Lake Tahoe Watershed; requiring, under certain

Legislative Counsel’s Digest:
Existing law establishes certain prohibitions relating to water pollution in Lake 1
Tahoe and within the Lake Tahoe Watershed. (NRS 445A.170 -445A.190) Section 2
1 of this bill prohibits a person from selling, offering for sale or distributing for sale 3
water in a disposable plastic bottle that has a capacity of not more than 4 liters in 4
any community which abuts the Lake Tahoe Watershed. Section 1 requires the 5
local board of health or health department to enforce this prohibition . Section 1 6
further requires the local board of health or health department to: (1) for a first 7
violation of section 1 within 1 year, issue a warning; (2) for a second violation 8
within 1 year, impose an administrative fine of not more than $100; (3) for a third 9
violation within 1 year , impose an administrative fine of not more than $ 200; and 10
(4) for a fourth or subsequent violation within 1 year impose an administrative fine 11
of not more than $500. 12

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 445A of NRS is hereby amended by 1
adding thereto a new section to read as follows: 2
1. A person shall not sell, offer to sell or distribute for sale 3
water in a disposable plastic bottle that has a capacity of not more 4
than 4 liters in any community that abuts the Lake Tahoe 5
Watershed. 6
2. The local board of health or health department with 7
jurisdiction in the county, city or health district shall enforce the 8
provisions of this section . For any v iolation of the provisions of 9
this section , the local board of health or health department , as 10
applicable, shall: 11
(a) For a first violation within 1 year, issue a warning to the 12
person who is in violation of this section. 13
(b) For a second violation withi n 1 year, impose a fine of not 14
more than $100. 15
(c) For a third violation within 1 year, impose a fine of not 16
more than $200. 17
(d) For a fourth or subsequent violation within 1 year, impose 18
a fine of not more than $500. 19
3. As used in this section: 20
(a) “Disposable plastic bottle” means a single -use or 21
disposable item that is made of plastic and used for bottling, 22
packaging, serving, consuming or transporting water. 23
(b) “Local board of health” means a county board of health, 24
city board of health or district board of health. 25
(c) “Plastic” means a synthetic or semisynthetic material 26
chemically synthesized by the polymerization of organic 27
substances that can be molded and shaped into rigid and flexible 28
forms. 29

Sec. 4. The provisions of NRS 354.599 do not apply to any 32
additional expenses of a local government that are related to the 33
provisions of this act. 34
Sec. 5. This act becomes effective on January 1, 2026. 35
