AN ACT relating to education; requiring the inclusion of certain
information regarding pupil achievement in annual reports
of accountability submitted by the boards of trustee s of
school districts, the sponsors of charter schools and the
State Board of Education; and providing other matters
properly relating thereto.
Legislative Counsel’s Digest:
Existing law requires the boards of trustees of school districts, the sponsors of 1
charter schools and the State Board of Education to prepare and publicly 2
disseminate annual reports of accountability for the quality of schools and the 3
educational achievement of pupils. (NRS 385A.070, 385A.400) Such annual 4
reports of accountability are required to include certain information concerning the 5
results of pupils on criterion -referenced examinations and the college and career 6
readiness assessment. (NRS 385A.200, 385A.410) Existing law prohibits a separate 7
reporting for a group of pupils if the number of pupils in that group is insufficient 8
to yield statistically reliable information or the results would reveal personally 9
identifiable information about an individual pupil. (NRS 385A.070, 385A.400) 10
Sections 1 and 2 of this bill require that, unless the existing prohibition on separate 11
reporting for a group of pupils applies, the boards of trustees of school districts, the 12
sponsors of charter schools and the State Board of Education must include within 13
annual reports of accountability information o n pupil achievement among pupils 14
who have accrued more than 10 absences before the first day of the period 15
prescribed by the State Board for the administration of criterion -referenced 16
examinations or the college and career readiness assessment at the schoo l of the 17
pupil, whichever is earlier. Under sections 1 and 2, this information is required to 18
be reported separately by certain pupil characteristics. 19

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 385A.200 is hereby amended to read as 1
follows: 2
385A.200 1. Except as otherwise provided in subsection 2, 3
the annual report of accountability prepared pursuant to NRS 4
385A.070 must include information on pupil achievement and 5
school performance, including, without limitati on, pupil 6
achievement for each school in the district and the district as a 7
whole, including, without limitation, each charter school sponsored 8
by the district. The board of trustees of the district shall base its 9
report on the results of the examinations administered pursuant to 10
NRS 390.105 and the college and career readiness assessment 11
administered pursuant to NRS 390.610 and shall compare the results 12
of those examinations for the school year for which the annual 13
report is being prepared with those of pr evious school years. The 14
report must include, for each school in the district, including, 15
without limitation, each charter school sponsored by the district, and 16
each grade in which the examinations and assessments were 17
administered: 18
(a) The number of pupi ls who took the examinations and a 19
record of attendance for the period in which the examinations were 20
administered, including an explanation of any difference in the 21
number of pupils who took the examinations and the number of 22
pupils who are enrolled in the school. 23
(b) Except as otherwise provided in subsection 2 of NRS 24
385A.070, pupil achievement, reported separately by gender and 25
reported separately for the groups of pupils identified in the 26
statewide system of accountability for public schools. 27
(c) A comparison of the achievement of pupils in each group 28
identified in the statewide system of accountability for public 29
schools with the performance targets established for that group. 30
(d) The percentage of pupils who were not tested. 31
(e) Except as otherwi se provided in subsection 2 of NRS 32
385A.070, the percentage of pupils who were not tested, reported 33
separately by gender and reported separately for the groups 34
identified in the statewide system of accountability for public 35
schools. 36
(f) The most recent 3 -year trend in pupil achievement in each 37
subject area tested and each grade level tested pursuant to NRS 38
390.105 and the college and career readiness assessment 39
administered pursuant to NRS 390.610, which may include 40
information regarding the trend in the a chievement of pupils for 41
more than 3 years, if such information is available. 42

(g) Except as otherwise provided in subsection 2 of NRS 1
385A.070, information on pupil achievement among pupils with 2
more than 10 absences occurring before the earlier of the first day 3
of the period prescribed by the State Board during which any 4
examination must be administered pursuant to NRS 390.105 at the 5
school of the pupil or, if the pupil is enrolled in high school, the 6
first day of the period during which the college and c areer 7
readiness assessment must be administered in all public high 8
schools as prescribed by the State Board pursuant to NRS 390.610, 9
reported separately for the groups identified in the statewide 10
system of accountability for public schools. For the purpose s of 11
this paragraph, a pupil is absent if the pupil misses an entire 12
school day, including any scheduled partial school day, regardless 13
of whether the absence is excused. 14
(h) Except as otherwise provided in subsection 3 of NRS 15
385A.720, the rating of each public school in the district, including, 16
without limitation, each charter school sponsored by the district, 17
pursuant to the statewide system of accountability for public 18
schools. 19
[(h)] (i) Information on whether each school in the district, 20
including, without limitation, each charter school sponsored by the 21
district, has made progress based upon the model adopted by the 22
Department pursuant to NRS 390.125. 23
[(i)] (j) Information that compares the results of pupils in the 24
school district, including, withou t limitation, pupils enrolled in 25
charter schools sponsored by the district, with the results of pupils 26
throughout this State. The information required by this paragraph 27
must be provided in consultation with the Department to ensure the 28
accuracy of the comparison. 29
[(j)] (k) For each school in the district, including, without 30
limitation, each charter school sponsored by the district, information 31
that compares the results of pupils in the school with the results of 32
pupils throughout the school district and th roughout this State. The 33
information required by this paragraph must be provided in 34
consultation with the Department to ensure the accuracy of the 35
comparison. 36
2. If the Department temporarily waives or otherwise pauses 37
the requirement to administer examinations that comply with 20 38
U.S.C. § 6311(b)(2) pursuant to subsection 6 of NRS 390.105, the 39
requirement of subsection 1 to include certain information in the 40
annual report of accountability prepared pursuant to NRS 385A.070 41
does not apply for the per iod of time that such a waiver or pause is 42
effective. 43

Sec. 2. NRS 385A.410 is hereby amended to read as follows: 1
385A.410 Except as otherwise provided in subsection 6 of 2
NRS 390.105, the annual report of accountability pr epared by the 3
State Board pursuant to NRS 385A.400 must include information on 4
pupil achievement and school performance, including, without 5
limitation: 6
1. Information on the achievement of all pupils based upon the 7
results of the examinations administere d pursuant to NRS 390.105 8
and the college and career readiness assessment administered 9
pursuant to NRS 390.610, reported for each school district, 10
including, without limitation, each charter school in the district, and 11
for this State as a whole. 12
2. Except as otherwise provided in subsection 2 of NRS 13
385A.400, pupil achievement, reported separately by gender and 14
reported separately for the groups of pupils identified in the 15
statewide system of accountability for public schools. 16
3. A comparison of the ach ievement of pupils in each group 17
identified in the statewide system of accountability for public 18
schools with the performance targets established for that group. 19
4. The percentage of all pupils who were not tested, reported 20
for each school district, incl uding, without limitation, each charter 21
school in the district, and for this State as a whole. 22
5. Except as otherwise provided in subsection 2 of NRS 23

385A.720, the ratin g of each public school, including, without 6
limitation, each charter school, pursuant to the statewide system of 7
accountability for public schools. 8
[8.] 9. Information on whether each public school, including, 9
without limitation, each charter school, has made progress based 10
upon the model adopted by the Department pursuant to NRS 11
390.125, if applicable for the grade level of pupils enrolled at the 12
school. 13
[9.] 10. Information on the results of pupils who participated in 14
the examinations of the National Assessment of Educational 15
Progress required pursuant to NRS 390.830. 16
Sec. 3. The provisions of NRS 354.599 do not apply to any 17
additional expenses of a local government that are related to the 18
provisions of this act. 19
Sec. 4. This act becomes effective on July 1, 2025. 20
