AN ACT relating to public employees; exempting certain teachers
and licensed educational personnel and their employee
organizations, bargaining agents and bargaining units
from the prohibition against public employees engaging
in a strike against a public employer; and providing other
matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 288 of NRS (Relations between 1
Governments and Public Employees) is hereby amend ed to read as 2
follows: 3
NRS 288.720 Prohibitions on strikes do not apply to certain 4
local government employees, employee organizations, bargaining 5
agents, and bargaining units. 6
1. Notwithstanding any law to the contr ary, the provisions of 7
NRS 288.700 through NRS 288.715 and any other law prohibiting 8
strikes shall not apply to local government employees licensed as 9
teachers pursuant to Chapter 391 of the Nevada Revised Statutes 10
and t heir employee organizations, bargaining agents, and 11
bargaining units. 12
2. As used in this section: “teacher” means a person licensed 13
pursuant to chapter 391 of NRS who is classified by the board of 14
trustees of a school district: 15
(a) As a teacher and who spends at least 50 percent of his or 16
her work year providing instruction or discipline to pupils; 17
(b) As instructional support staff, who does not hold a 18
supervisory position and who spends not more than 50 percent of 19
his or her work year providing inst ruction to pupils. Such 20

instructional support staff includes, without limitation, librarians 1
and persons who provide instructional support; or 2
(c) As school counselors, school nurses and other employees 3
who spend at least 50 percent of their work year pr oviding 4
emotional support, non instructional guidance or medical support 5
to pupils. 6
Section 2. Severability. If any provision of this act, or the 7
application therefore to any person, thing or circumstance is held 8
invalid or unconstitutional by a court of competent jurisdiction, such 9
invalidity or unconstitutionality shall not affect the validity or 10
constitutionality of this act as a whole or any provision or 11
application of this act which can be given effect without the invalid 12
or unconstitutional provisi on or application, and to this end the 13
provisions of this act are declared to be severable. 14
Section 4. This act shall become effective if approved by the 15
legislature, or upon passage and approval by the voters. 16
