AN ACT relating to energy; requiring certain wholesale facilities for
the generation of electricity to purchase power from
certain small electric utilities; requiring a provid er of
electric service that serves a wholesale generation facility
in the service territory of certain small electric utilities to
make certain payments to the utility ; and providing other
matters properly relating thereto.
Legislative Counsel’s Digest:
Existing law provides for the issuance of a certificate of public convenience 1
and necessity to certain cooperative associations, nonprofit corporations and 2
nonprofit associations that provide electric service to their members. (NRS 3
704.677) Existing law also authorizes certain local governmental entities to provide 4
electric service. (Chapters 709 and 710 of NRS) This bill requires certain wholesale 5
facilities for the generation of electricity which are located within the service 6
territory of such a cooperati ve association, nonprofit corporation or nonprofit 7
association or municipal utility to purchase the energy required to operate, maintain 8
or repair the facility from the cooperative association, nonprofit corporation or 9
nonprofit association or municipal ut ility. This bill further requires the facility to: 10
(1) adhere to all rules, rates and policies established by the governing board of the 11
cooperative association, nonprofit corporation or nonprofit association or municipal 12
utility relating to the delivery o f and payment for power; and (2) authorize a 13
cooperative association, nonprofit corporation or nonprofit association or municipal 14
utility to install or certify the proper operation of a meter to accurately measure and 15
provide accurate monthly readings of the energy use of the facility. This bill 16
further: (1) authorizes a cooperative association, nonprofit corporation, nonprofit 17

association or municipal utility to charge certain rates to the wholesale generation 18
facility; and (2) requires a provider of elec tric service that provides power to a 19
wholesale generation facility in the service territory of the cooperative association, 20
nonprofit corporation, nonprofit association or municipal utility to make certain 21
payments to the cooperative association, nonprofi t corporation, nonprofit 22
association or municipal utility. 23

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 701 of NRS is hereby amended by adding 1
thereto a new section to read as follows: 2
1. A wholesale generation facility in this State which becomes 3
operational on or after January 1, 2026, and is located within the 4
service territory of a rural electric utility shall: 5
(a) Purchase its station power from the rural electric utility, 6
unless otherwise provided in a wri tten agreement between the 7
wholesale generation facility and the rural electric utility. 8
(b) Adhere to all rules, rates and policies established by the 9
governing board of the rural electric utility relating to the delivery 10
of and payment for station power. 11
(c) Authorize the rural electric utility to install or certify the 12
proper operation of a meter that measures the use of station power 13
by a wholesale generation facility and provides the rural electric 14
utility with accurate monthly readings of that use. 15
2. A rural electric utility may charge to a wholesale 16
generation facility a retail rate for station power which is 17
commensurate with the rate the rural electric utility charges to 18
customers in its service territory with comparable load 19
magnitudes, load factors and other relevant characteristics. 20
3. If a wholesale generation facility receives station power 21
from a provider of electric service other than the rural electric 22
utility for the service territory in which the wholesale generation 23
facility is located, the provider of electric service shall remit to the 24
rural electric utility an amount equal to the payment which the 25
wholesale generation facility would have paid for such station 26
power if provided by the rural electric utility. 27
4. As used in this section: 28
(a) “Municipal electric utility” includes, without limitation: 29
(1) An electric utility established pursuant to chapter 709 or 30
710 of NRS. 31
(2) Any other electric utility that is owned, operated or 32
controlled by a county, city or other local governmental entity. 33
(b) “Rural electric utility” means: 34

(1) A cooperative association, nonprofit corporation, 1
nonprofit association or provider of electric service which is 2
declared to be a public utility pursuant to NRS 704.673 and which 3
provides service only to its members; or 4
(2) A municipal electric utility which provides electric 5
service to fewer than 100,000 retail electric meters. 6
(c) “Station power” means energy used on the site of a 7
wholesale generation facility for the operation, maintenance o r 8
repair of the facility, including, without limitation, energy used for 9
lighting, thermal regulation, fuel processing and powering 10
equipment. The term: 11
(1) Includes any such load: 12
(I) That is served by a provider of electric service over a 13
distribution line that is connected to the system of the provider of 14
electric service at a point that is separate from the switchyard 15
where a generation or storage resource of the wholesale 16
generation facility is connected to the transmission system; or 17
(II) That is served by the system of a provider of electric 18
service that is connected to the transmission system at the same 19
point as a generation or storage resource of the wholesale 20
generation facility during any period when the generation or 21
storage resource is idle. 22
(2) With respect to a wholesale generation facility which 23
generates electricity from geothermal resources, does not include 24
energy used to operate fans or pumps or parasitic loads associated 25
with the production of electricity from a geothermal resource. 26
(d) “Wholesale generation facility” means a facility for the 27
generation of electricity that has a capacity in excess of 1 28
megawatt and: 29
(1) Is not affiliated through common ownership with an 30
end-use customer that purchases electricity; and 31
(2) Does not provide the electricity generated by the facility 32
directly and exclusively to the end -use customer described in 33
subparagraph (1). 34
Sec. 2. 1. This section becomes effective upon passage and 35
approval. 36
2. Section 1 of this act becomes effective: 37
(a) Upon passage and approval for the purpose of adopting any 38
regulations and performing any other preparatory administrative 39
tasks that are necessary to carry out the provisions of this act; and 40
(b) On January 1, 2026, for all other purposes. 41
