for the school district pursuant to NRS 388.720, the 19
average daily enrollment of pupils and the ratio of pupils per 20
licensed teacher for those grades which are required to comply with 21
the alternative cl ass-size reduction plan for each elementary school 22
in the school district. 23
2. The board of trustees of each school district shall post on the 24
Internet website maintained by the school district: 25
(a) The information concerning average daily enrollment and 26
class size for each elementary school in the school district, as 27
reported to the Department pursuant to subsection 1; and 28
(b) An identification of each elementary school in the school 29
district, if any, for which a variance from the prescribed pupil -30
teacher ratios was granted by the State Board pursuant to subsection 31
4 of NRS 388.700. 32
Sec. 10. NRS 354.6015 is hereby amended to read as follows: 33
354.6015 1. [Except as otherwise provided in subsection 3, 34
the] The governing board of a local government shall: 35
(a) [Submit] Except as otherwise provided in subsection 3, 36
submit electronically a fiscal report of the local government to the 37
Department of Taxation in accordance with the requirements 38
prescribed by the Committee on Lo cal Government Finance 39
pursuant to subsection 2; and 40
(b) [Publish] Except as otherwise provided in this paragraph, 41
publish a summary of the fiscal report, which must contain the 42
information required by the Committee on Local Government 43
Finance pursuant to subsection 2, in a newspaper of general 44
circulation in the county in which the local government is situated. 45

The board of trustees of a county school district is not required to 1
prepare or publish a summary of the fiscal report of the county 2
school district pursuant to this paragraph. 3
2. The Committee on Local Government Finance shall 4
prescribe, by regulation: 5
(a) The dates and times for filing a fiscal report, which must 6
require a local government to file at least one fiscal report per year; 7
(b) The content of a fiscal report, which must include, without 8
limitation, revenues, expenditures, fund balances, cash balances, 9
components of assessed value, debt schedules and any other 10
information that the Committee on Local Government Finance 11
determines to be appropriate for determining the financial status of a 12
local government; 13
(c) The content for a summary of a fiscal report that must be 14
published pursuant to subsection 1; and 15
(d) A uniform method for creating and submitting a fiscal report 16
electronically pursuant to this section. The method must facilitate 17
the storage and reproduction of the fiscal report in electronic format 18
by the Department of Taxation. 19
3. The Committee on Local Government Finance may 20
establish, by regulation, an exception to the requirement that a fiscal 21
report be submitted to the Department of Taxation in electronic 22
format. The exception must be limited to local governments that the 23
Committee determines do not have the financial ability to comply 24
with the method for submitting a fiscal report to the Department of 25
Taxation prescribed by the Committee. If the Committee on Local 26
Government Finance provides an exception pursuant to this 27
subsection, the Committee shall provide, by regulation, specific 28
standards that it will use to dete rmine whether a local government 29
qualifies for an exemption pursuant to this subsection. 30
4. The Committee on Local Government Finance shall adopt 31
regulations pursuant to this section in the manner prescribed for 32
state agencies in chapter 233B of NRS. 33
Sec. 10.5. The provisions of subsection 1 of NRS 218D.380 34
do not apply to any provision of this act which adds or revises a 35
requirement to submit a report to the Legislature. 36
Sec. 11. NRS 387.206 and 387.2062 are hereby repealed. 37
Sec. 12. This act becomes effective on July 1, 2025. 38

TEXT OF REPEALED SECTIONS

387.206 Recommended minimum expenditure by school
districts, charter schools and university schools for profoundly
gifted pupils for textbooks, instructional supplies, instructional
software and instructional hardware.
1. On or before August 1 of each odd -numbered year, the
Department, in consultation with the Budget Division of the Office
of Finance and the Fiscal Analysis Division of the Legislative
Counsel Bureau, shall determine a recommended minimum amount
of money to be expended during each fiscal year of a biennium for
textbooks, instructional supplies, instructional software and
instructional h ardware by all school districts, charter schools and
university schools for profoundly gifted pupils. The amount must be
determined by increasing the amount that was established for the
Fiscal Year 2004 -2005 by the percentage of the change in
enrollment be tween Fiscal Year 2004 -2005 and the fiscal year for
which the amount is being established, plus any inflationary
adjustment approved by the Legislature after Fiscal Year
2004-2005.
2. The Department, in consultation with the Budget Division of
the Office of Finance and the Fiscal Analysis Division of the
Legislative Counsel Bureau, shall develop or revise, as applicable, a
formula for determining the minimum amount of money that each
school district, charter school and university school for profound ly
gifted pupils is recommended to expend each fiscal year for
textbooks, instructional supplies, instructional software and
instructional hardware. The sum of all of the minimum amounts
determined pursuant to this subsection must be equal to the
combined minimum amount determined pursuant to subsection 1.
The formula must be used only to develop expenditure
recommendations and must not be used to alter the yearly
apportionment from the State Education Fund to school districts,
charter schools or university schools for profoundly gifted pupils.
3. Upon approval of the formula pursuant to subsection 2, the
Department shall provide written notice to each school district,
charter school and university school for profoundly gifted pupils on
or before August 15 of each odd -numbered year that sets forth the
recommended minimum combined amount of money that the school
district, charter school and university school for profoundly gifted
pupils may expend for textbooks, instructional supplies,

instructional software and instructional hardware for each fiscal year
of a biennium.
387.2062 Report concerning failure to comply with
recommended minimum expenditure.
1. On or before January 1 of each year, the Department shall
determine whether each school district, charter school and university
school for profoundly gifted pupils has expended, during the
immediately preceding fiscal year, the recommended minimum
amount of money set forth in the notice provided pursuant to
subsection 3 of NRS 387.206. In making this d etermination, the
Department shall use the report submitted by:
(a) The school district pursuant to NRS 387.303.
(b) The charter school pursuant to NRS 388A.345.
(c) The university school for profoundly gifted pupils pursuant
to NRS 388C.250.
2. Except as otherwise provided in subsection 3, if the
Department determines that a school district, charter school or
university school for profoundly gifted pupils, as applicable, has not
expended the recommended minimum amount of money set forth in
the notice or the revised notice, as applicable, provided pursuant to
subsection 3 of NRS 387.206, the Department shall publish a report
on an Internet website maintained by the Department which
identifies the difference between the actual combined expenditure
for te xtbooks, instructional supplies, instructional software and
instructional hardware and the minimum recommended combined
expenditure set forth in the notice provided pursuant to subsection 3
of NRS 387.206.
3. If the actual enrollment of pupils in a schoo l district, charter
school or university school for profoundly gifted pupils is less than
the enrollment included in the projections used in the biennial
budget of the school district submitted pursuant to NRS 387.303, the
budget of the charter school subm itted pursuant to NRS 388A.345
or the report of the university school for profoundly gifted pupils
submitted pursuant to NRS 388C.250, as applicable, the
recommended expenditure for textbooks, instructional supplies,
instructional software and instructiona l hardware pursuant to NRS
387.206 must be reduced proportionately.
