AN ACT relating to common -interest communities; enacting provisions relating to
the installation and maintenance of electric vehicle charging stations
within a common -interest community; and providing other matters
properly relating thereto.
Legislative Counsel’s Digest:
Existing law requires the unit -owners’ association of a common -interest community to 1
adopt bylaws and authorizes an association to amend bylaws and adopt rules and regulations 2
relating to the community. (NRS 116.3102) This bill: (1) authorizes an association to install 3
an electric vehicle charging station [in a ] on the common [area] elements under certain 4
circumstances; (2) authorizes an association to enter into a necessary contract for the 5
installation or maintenance of an electric vehicle charging station [in a] on the common [area] 6
elements after complying with certain requirements; and (3) provides that the installation and 7
maintenance of an electric vehicle charging station [in a ] on the common [area] elements 8
shall be deemed not to constitute a change in use of the common [area,] elements, a 9
commercial use of the common [area] elements or a capital improvement. 10
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 116 of NRS is hereby amended by adding thereto a new 1
section to read as follows: 2
1. Notwithstanding any provision in the governing documents or this 3
chapter to the contrary: 4
(a) An association may install an electric vehicle charging station [in a] on 5
the common [area] elements if: 6
(1) The location [in] on the common [area] elements is not being used 7
for recreation, including, without limit ation, being used as a park, playground or 8
open play space; 9
(2) [A majority of the units’ owners, whether present in person or by 10
proxy, do not reject the proposed electric vehicle charging station by vote at a 11

regular meeting of the executive board where the installation of the proposed ] 1
The decision of the executive board to install an electric vehicle charging station 2
is [an agenda item listed for discussion; ] ratified by units’ owners in accordance 3
with the provisions of subsection 2; 4
(3) The association complies with the provisions of subsection 3 of NRS 5
116.345; and 6
(4) Placement of the electric vehicle charging station in that location 7
does not [increase any cost to any unit owner or ] violate any applicable zoning 8
ordinance, permit or approval. 9
(b) An association may, after complying with the provisions of 10
subparagraphs (1) to (4), inclusive, of paragraph (a), enter into any necessary 11
contract with any person for the installation or maintenance of an electric vehicle 12
charging station [in a] on the common [area.] elements. 13
(c) The installation and maintenance of an electric vehicle charging station 14
[in a] on the common [area] elements shall be deemed not to constitute: 15
(1) A change in use of the common [area;] elements; 16
(2) A commercial use of the common [area;] elements; or 17
(3) A capital improvement. 18
2. Within 60 days after the executive board decides to install an electric 19
vehicle charging station on the common elements pursuant to this section, the 20
executive board shall notify each unit’s owner of the decision and shall set a date 21
for a meeting of the units’ owners to consider ratification of the decision not less 22
than 14 days or more than 30 days after notifying the units’ owners. Unless at 23
that meeting a majority of all units ’ owners reject the decision of the executive 24
board to install an electric vehicle charging station on the common elements, the 25
decision of the executive board is ratified, whether or not a quorum is present. 26
3. If the decision of the executive board to install an electric vehicle 27
charging station on the common elements is ratified by the units’ owners 28
pursuant to subsection 2 and the association will be responsible for the operation 29
of the electric vehicle charging station, then the association may adopt rules and 30
regulations governing the use of the electric vehicle charging station that include, 31
without limitation: 32
(a) Establishing limitations on the hours that the electric vehicle charging 33
station may be used; 34
(b) Determining the manner in which user s of the electric vehicle charging 35
station are billed for such use; and 36
(c) Establishing any other necessary and appropriate rules or regulations 37
relating to the use of the electric vehicle charging station. 38
4. As used in this section, “electric vehicle charging station” means a 39
station that delivers electricity from a source outside an electric vehicle into one 40
or more electric vehicles. The term includes, without limitation, an electric 41
vehicle charging station where several charge points simultaneousl y connect 42
several electric vehicles to the station and any related equipment needed to 43
facilitate charging electric vehicles. 44
