AN ACT relating to common -interest communities; providing that
certain complaints, documents and information filed with
the Real Estate Division of the Department of Business
and Industry and certain documents and information
relating to such complaints and the i nvestigation thereof
are public records; and providing other matters properly
relating thereto.
Legislative Counsel’s Digest:
Existing law requires the Real Estate Division of the Department of Business 1
and Industry to keep confidential, with certain exce ptions, a complaint filed with 2
the Division alleging a violation of existing law, all documents and other 3
information filed with the complaint and all documents and other information 4
compiled as a result of an investigation conducted to determine whether t o initiate 5
disciplinary action. (NRS 116A.270) Section 1 of this bill provides instead that 6
such a complaint and all such documents and information are public records. 7
Section 2 of this bill makes a conforming change to reflect that such a complaint 8
and all such documents and information are public records and no longer 9
confidential under any circumstances pursuant to section 1. 10

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 116A.270 is hereby amended to read as 1
follows: 2
116A.270 [1. Except as otherwise provided in this section 3
and NRS 239.0115, a ] A complaint filed with the Division alleging 4
a violation of this chapter or chapter 116 or 116B of NRS, all 5

documents and other information filed with the complaint and all 1
documents and other information compiled as a result of an 2
investigation conducted to determine whether to initiate disciplinary 3
action are [confidential. 4
2. The Division shall not disclose any information that is 5
confidential pursuant to subsection 1, in whole or in part, to any 6
person, including, without limitation, a person who is the subject of 7
an investigation or complaint, unless and until a formal complaint is 8
filed pursuant to subsection 3 and the disclosure is required pursuant 9
to subsection 3, except that the Division may disclose the 10
information described in subsection 1 as nec essary in the course of 11
administering this chapter or to a licensing board or agency or any 12
other governmental agency, including, without limitation, a law 13
enforcement agency, that is investigating a person who holds a 14
certificate or registration issued pursuant to this chapter. 15
3. The formal complaint or other charging documents filed by 16
the Administrator with the Commission to initiate disciplinary 17
action and all documents and other information considered by the 18
Commission or a hearing panel when determ ining whether to 19
impose discipline are] public records. 20

and public records of a governmental entity must be open at all 25
times during office hours to inspection by any person, and may be 26
fully copied or an abstract or memorandum may be prepared from 27
those public books and public records. Any such copies, abstracts or 28
memoranda may be u sed to supply the general public with copies, 29
abstracts or memoranda of the records or may be used in any other 30
way to the advantage of the governmental entity or of the general 31
public. This section does not supersede or in any manner affect the 32
federal laws governing copyrights or enlarge, diminish or affect in 33
any other manner the rights of a person in any written book or 34
record which is copyrighted pursuant to federal law. 35
2. A governmental entity may not reject a book or record 36
which is copyrighted solely because it is copyrighted. 37
3. A governmental entity that has legal custody or control of a 38
public book or record shall not deny a request made pursuant to 39
subsection 1 to inspect or copy or receive a copy of a public book or 40
record on the basis that the requested public book or record contains 41
information that is confidential if the governmental entity can 42
redact, delete, conceal or separate , including, without limitation, 43
electronically, the confidential information from the information 44

included in the public book or record that is not otherwise 1
confidential. 2
4. If requested, a governmental entity shall provide a copy of a 3
public record in an electronic format by means of an electronic 4
medium. Nothing in this subsection requires a governmental entity 5
to provide a copy of a public record in an electronic format or by 6
means of an electronic medium if: 7
(a) The public record: 8
(1) Was not created or prepared in an electronic format; and 9
(2) Is not available in an electronic format; or 10
(b) Providing the public record in an electronic format or by 11
means of an electronic medium would: 12
(1) Give access to proprietary software; or 13
(2) Require the production of information that is confidential 14
and that cannot be redacted, deleted, concealed or sepa rated from 15
information that is not otherwise confidential. 16
5. An officer, employee or agent of a governmental entity who 17
has legal custody or control of a public record: 18
(a) Shall not refuse to provide a copy of that public record in the 19
medium that is requested because the officer, employee or agent has 20
already prepared or would prefer to provide the copy in a different 21
medium. 22
(b) Except as otherwise provided in NRS 239.030, shall, upon 23
request, prepare the copy of the public record and shall not requ ire 24
the person who has requested the copy to prepare the copy himself 25
or herself. 26
