AN ACT relating to governmental administration; imposing certain
requirements and prohibitions on a state or local
governmental agency that collects certain demographic
information; and providing other matters properly relating
thereto.
Legislative Counsel’s Digest:
Existing law regulates the collection of certain personal information by the 1
State and local governments. ( See, e.g. , chapter 239B of NRS) For example, 2
existing law authorizes certain criminal justice agencies, and requires other state 3
and local governmental agencies, that collect information from persons related to 4
their race or ethnicity to include a separate category for persons of Middle Eastern 5
or North African descent. (NRS 239B.028) Section 2 of this bill, with certain 6
exceptions, prescribes requirements for the collection and tabulation by a state or 7
local governmental agency, directly or by contract, of information concerning the 8
race or ethnicity of persons in this State who self -identify a s Asian, Native 9
Hawaiian or Pacific Islander. Specifically, section 2 requires such a governmental 10
agency to request any information concerning the race or e thnicity of such a person 11
in not more than one question. Section 2 also mandates that such a governmental 12
agency use separate categories for the collection and tabulation of the information, 13
including: (1) for the category of persons who self -identify as Asian, an option to 14
self-identify as Chinese, Vietnamese, Asian Indian, Korean, Filipino or Japanese or 15
to specify another subcategory; and (2) for the categ ory of persons who self -16
identify as Native Hawaiian or Pacific Islander, an option to self -identify as Native 17

Hawaiian, Samoan, Chamorro, Tongan, Fijian or Marshallese or to specify another 18
subcategory. 19
Additionally, section 2 requires that a governmental agency ensure that any 20
personally identifiable information in the information collected by the 21
governmental agency concerning the race or ethnicity of per sons in this State who 22
self-identify as Asian, Native Hawaiian or Pacific Islander be kept confidential. 23
With certain exceptions, section 2 also requires tha t the governmental agency: (1) 24
make such information collected by the governmental agency available to the 25
public by publishing the information on its Internet website; and (2) include such 26
information in any demographic report concerning the race or ethni city of persons 27
in this State that is published by the governmental agency. Finally, section 2 28
prohibits the governmental agency from denying services or as sistance to a person 29
who fails or refuses to provide such information. Section 1 of this bill makes a 30
conforming change to reflect that certain information collected by such a 31
governmental agency in accordance with section 2 is not a public record. 32

of Nevada 2013 and unless otherwise declared by law to be 21
confidential, all public boo ks and public records of a governmental 22
entity must be open at all times during office hours to inspection by 23
any person, and may be fully copied or an abstract or memorandum 24
may be prepared from those public books and public records. Any 25
such copies, abst racts or memoranda may be used to supply the 26
general public with copies, abstracts or memoranda of the records or 27
may be used in any other way to the advantage of the governmental 28
entity or of the general public. This section does not supersede or in 29
any manner affect the federal laws governing copyrights or enlarge, 30
diminish or affect in any other manner the rights of a person in any 31
written book or record which is copyrighted pursuant to federal law. 32
2. A governmental entity may not reject a book or rec ord 33
which is copyrighted solely because it is copyrighted. 34
3. A governmental entity that has legal custody or control of a 35
public book or record shall not deny a request made pursuant to 36
subsection 1 to inspect or copy or receive a copy of a public book or 37
record on the basis that the requested public book or record contains 38
information that is confidential if the governmental entity can 39
redact, delete, conceal or separate, including, without limitation, 40
electronically, the confidential information from t he information 41
included in the public book or record that is not otherwise 42
confidential. 43
4. If requested, a governmental entity shall provide a copy of a 44
public record in an electronic format by means of an electronic 45

medium. Nothing in this subsection r equires a governmental entity 1
to provide a copy of a public record in an electronic format or by 2
means of an electronic medium if: 3
(a) The public record: 4
(1) Was not created or prepared in an electronic format; and 5
(2) Is not available in an electronic format; or 6
(b) Providing the public record in an electronic format or by 7
means of an electronic medium would: 8
(1) Give access to proprietary software; or 9
(2) Require the production of information that is confidential 10
and that cannot be redacted, del eted, concealed or separated from 11
information that is not otherwise confidential. 12
5. An officer, employee or agent of a governmental entity who 13
has legal custody or control of a public record: 14
(a) Shall not refuse to provide a copy of that public record in the 15
medium that is requested because the officer, employee or agent has 16
already prepared or would prefer to provide the copy in a different 17
medium. 18
(b) Except as otherwise provided in NRS 239.030, shall, upon 19
request, prepare the copy of the public re cord and shall not require 20
the person who has requested the copy to prepare the copy himself 21
or herself. 22
Sec. 2. Chapter 239B of NRS is hereby amended by adding 23
thereto a section to read as follows: 24
1. Except as otherwise prohibited by state or federal law, a 25
governmental agency that directly or by contract collects 26
information concerning the race or ethnicity of persons in this 27
State who self -identify as Asian, Native Hawaiian or Pacific 28
Islander shall: 29
(a) Request any information concerning the race or ethnicity 30
of such a person in not more than one question; 31
(b) When requesting information concerning the race or 32
ethnicity of such a person, use separate categories for the 33
collection and tabulation of the information whi ch include, 34
without limitation: 35
(1) For the category of persons who self-identify as Asian , 36
an option for a person to self-identify as Chinese, Vietnamese, 37
Asian Indian, Korean, Filipino or Japanese or specify another 38
subcategory, including, without limi tation, Pakistani, Hmong or 39
Afghan; and 40
(2) For the category of person s who self-identify as Native 41
Hawaiian or Pacific Islander, an option for a person to self-42
identify as Native Hawaiian, Samoan, Chamorro, Tongan, Fijian 43
or Marshallese or specify another subcategory, including, without 44
limitation, Chuukese, Palauan or Tahitian; 45

(c) If applicable, use separate categories for the collection and 1
tabulation of information concerning the primary language 2
spoken in the person’s home; 3
(d) In collecting the information described in this section , 4
collaborate with: 5
(1) Community-based organizations; and 6
(2) Persons with expertise in issues relating to the 7
collection of demographic data, including, without limitation, best 8
practices for, and barriers to, the collection of demographic data; 9
(e) Except as otherwise provided in paragraph (f) or by state or 10
federal law: 11
(1) Make the information collected pursuant to this section 12
available to the public by publishing the information on th e 13
Internet website of the governmental agency; and 14
(2) Include the information collected pursuant to this 15
section in any demographic report concerning the race or 16
ethnicity of persons in this State that is published by the 17
governmental agency; and 18
(f) Ensure that any personally identifiable information in the 19
information collected pursuant to this section is kept confidential. 20
2. Nothing in this section shall be construed to prohibit a 21
governmental agency from: 22
(a) Using an additional category or subcategory to collect the 23
information described in subsection 1; or 24
(b) Providing an option for a person to select “No Race or 25
Ethnicity Specified.” 26
3. No person shall be denied services or assistance from a 27
governmental agency for failure or refusal t o provide to the 28
government agency any information described in subsection 1. 29
4. As used in this section: 30
(a) “Governmental agency” has the meaning ascribed to it in 31
NRS 239B.024. 32
(b) “Personally identifiable information” means information 33
that, alone or in combination with other information, may be used 34
to identify a person. The term includes, without limitation, the 35
name, address, telephone number, date of birth or social security 36
number of the person. 37
Sec. 3. The amendatory provisions of section 2 of this act do 38
not apply to any information described in subsection 1 of section 2 39
of this act that was collected by a governmental agency, as that term 40
is defined in NRS 239B.024, before January 1, 2026. 41
Sec. 4. The provisions of NRS 354.599 do not apply to any 42
additional expense of a local government that are related to the 43
provisions of this act. 44

Sec. 5. 1. This section and section 4 of this act become 1
effective upon passage and approval. 2
2. Sections 1, 2 and 3 of this act become effective: 3
(a) Upon passage and approval for the purpose of adopting any 4
regulations and performing any other preparatory administrative 5
tasks that are necessary to carry out the provisions of this act; and 6
(b) On January 1, 2026, for all other purposes. 7
