AN ACT relating to the Department of Motor Vehicles; directing
the Department of Motor Vehicles to cease using certain
existing electronic systems relating to appointments for
document preparation services; and providing other
matters properly relating thereto.
Legislative Counsel’s Digest:
Existing law establishes requirements for the registration and practice of a 1
person as a document preparation service. (Chapter 240A of NRS) Existing law 2
requires the Department of Motor Ve hicles to maintain certain public service 3
windows or locations dedicated to serving document preparation services 4
conducting transactions on behalf of clients. (NRS 481.062) This bill requires the 5
Department to immediately cease the use of any existing ele ctronic system of the 6
Department for the scheduling or granting of appointments for document 7
preparation services that: (1) denies or limits the ability of a document preparation 8
service to schedule or receive an appointment based solely on certain factors related 9
to the longevity of the document preparation service; or (2) grants certain document 10
preparation services more favorable or expansive access to appointments or the 11
ability to schedule appointments for reasons unrelated to misconduct. 12

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. 1. The Department of Motor Vehicles shall 1
immediately cease the use of any existing electronic system of the 2

Department for the scheduling or granting of appointments for 1
document preparation services that: 2
(a) Denies or limits the ability of a document preparation service 3
to schedule or receive an appointment with the Department based 4
solely on: 5
(1) The point in time at which the service began conducting 6
transactions with the Department on behalf of clients; or 7
(2) The duration of time that the servi ce has been conducting 8
transactions with the Department on behalf of clients in comparison 9
with the duration of time that other document preparation services 10
have been conducting such transactions with the Department; or 11
(b) Grants certain document preparation services more favorable 12
or expansive access to appointments or the ability to schedule 13
appointments than is available to other document preparation 14
services for reasons unrelated to misconduct by the document 15
preparation service. 16
2. As used in this section, “document preparation service” 17
means a document preparation service registered pursuant to chapter 18
240A of NRS. 19
Sec. 2. This act becomes effective upon passage and approval. 20
