AN ACT relating to collective bargaining; removing the exemption
from compliance with any provision of existing law
requiring a meeting to be open or public for certain
proceedings concerning collective bargaining between
public employers and public employ ees; and providing
other matters properly relating thereto.
Legislative Counsel’s Digest:
Existing law exempts from any provision of existing law which requires a 1
meeting to be open or public certain proceedings conducted relating to collective 2
bargaining between public employers and public employees. Proceedings subject to 3
the exemption include, among others: (1) any negotiation or informal discussion 4
between a local government employer and an employee organization or employees 5
as individuals or between the Executive Department of State Government and a 6
labor organization or employees as individuals; (2) any meeting of a mediator with 7
either party or both parties to a negotiation; and (3) any meeting or investigation 8
conducted by a fact finder or arbitrat or. (NRS 288.220, 288.590) Sections 1 and 2 9
of this bill remove the exemption for those specified proceedings. 10

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 288.220 is hereby amended to read as follows: 1
288.220 The following proceedings, required by or pursuant to 2
this chapter, are not subject to any provision of NRS which requires 3
a meeting to be open or public: 4

1. [Any negotiation or informal discussion between a local 1
government employer and an employee orga nization or employees 2
as individuals, whether conducted by the governing body or through 3
a representative or representatives. 4
2. Any meeting of a mediator with either party or both parties 5
to a negotiation. 6
3. Any meeting or investigation conducted by a fact finder. 7
4.] Any meeting of the governing body of a local government 8
employer with its management representative or representatives. 9
[5.] 2. Deliberations of the Board toward a decision on a 10
complaint, appeal or petition for declaratory relief. 11
Sec. 2. NRS 288.590 is hereby amended to read as follows: 12
288.590 [The following proceedings, required by or conducted 13
pursuant to this chapter, are not subject to any provision of NRS 14
which requires a meeting to be open or public: 15
1. Any negotiation or informal discussion between the 16
Executive Department and a labor organization or employees as 17
individuals. 18
2. Any meeting of a mediator with either party or both parties 19
to a negotiation. 20
3. Any meeting or investigation conducted by an arbitrator. 21
4.] Deliberations of the Board toward a decision on a 22
complaint, appeal or petition for declaratory relief [.] are not subject 23
to any provision of NRS which requires a meeting to be open or 24
