SUMMARY—Revises provisions relating to the organization of

AN ACT relating to education; revising provisions governing the
plan of operation for a local school precinct; revising
provisions governing the expenditure of certain money by
a local school precinct; revising provisions gove rning
members of the organizational team for a local school
precinct; revising provisions governing the duties of
certain entities when a vacancy occurs in the position of
principal for a local school precinct; requiring the
principal of a local school pre cinct to provide the
organizational team with a briefing containing certain
information; and providing other matters properly relating
thereto.
Legislative Counsel’s Digest:
Existing law provides that each public school within a school district in this 1
State which has more than 100,000 pupils enrolled in its public schools (currently 2
the Clark County School District) is deemed to be a local school precinct. (NRS 3
388G.530, 388G.600) Existing law requires the principal of a local school precinct 4
to: (1) esta blish an organizational team for the local school precinct; (2) develop a 5
plan of operation that contains a budget for the use of money allocated to the local 6
school precinct; (3) present the plan at a public meeting before the organizational 7
team conducts a vote to approve the plan; and (4) if at least 75 percent of the 8
members of the organizational team vote to approve the plan of operation, submit 9
the plan to the school associate superintendent for approval. (NRS 388G.700) 10
Section 2 of this bill requires, for each meeting at which the organizational team is 11
scheduled to vote on approval of the plan of operation, the principal to: (1) at least 12
3 days before the meeting, send a copy of the budget included in such a plan to the 13
members of the organizational team through electronic mail; and (2) provide the 14

organizational team with a report containing information regarding certain 15
expenditures. Section 3 of this bill: (1) requires the principal to, at least 3 working 16
days before holding a public meeting to pre sent a plan of operation, send a copy of 17
the agenda to the parents or legal guardian of a pupil enrolled in the local school 18
precinct unless the parents or legal guardian have opted not to receive a copy of the 19
agenda; and (2) sets forth certain requiremen ts governing the posting of the agenda 20
and minutes and plan of operation on various Internet websites maintained by the 21
large school district or the local school precinct. Finally, section 3 provides that: (1) 22
after the plan of operation has been approved, if the principal determines that an 23
adjustment to the budget is necessary, the adjustment may not be made unless the 24
principal notifies the organizational team and conducts a meeting of the 25
organizational team and school associate superintendent for any adjustment to 26
the budget in an amount of at least $80,000 for an elementary or middle school or 27
$125,000 for a high school; and (2) any expenditure of money generated by pupils 28
enrolled at the local school precinct must be approved by the organizational team. 29
(NRS 388G.710) 30
Existing law requires the organizational team for a local school precinct to 31
include elected members who are: (1) teachers or other licensed educational 32
personnel at the local school precinct; ( 2) employees of the local school precinct 33
who are not teachers or other licensed educational personnel; and (3) parents or 34
legal guardians of pupils enrolled at the local school precinct. (NRS 388G.720) 35
Section 4 of this bill: (1) prohibits the principal o f a local school precinct from 36
being elected as a member of an organizational team in any capacity other than as 37
principal; and (2) provides for the designation of certain alternate members in the 38
event of a vacancy. Section 4 additionally requires the sup erintendent of the large 39
school district to provide the staff of the large school district with a directory of 40
contact information for members of each organizational team within the large 41
school district. 42
Existing law sets forth certain requirements gover ning meetings of 43
organizational teams and the terms of members of organizational teams. (NRS 44
388G.730) Section 5 of this bill: (1) sets forth certain requirements for the school 45
associate superintendent who oversees the local school precinct concerning suc h 46
meetings; and (2) sets forth the procedure to fill a vacancy in the organizational 47
team from among the candidates who received votes in elections for members of 48
the organizational team. 49
Existing law sets forth certain duties that the organizational team and 50
superintendent of the large school district are required to carry out when a vacancy 51
occurs in the position of principal for a local school precinct. (NRS 388G.740) 52
Section 6 of this bill: (1) requires the organizational team to conduct a meeting to 53
obtain input from the public concerning the vacancy; (2) sets forth requirements for 54
how the organizational team and superintendent must use the list of qualifications 55
for candidates prepared by the organizational team; and (3) requires the 56
organizational team to hold a meeting to introduce the person selected to serve as 57
principal. 58
Existing law requires the board of trustees of each school district to submit to 59
the Superintendent of Public Instruction and the Department of Taxation an annual 60
report contai ning certain information concerning budgets and expenditures. (NRS 61
387.303) Section 1 of this bill requires the principal of a local school precinct to 62
provide the organizational team with a briefing containing certain information 63
contained in the report. 64

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 388G of NRS is hereby amended by 1
adding thereto a new section to read as follows: 2
The principal of a local school precinct shall, not later than 45 3
days after the board of trustees submits the report required 4
pursuant to NRS 387.303, provide the organizational team for the 5
local school precinct with a briefing comparing the budget 6
included in the plan of operation for the local precinct pursuant to 7
subsection 3 of NRS 388G.700 for the previous school year with 8
the actual expenditures of the local school precinct for the 9
previous school year. 10
Sec. 2. NRS 388G.700 is hereby amended to read as follows: 11
388G.700 1. The principal of a local school precinct shall: 12
(a) Establish an organizational team for the local school precinct 13
consisting of the members described in NRS 388G.720 on or before 14
October 1 of each school year; 15
(b) Develop the proposed plan of operation for the local school 16
precinct for the next school year with the assistance and advice of 17
the organizational team; 18
(c) Before any vote on a proposed plan of operation for the local 19
school precin ct, make every effort to notify the members of the 20
organizational team for the local school precinct of the date, time 21
and location of the scheduled vote; 22
(d) At least 3 days before any vote on a proposed plan of 23
operation for the local school precinct, s end a message through 24
electronic mail to the members of the organizational team for the 25
local school precinct that contains a copy of the budget included 26
in the proposed plan of operation for the local school precinct 27
pursuant to paragraph (b) of subsection 3; 28
(e) If the proposed plan of operation for the local school precinct 29
is approved by a vote of at least 75 percent of the members of the 30
organizational team for the local school precinct who are present at 31
the time of the vote, submit the proposed plan of operation to the 32
school associate superintendent for approval; [and 33
(e)] (f) If the proposed plan of operation for the local precinct is 34
not approved by a vote of at least 75 percent of the members of the 35
organizational team who are present at the time of the vote, notify 36
the school associate superintendent in accordance with NRS 37
388G.750 [.] ; and 38
(g) At each meeting in which the organizational team is 39
scheduled to vote on the proposed plan of operation for the local 40
school precinct, provide the o rganizational team with an itemized 41

report describing any expenditures that will not be completed 1
within 1 year and the reason for the timing of the expenditures. 2
2. In accordance with the applicable collective bargaining 3
agreement, the principal of the local school precinct shall select staff 4
for the local school precinct as necessary to carry out the plan of 5
operation from a list provided by the superintendent. 6
3. The plan of operation for the local school precinct must 7
include, without limitation: 8
(a) A plan to improve the achievement of pupils enrolled in the 9
local school precinct, regardless of whether such a plan is required 10
to be prepared pursuant to NRS 385A.650; and 11
(b) A budget which itemizes the manner in which the local 12
school precinct wi ll use the money allocated to the local school 13
precinct. 14
4. The budget included in the plan of operation for the local 15
school precinct pursuant to subsection 3 must be based upon the 16
average unit cost for each type of employee of the local school 17
precinct established pursuant to paragraph (a) of subsection 1 of 18
NRS 388G.650, the actual cost for the procurement of equipment, 19
services and supplies for the local school precinct and the actual cost 20
of any other item included in the budget of the local school precinct. 21
The budget must be developed in accordance with the criteria for 22
determining budgetary priorities established by the board of trustees 23
of the large school district pursuant to NRS 387.301. 24
Sec. 3. NRS 388G.710 is hereby amended to read as follows: 25
388G.710 1. Before the organizational team conducts a vote 26
on approving a plan of operation for the local school precinct, the 27
principal of the local school precinct shall present the plan at a 28
public meeting held in a ccordance with [subsection] subsections 2 29
and 3 at the local school precinct to which the plan of operation 30
applies. 31
2. The principal shall [post] : 32
(a) Post notice of the meeting not less than 3 working days 33
before the date on which the meeting will be held [.] ; 34
(b) Send a copy of the agenda for the meeting to the parents or 35
legal guardian of a pupil enrolled in the local school precinct by 36
electronic mail or through other electronic means not less than 3 37
working days before the date on which the meet ing will be held, 38
unless a parent or legal guardian of a pupil opt not to receive a 39
copy of the agenda; and 40
(c) Post a copy of the agenda and minutes for the meeting on 41
the Internet website maintained by the local school precinct. Any 42
agendas or minutes p osted pursuant to this paragraph must 43
remain posted on the Internet website maintained by the local 44
school precinct for not less than 3 years. 45

3. Members of the public must be allowed to attend any portion 1
of the meeting, except any portion of the meeti ng during which 2
confidential information is discussed, and each meeting must 3
include a period for public comment. A meeting held pursuant to 4
this [subsection] section is not subject to the provisions of chapter 5
241 of NRS. 6
[3.] 4. Before any vote on a pr oposed plan of operation for the 7
local school precinct, the principal of the local school precinct must 8
make every effort to notify the members of the organizational team 9
for the local school precinct of the date, time and location of the 10
scheduled vote. 11
[4.] 5. The principal shall not finalize the plan of operation for 12
the local school precinct unless the plan of operation has been 13
approved by at least 75 percent of the members of the organizational 14
team who are present at the time of the vote. If the pl an of operation 15
for the local school precinct is finalized by the principal, the 16
principal must submit the plan to the school associate superintendent 17
for approval. After receipt of the plan of operation pursuant to this 18
subsection, the school associate su perintendent must approve or 19
deny the plan of operation within 10 days. The plan of operation 20
must be approved unless any provision of the plan violates any 21
federal or state law or policy of the large school district. 22
[5.] 6. If the school associate superintendent: 23
(a) Approves the plan of operation for a local school precinct, 24
the school associate superintendent must notify the principal of the 25
local school precinct and cause the plan of operation to be posted on 26
the Internet website of the large school district and on the Internet 27
website of the local school precinct and make the plan of operation 28
available to any person upon request. The plan of operation must 29
remain posted on the Internet website of the large school district 30
and on the Internet website of the local school precinct for not less 31
than 5 years. 32
(b) Does not approve the plan of operation for a local school 33
precinct, the school associate superintendent must notify the 34
principal of the local school precinct of the reasons for not 35
approving the plan and post those reasons on the Internet website of 36
the large school district and on the Internet website of the local 37
school precinct and make the plan of operation available to any 38
person upon request. The school associate superintendent must 39
assist the principal as necessary to revise the plan of operation. 40
[6.] 7. [Any] For any adjustment to the budget that the 41
principal of the local school precinct determines is necessary after 42
the plan of operation has been approved pursuant to this section o r 43
NRS 388G.750 [may] : 44

(a) If the adjustment to the budget is at least $80,000 for an 1
elementary or middle school or $125,000 for a high school, the 2
adjustment may not be made unless the principal: 3
(1) Notifies the organizational team before making the 4
adjustment; and 5
(2) Schedules and holds a meeting of the organizational 6
team in accordance with subsection 3 of NRS 388G.730 and the 7
school associate superintendent not later than 10 days after the 8
notification of the adjustment unless exigent circumsta nces 9
require otherwise; or 10
(b) If the adjustment to the budget is less than $80,000 for an 11
elementary or middle school or $125,000 for a high school, the 12
adjustment may be made upon consultation with the organizational 13
team and approval of the school associate superintendent. 14
8. Before any expenditure of money generated for the local 15
school precinct by pupils enrolled at the local school precinct, the 16
organizational team must approve the expenditure. 17
Sec. 4. NRS 388G.720 is hereby amended to read as follows: 18
388G.720 1. The organizational team for a local school 19
precinct must consist of: 20
(a) The principal of the local school precinct who shall serve as 21
a voting member. 22
(b) At least two but not more than four members, as determined 23
by the principal, who are teachers or other licensed educational 24
personnel at the local school precinct who are elected by a vote of 25
the teachers and other licensed educational personnel at the local 26
school precinct and at least one -half of whom are members of the 27
association representing teachers and other licensed educational 28
personnel. The association shall establish the process for nominating 29
and electing the members pursuant to this paragraph, which must 30
allow all teachers and other lice nsed educational personnel an 31
opportunity to participate and be elected regardless of whether the 32
teachers or other licensed educational personnel are members of the 33
association. 34
(c) One member who is employed at the local school precinct, 35
other than a te acher or other licensed educational personnel, who is 36
elected by a vote of all such employees, other than teachers or other 37
licensed educational personnel, except that if four members are 38
elected pursuant to paragraph (b), then two members who are 39
elected by a vote of all such employees and who are members of an 40
organization that represents those employees. The organization that 41
represents those employees shall establish the process for 42
nominating and electing the members pursuant to this paragraph, 43
which m ust allow any eligible employee an opportunity to vote 44
regardless of whether the employee is a member of the organization. 45

(d) A number of parents or legal guardians of pupils who are 1
enrolled at the local school precinct which represents 50 percent of 2
the total number of voting members if possible, or, if fewer are 3
available to accept membership, then the greatest number of parents 4
or legal guardians available. The parents or legal guardians must be 5
elected by a vote of all parents and legal guardians of pupils 6
enrolled at the local school precinct. A parent or legal guardian who 7
is a teacher or other licensed educational personnel or employee of 8
the local school precinct may not be elected to serve as a member 9
pursuant to this paragraph, but may be electe d to serve as a member 10
of the organizational team pursuant to paragraph (b) or (c), as 11
applicable. The parents or legal guardians who receive the most 12
votes of those not elected pursuant to this paragraph must be 13
designated as alternates in the event that a vacancy must be filled 14
pursuant to paragraph (b) of subsection 7 of NRS 388G.730. The 15
association of parents for the school, if there is one, must establish 16
the process for nominating and electing these members pursuant to 17
this paragraph. If no such asso ciation exists, the principal of the 18
local school precinct must inform all parents and legal guardians of 19
the opportunity to serve on the organizational team and provide the 20
parents and guardians with information about the responsibilities 21
associated with serving as a member of the organizational team, the 22
manner in which to submit a name to be included on a ballot, the 23
date on which a vote will be taken and any other relevant 24
information. The principal must post such information on the 25
Internet website of the local school precinct and provide the 26
information to the superintendent who shall post the information on 27
the Internet website of the large school district. The information 28
must also be made available to any person upon request. 29
2. The principal of a local school precinct may not be elected 30
to an organizational team pursuant to paragraph (b), (c) or (d) of 31
subsection 1. 32
3. If one or more specialty schools exist within a local school 33
precinct, at least one member selected pursuant to paragraphs (b) 34
and (d) of subsection 1 must represent each specialty school on the 35
organizational team. 36
[3.] 4. In addition to the members described in subsection 1, if 37
the local school precinct is a middle school, junior high school or 38
high school, the organizational team must have one nonvoting 39
member who is a pupil enrolled at the local school precinct who is 40
elected by a vote of all of the pupils enrolled at the local school 41
precinct. Any pupil who attends the local school precinct may 42
request to be placed on the ballot to be elected to serve as a member 43
of the organizational team pursuant to this subsection. A teacher or 44
administrator of the local school precinct may nominate a pupil but 45

the pupil may only be placed on the ballot if the pupil agrees to have 1
his or h er name placed on the ballot. The principal of the local 2
school precinct shall cause a vote to be taken of the entire student 3
body at the local school precinct through secret ballot to elect the 4
pupil member. A member elected pursuant to this subsection ma y 5
only provide assistance and advice regarding the plan of operation 6
for the local school precinct. 7
[4.] 5. The organizational team may select one or more 8
nonvoting advisory members from the community at large to assist 9
the organizational team and provid e input from the community. 10
Such members must not be the parent or legal guardian of a pupil 11
who attends the local school precinct and must not otherwise be 12
qualified to serve as a voting member of the organizational team. 13
[5.] 6. The principal of a loca l school precinct shall assist as 14
necessary with establishing the process for nominating and electing 15
the members described in subsection 1 and shall ensure that each 16
member who is elected pursuant to paragraph (d) of subsection 1 is 17
informed that the memb er is not an employee of the local school 18
precinct or the large school district and of any potential liability for 19
serving as a member of the organizational team. 20
[6.] 7. A person who receives the highest number of votes must 21
be appointed to the organizational team regardless of the total 22
number of votes cast for the position. 23
[7.] 8. The superintendent shall, for each organizational team 24
established pursuant to NRS 388G.700, collect, organize and 25
update, as necessary, contact information for ea ch member of the 26
organizational team. The contact information collected pursuant 27
to this subsection must be compiled in an accessible directory that 28
is made available to the staff of the large school district for the 29
purpose of official communications rela ted to the operation and 30
governance of the local school precinct for which the 31
organizational team was established. 32
9. Except as otherwise provided in this subsection, an 33
organizational team and its members who are not employees of the 34
large school district are immune from liability for civil damages as a 35
result of an act or omission in performing any of the duties of the 36
organizational team as set forth in NRS 388G.700 to 388G.750, 37
inclusive [.] , and section 1 of this act. This subsection does not 38
restrict the liability of a local school precinct or the large school 39
district for an act or omission of an organizational team or its 40
members in performing the duties described in NRS 388G.700 to 41
388G.750, inclusive [.] , and section 1 of this act. 42
Sec. 5. NRS 388G.730 is hereby amended to read as follows: 43
388G.730 1. Upon the establishment of an organizational 44
team pursuant to NRS 388G.700, the principal of the local school 45

precinct shall schedule the first meeting of the team and act as the 1
chair of the team until a chair is selected. The first item of business 2
for the organizational team must be to select a chair and vice chair 3
from among its members. 4
2. A majority of the voting members of the organizational team 5
constitutes a quorum for purposes of voting. A majority vote of the 6
quorum is required to take action with respect to any matter. 7
3. Notice of a meeting of the organizational team must be 8
posted not less than 3 working days before the date on which the 9
meeting will be held. Members of the public must be allowed to 10
attend any portion of the meeting, except any portion of the meeting 11
during which confidential information is discussed, and each 12
meeting must include a period for public comment. A meeting held 13
pursuant to this subsection is not subject to the provisions of chapter 14
241 of NRS. 15
4. Each school associate superintendent shall: 16
(a) Each year, attend at least one meeting of the 17
organizational team for each local school precinct overseen by the 18
school associate superintendent; and 19
(b) On or before November 1 of each year, send a message 20
through electronic mail to each member of each such 21
organizational team which contains: 22
(1) Instructions for accessing any relevant training 23
materials; and 24
(2) Directions for communicating with the school associate 25
superintendent concerning oversight of the principal of a local 26
school precinct. 27
5. Each member of the organizational team serves until 28
October 1 of the year following his or her election and ma y serve 29
additional terms. 30
[5.] 6. The organizational team must meet not less than one 31
time each month during the school year. 32
[6.] 7. If a vacancy occurs in the membership of the 33
organizational team [, a] : 34
(a) For a member elected pursuant to paragraph ( b) or (c) of 35
subsection 1 of NRS 388G.720, the new member must be [elected 36
in the same manner as the original selection, ] the candidate who 37
received the next highest number of votes in the immediately 38
preceding election, and the vacancy must be filled within 30 days. 39
If there is no candidate remaining who received votes in the 40
immediately preceding election, the vacancy must be filled by 41
electing a new member in the same manner as the original 42
selection. 43
(b) For a member elected pursuant to paragraph ( d) of 44
subsection 1 of NRS 388G.720, the new member must be an 45

alternate designated pursuant to that paragraph, and the vacancy 1
must be filled within 30 days. If there is no such alternate 2
remaining, the vacancy must be filled by electing a new member in 3
the same manner as the original selection. 4
[7.] 8. Each member of the organizational team [serves] : 5
(a) Serves without compensation of any kind. 6
(b) Whether he or she is an employee of the local school 7
precinct, is entitled to receive the same informati on necessary to 8
carry out the duties of the organizational team, as set forth in NRS 9
388G.700 to 388G.750, inclusive, and section 1 of this act. 10
Sec. 6. NRS 388G.740 is hereby amended to read as follows: 11
388G.740 1. An organizational team shall: 12
(a) Provide assistance and advice to the principal of the local 13
school precinct regarding the development of the plan of operation 14
for the local school precinct and vote on whether to approve that 15
plan of operation; 16
(b) Provide continued assistance and advice to the principal of 17
the local school precinct in carrying out the plan of operation for the 18
local school precinct; and 19
(c) Whenever a vacancy occurs in the position of principal for 20
the local school precinct, assist with t he selection of the next 21
principal in accordance with the provisions of this section. 22
2. The organizational team may provide input regarding the 23
principal of the local school precinct to the school associate 24
superintendent not more than two times each school year. 25
3. Whenever a vacancy occurs in the position of principal for 26
the local school precinct, the organizational team shall [establish] : 27
(a) Not later than 7 business days after receiving notice of the 28
vacancy: 29
(1) Schedule a meeting, which mus t be held not later than 30
14 days after receiving such notice, for the purpose of receiving 31
input from pupils enrolled in the local school precinct, parents or 32
legal guardians of such pupils and employees of the local school 33
precinct concerning the needs of the local school precinct and any 34
qualifications desired for a candidate for the position of principal 35
for the local school precinct; and 36
(2) Notify the large school district of the meeting scheduled 37
pursuant to subparagraph (1) and the large school dis trict shall 38
send an electronic communication to each parent or legal 39
guardian of a pupil enrolled in the local school precinct and 40
employee of the local school precinct that provides notice of the 41
meeting scheduled pursuant to subparagraph (1); and 42
(b) After considering any input received during the meeting 43
held pursuant to paragraph (a), establish a list of qualifications 44
that the organizational team [determines] recommends are desirable 45

for the next principal of the local school precinct and provide the list 1
to the superintendent. The list of qualifications must include, 2
without limitation, qualifications relating to the: 3
[(a)] (1) Employment history of the candidate; 4
[(b)] (2) Ability of the candidate to connect and 5
communicate with pupils; 6
[(c)] (3) Ability of the candidate to provide a safe and 7
respectful learning environment pursuant to NRS 388.1321; and 8
[(d)] (4) Strategies the candidate would implement to 9
improve the achievement of pupils. 10
4. The superintendent shall post notice of the vacancy pursuant 11
to subsection 3. [The superintendent shall interview qualified 12
candidates and establish a list of at least three but not more than five 13
candidates to submit to the organizational team. One me mber] The 14
notice must include the list of qualifications established by the 15
organizational team pursuant to paragraph (b) of subsection 3. 16
The large school district shall examine the list of candidates and 17
conduct an interview of at least 5 but not more than 10 candidates, 18
unless fewer than 5 candidates applied to fill the vacancy, in 19
which case an interview must be conducted of all candidates. At 20
least two members of the organizational team must [be allowed to ] 21
participate in interviewing candidates with t he superintendent [.] , 22
including, at least one member elected pursuant to paragraph (b) 23
of subsection 1 of NRS 388G.720 and one member elected 24
pursuant to paragraph (d) of subsection 1 of NRS 388G.720. Such 25
an interview must not be conducted unless at least two members of 26
the organizational team are present at the interview. 27
5. From the list of candidates submitted by the superintendent 28
pursuant to subsection 4, the organizational team shall rank the 29
candidates for the position of principal by preference and submit a 30
list with that ranking within 15 school days after receipt of the 31
recommendation. The superintendent, in consultation with the 32
school associate superintendent, must select a candidate to hire for 33
the position of principal. Before any vote on the selected candidate, 34
the school associate superintendent responsible for the local school 35
precinct must make every effort to notify the members of the 36
organizational team for the local school precinct of the date, time 37
and location of the scheduled vote . The organizational team may 38
reject the selection of the candidate if at least 75 percent of the 39
members of the organizational team who are present at the time of 40
the vote elect to do so. The superintendent must then select a 41
candidate from the remaining members of the list submitted 42
pursuant to subsection 4. Not later than 10 days after the selection 43
of a candidate, the organizational team must hold a meeting at the 44

local school precinct to introduce the candidate selected to serve as 1
principal of the local school precinct. 2
6. Each person who participates in interviewing candidates 3
pursuant to this section shall comply with all laws that apply to an 4
employer when making a decision about employment. 5
7. After the principal of the local school precinct is hired, the 6
superintendent may, in his or her sole discretion, reassign and make 7
other employment decisions concerning the principal. 8
8. As used in this section, “electronic communication” means 9
the communication of any written, verbal or pictorial infor mation 10
through the use of an electronic device, including, without 11
limitation, a telephone, cellular telephone, electronic mail or any 12
similar means of communication. 13
Sec. 7. This act becomes effective on July 1, 2025. 14
