AN ACT relating to financial institutions; requiring certain financial
institutions, credit unions, savings banks and thrift
companies to take certain actions relating to the use of an
emergency financial contact for certain accounts and
transactions which involve an older p erson or vulnerable
person; authorizing certain persons to temporarily delay
certain financial transactions involving the suspected
exploitation of an older person or vulnerable person;
exempting certain persons from liability for certain
actions relating to the suspected exploitation of an older
person or vulnerable person; creating a civil cause of
action to recover damages for certain violations of certain
requirements relating to the use of an emergency financial
contact which result in exploitation of an older person or
vulnerable person; and providing other matters properly
relating thereto.
Legislative Counsel’s Digest:
Existing law requires certain financial institutions, credit unions, savings banks 1
and thrift companies to: (1) provide training con cerning the identification and 2
reporting of the exploitation of older persons and vulnerable persons to certain 3
directors, officers and employees who may interact with or review information of 4
an older person or vulnerable person in providing financial ser vices; and (2) 5
designate a person to whom a director, officer or employee must report known or 6
suspected exploitation of an older person or vulnerable person. (NRS 657.220 -7
657.290, 672.767 -672.779, 673.773 -673.807, 677.673 -677.707) Existing law 8
requires a designated reporter, under certain circumstances, to report known or 9

suspected exploitation of an older person or vulnerable person to the Aging and 10
Disability Services Division of the Department of Health and Human Services, a 11
police department or sheriff ’s office and any county office for protective services. 12
(NRS 657.290, 672.779, 673.807, 677.707) 13
Existing law also: (1) authorizes a designated reporter for certain financial 14
institutions to delay a requested disbursement or transaction involving an olde r 15
person or vulnerable person if the designated reporter knows or has reasonable 16
cause to believe that the older person or vulnerable person has been exploited; and 17
(2) sets forth procedures and requirements for the imposition of such a delay. 18
Additionally, existing law provides that a financial institution and its officers, 19
employees and designated reporters are immune from criminal, civil and 20
administrative liability for: (1) making a report concerning the known or suspected 21
exploitation of an older perso n or vulnerable person in good faith; (2) delaying a 22
requested disbursement or transaction involving such exploitation; and (3) taking 23
certain other actions relating to such exploitation. (NRS 657.290) Sections 20, 30 24
and 40 of this bill make those provisions similarly applicable to credit unions, 25
savings banks and thrift companies. 26
Sections 2, 12, 22 and 32 of this bill define “covered account” to mean an 27
account for which a financial institution, credit union, savings bank or thrift 28
company has actual knowledge is an account of an older person or vulnerable 29
person or to which an older person or vulnerable person is a beneficiary. Sections 30
5, 15, 25 and 35 of this bill require a financial institution, credit union, savings 31
bank and thrift company, before opening any covered account, to require the 32
prospective account holder to either complete a form des ignating a person to serve 33
as an emergency financial contact or complete a form declining to designate an 34
emergency financial contact. Sections 6, 16, 26 and 36 of this bill authorize the 35
account holder of a covered account that was opened in a financial institution, 36
credit union, savings bank or thrift company before October 1, 2025, to, upon 37
request of the account holder, designate an emergency financial contact. Sections 6, 38
16, 26 and 36 authorize a financial institution, credit union, savings bank or thrift 39
company to notify an d provide information to account holders of covered accounts 40
that were opened before October 1, 2025, concerning the designation of an 41
emergency financial contact. 42
Sections 3, 13, 23 and 33 of this bill define “covered transaction” to mean a 43
requested disbursement from or a requested transaction involving a covered 44
account that exceeds $5,000. Sections 7, 17, 27 and 37 of this bill require a 45
financial institution, credit union, savings bank and thrift company to attempt to 46
contact a designated emergency financial contact within 24 hours after a covered 47
transaction is requested involving a covered account for which the account holder 48
has designated an emergency financial contact. Sections 7, 17, 27 and 37 prohibit 49
the entity from proceeding with the covered transaction until 24 hours after 50
attempting such contact or , if applicable, the expiration of any temporary delay, 51
whichever is later. Under sections 7, 17, 27 and 37, if a director, officer or 52
employee of such an entity, after attempting such contact, knows or suspects that 53
exploitation has occurred or is occurring, the director, officer or employee is 54
required to report the known or suspected exploitation to the designated reporter. 55
The designated reporter is required to proceed in accordance with the proced ures 56
for handling other reports of known or suspected exploitation, except that, under 57
sections 10, 20, 30 and 40, the designated reporter is required, rather than 58
authorized, to temporarily delay the covered transaction. 59
Sections 10, 20, 30 and 40 provide immunity from criminal, civil and 60
administrative liability to a financial institutio n, credit union, savings bank and 61
thrift company for taking the actions required by sections 7, 17, 27 and 37. 62
However, if such an entity violates the provisions of sections 7, 17, 27 and 37, and 63
the violation results in the exploitation of an account holder, sections 8, 18, 28 and 64

38 of this bill authorize the account holder to bring an action against the entity, in 65
which the account holder is entitled to treble damages. 66
Sections 4, 14, 24 and 34 of this bill define “emergency financial con tact.” 67
Sections 9, 19, 29 and 39 of this bill make a conforming change to apply the 68
definitions set forth in sections 2-4, 12-14, 22-24 and 32-34 to the provisions of 69
existing law requiring the identification and reporting of exploitation of older 70
persons and vulnerable persons by financial entities. 71
Existing law provides that a designated reporter for certain financial institutions 72
who delays a requested disbursement or transaction due to, or certain other persons 73
who make a report concerning, exploitation of an older person or vuln erable person 74
are not required to accept an acknowledged power of attorney under certain 75
circumstances. (NRS 162A.370) Section 41 of this bill makes those pr ovisions 76
similarly applicable to designated reporters and certain persons who make such 77
reports for credit unions, savings banks and thrift companies. 78
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 657 of NRS is hereby amended by adding 1
thereto the provisions set forth as sections 2 to 8, inclusive, of this 2
act. 3
Sec. 2. “Covered account” means an account which a 4
financial institution has actual knowledge is: 5
1. An account of an older person or vulnerable person; or 6
2. An account to which an older person or vulnerable person 7
is a beneficiary. 8
Sec. 3. “Covered transaction” means a requested 9
disbursement from or a requested transaction involving a covered 10
account that exceeds $5,000. 11
Sec. 4. “Emergency financial contact” means a person who 12
is designated as an emergency financial contact pursuant to 13
section 5 of this act. 14
Sec. 5. 1. Except as otherwise provided in subsection 3, a 15
financial institution shall, before opening a covered account, 16
require the prospective account holder to designate an emergency 17
financial contact by completing a form that contains: 18
(a) The name, address, electronic mail address and telephone 19
number of the account holder and any joint account holder; and 20
(b) The name and telephone number of a person to serve as 21
the emergency financial contact of the account holder. 22
2. A person designated an emergency financial contact 23
pursuant to subsection 1 must be over 18 years of age. 24
3. A financial institution may open a covered account without 25
complying with the provisions of subsection 1 if the prospective 26
account holder declines to designate an emergency financial 27
contact by completing a form acknowledging the declination. 28

Sec. 6. The account holder of a covered account that was 1
opened in a financial institution before October 1, 2025 , may, 2
upon request of the account holder, designate an emergency 3
financial contact in the manner set forth in subsection 1 of section 4
5 of this act. A financial institution may notify and provide 5
information to account holders of covered accounts that were 6
opened before October 1, 2025 , concerning the provisions of this 7
section. 8
Sec. 7. 1. If an account holder of a covered account has 9
designated an emergency financial contact pursuant to section 5 10
or 6 of this act, the financial institution: 11
(a) Shall attempt to contact the emergency financial contact 12
within 24 hours after a covered transaction is requested involving 13
the covered account of the account holder to request an opinion 14
from the emergency financial contact concerning whether the 15
covered transaction is the result of exploitation; and 16
(b) Shall not proceed with the covered transaction until the 17
later of 24 hours after the attempt to contact the emergency 18
financial contact or, if applicable, the expiration of any temporary 19
delay imposed pursuant to NRS 657.290. 20
2. If, after attempting to contact the emergency financial 21
contact pursuant to subsection 1, an officer or employee of the 22
financial institution knows or suspects that exploitation of an 23
account holder has occurred or is occurring, the officer or 24
employee shall report the known or suspected exploitation to the 25
designated reporter in accordance with NRS 657.290, who shall 26
proceed in accordance with the provisions of that section. 27
Sec. 8. 1. If a financial institution violates the provisions of 28
section 7 of this act and that violation results in the exploitation of 29
the account holder, the account holder may bring an action 30
against the financial institution. In such an action, the account 31
holder is entitled to treble damages. 32
2. In any action brought pursuant to subsection 1, the 33
plaintiff must allege in the complaint, and prove at the trial, that, 34
as of the time of the violation, the plaintiff had designated an 35
emergency financial contact in the manner set forth in subsection 36
1 of section 5 of this act. 37
Sec. 9. NRS 657.220 is hereby amended to read as follows: 38
657.220 As used in NRS 657.220 to 657.2 90, inclusive, and 39
sections 2 to 8, inclusive, of this act, unless the context otherwise 40
requires, the words and terms defined in NRS 657.230 to 657.270, 41
inclusive, and sections 2, 3 and 4 of this act have the meanings 42
ascribed to them in those sections. 43

Sec. 10. NRS 657.290 is hereby amended to read as follows: 1
657.290 1. Each financial institution shall designate a person 2
or persons to whom an officer or employee of the financial 3
institution must report known or suspected exploitation of an older 4
person or vulnerable person. 5
2. If an officer or employee reports known or suspected 6
exploitation of an older person or vulnerable person to a designated 7
reporter and, based on such a report or based on his or her own 8
observations or knowledge, the designated reporter knows or has 9
reasonable cause to believe that an older person or vulnerable 10
person has been exploited, the designated reporter: 11
(a) Except as otherwise provided in subsection 3, shall report the 12
known or suspected exploitation of the older person or vulnerable 13
person to: 14
(1) The local office of the Aging and Disability Services 15
Division of the Department of Health and Human Services; 16
(2) A police department or sheriff’s office; 17
(3) The county’s office for protective services, if one exists 18
in the county where the suspected action occurred; or 19
(4) A toll-free telephone service designated by the Aging and 20
Disability Services Division of the De partment of Health and 21
Human Services; 22
(b) Shall make such a report as soon as reasonably practicable; 23
and 24
(c) May temporarily delay a requested disbursement from, or a 25
requested transaction involving, an account of an older person or 26
vulnerable person or an account to which an older person or 27
vulnerable person is a beneficiary , except that if the disbursement 28
or tra nsaction is a covered transaction, the designated reporter 29
shall temporarily delay the transaction. A designated reporter [:] 30
who temporarily delays a disbursement or transaction pursuant to 31
this paragraph shall: 32
(1) Not later than 2 business days after the date on which the 33
requested disbursement or transaction is delayed: 34
(I) [Provides] Provide written notification of the delay 35
and the reason for the delay to all parties authorized to transact 36
business on the account [,] and an emergency financial contact, if 37
applicable, except a party or emergency financial contact who is 38
reasonably believed to have engaged in the suspected exploitation; 39
and 40
(II) [Notifies] Notify the local office of the Aging and 41
Disability Services D ivision of the Department of Health and 42
Human Services and a local law enforcement agency of the delay; 43
and 44

(2) [Notifies] Notify the local office of the Aging and 1
Disability Services Division of the Department of Health and 2
Human Services and the approp riate local law enforcement agency 3
of any new information that is relevant to the delay within a 4
reasonable time after becoming aware of the information. 5
3. If the designated reporter knows or has reasonable cause to 6
believe that the exploitation of the older person or vulnerable person 7
involves an act or omission of the Aging and Disability Services 8
Division, another division of the Department of Health and Human 9
Services or a law enforcement agency, the designated reporter shall 10
make the report to an ag ency other than the one alleged to have 11
committed the act or omission. 12
4. In accordance with the provisions of subsection 3 of NRS 13
239A.070, in making a report pursuant to this section, a designated 14
reporter may: 15
(a) Disclose any facts or information th at form the basis of the 16
determination that the designated reporter knows or has reasonable 17
cause to believe that an older person or vulnerable person has been 18
exploited, including, without limitation, the identity of any person 19
believed to be involved in the exploitation of the older person or 20
vulnerable person; and 21
(b) Provide any financial records or other documentation 22
relating to the exploitation of the older person or vulnerable person. 23
5. [A] Except as otherwise provided in section 8 of this act, a 24
financial institution and any of its officers, employees and 25
designated reporters are immune from civil, criminal and 26
administrative liability arising from: 27
(a) Making a report in good faith pursuant to this section [;] or 28
section 7 of this act; 29
(b) Delaying a requested disbursement or transaction involving 30
the known or suspected exploitation of an older person or vulnerable 31
person pursuant to this section; [or] 32
(c) Taking any action required by section 7 of this act; or 33
(d) Taking any reasonable action which is: 34
(1) Performed in furtherance of a duty or authorization 35
created by subsection 2, 3 or 4 [;] or section 7 of this act; and 36
(2) Based upon a reasonable belief that an older person or 37
vulnerable person has been exploited. 38
6. Except as otherwise provided in this subsection and 39
subsections 7 a nd 8, a delay in a requested disbursement or 40
transaction authorized or required by paragraph (c) of subsection 2 41
expires 15 business days after the date on which the requested 42
disbursement or transaction was delayed. If the local office of the 43
Aging and Disability Services Division of the Department of Health 44
and Human Services or a local law enforcement agency requests in 45

writing that the designated reporter extend the delay, the delay 1
expires upon the earlier of: 2
(a) Twenty-five business days after the date on which the 3
requested disbursement or transaction was delayed; or 4
(b) Upon the written request of the local office of the Aging and 5
Disability Services Division of the Department of Health and 6
Human Services or the local law enforcement agency that requested 7
the extension of the delay or upon the order of a court of competent 8
jurisdiction. 9
7. A delay in a requested disbursement or transaction 10
authorized or required by paragraph (c) of subsection 2 may expir e 11
before the period set forth in subsection 6 and the designated 12
reporter may proceed with the requested disbursement or transaction 13
if the designated reporter reasonably believes that the requested 14
disbursement or transaction will not result in exploitati on of the 15
older person or vulnerable person. 16
8. A court of competent jurisdiction may issue an order 17
extending a delay of a requested disbursement or transaction 18
authorized or required by paragraph (c) of subsection 2 based on the 19
petition of the local o ffice of the Aging and Disability Services 20
Division of the Department of Health and Human Services, a local 21
law enforcement agency or any other interested party. 22
9. When determining whether an older person or vulnerable 23
person has been exploited, a desig nated reporter may consider any 24
information received pursuant to section 7 of this act and any of 25
the following circumstances, if applicable and without limitation: 26
(a) A requested disbursement from, or a requested transaction 27
involving, an account of an older person or vulnerable person or an 28
account to which an older person or vulnerable person is a 29
beneficiary that the older person or vulnerable person c annot 30
explain; 31
(b) A request to close a certificate of deposit of an older person 32
or vulnerable person that is made: 33
(1) Before the date of maturity of the certificate of deposit; 34
and 35
(2) With apparent disregard for any penalty associated with 36
closing the certificate of deposit before the date of maturity of the 37
certificate of deposit; 38
(c) A check written by an older person or vulnerable person 39
under suspicious circumstances; 40
(d) An uncharacteristic attempt by an older person or vulnerable 41
person to initiate a wire transfer of a significant sum of money; 42
(e) A suspicious signature on documentation relating to an 43
account of an older person or vulnerable person; 44
(f) A suspicious alteration to a: 45

(1) Trust to which an older person or vulnerable person is a 1
beneficiary; or 2
(2) Will or trust for which an older person or vulnerable 3
person is a testator or trustee; 4
(g) A suspicious alteration in a power of attorney relating to an 5
older person or vulnerable person; and 6
(h) A person attempting to initiate a financial transaction on 7
behalf of an older person or vulnerable person without proper 8
documentation. 9
Sec. 11. Chapter 672 of NRS is hereby amended by adding 10
thereto the provisions set forth as sections 12 to 18, inclusive, of this 11
act. 12
Sec. 12. “Covered account” means an account which a credit 13
union has actual knowledge is: 14
1. An account of an older person or vulnerable person; or 15
2. An account to which an older person or vuln erable person 16
is a beneficiary. 17
Sec. 13. “Covered transaction” means a requested 18
disbursement from or a requested transaction involving a covered 19
account that exceeds $5,000. 20
Sec. 14. “Emergency financial contact” means a person who 21
is designated as an emergency financial contact pursuant to 22
section 15 of this act. 23
Sec. 15. 1. Except as otherwise provided in subsection 3, a 24
credit union shall, before opening a covered account, require the 25
prospective account holder to designate an emergency financial 26
contact by completing a form that contains: 27
(a) The name, address, electronic mail address and telephone 28
number of the account holder and any joint account holder; and 29
(b) The name and telephone number of a person to serve as 30
the emergency financial contact of the account holder. 31
2. A person designated an emergency financial contact 32
pursuant to subsection 1 must be over 18 years of age. 33
3. A credit union may open a covered account without 34
complying with the provisions of subsection 1 if the prospective 35

Sec. 16. The account holder of a covered account that was 38

request of the account holder, desi gnate an emergency financial 40
contact in the manner set forth in subsection 1 of section 15 of this 41
act. A credit union may notify and provide information t o account 42
holders of covered accounts that were opened before October 1, 43
2025, concerning the provisions of this section. 44

Sec. 17. 1. If an account holder of a covered account has 1
designated an emergency financial contact pursuant to section 15 2
or 16 of this act, the credit union: 3
(a) Shall attempt to contact the emergency financial contact 4
within 24 hours after a covered transaction is requested involving 5
the covered account of the accou nt holder to request an opinion 6
from the emergency financial contact concerning whether the 7
covered transaction is the result of exploitation; and 8
(b) Shall not proceed with the covered transaction until the 9
later of 24 hours after the attempt to contact the emergency 10
financial contact or, if applicable, the expiration of any temporary 11
delay imposed pursuant to NRS 672.779. 12
2. If, after attempting to contact the emergency financial 13
contact pursuant to subsection 1, an employee of the credit union 14
knows or suspects that exploitation of an account holder has 15
occurred or is occurring, the officer or employee shall report the 16
known or suspected exploitation to the designated reporter in 17
accordance with NRS 672.779, who shall proceed in accordance 18
with the provisions of that section. 19
Sec. 18. 1. If a credit union violates the provisions of 20
section 17 of this act and that viola tion results in the exploitation 21
of the account holder, the account holder may bring an action 22
against the credit union. In such an action, the account holder is 23
entitled to treble damages. 24
2. In any action brought pursuant to subsection 1, the 25
plaintiff must allege in the complaint, and prove at the trial, that, 26
as of the time of the violation, the plaintiff had designated an 27
emergency financial contact in the manner set forth in subsection 28
1 of section 15 of this act. 29
Sec. 19. NRS 672.767 is hereby amended to read as follows: 30
672.767 As used in NRS 672.767 to 672.779, inclusive, and 31
sections 12 to 18, inclusive, of this act, unless the context otherwise 32
requires, the wo rds and terms defined in NRS 672.769 to 672.777, 33
inclusive, and sections 12, 13 and 14 of this act have the meanings 34
ascribed to them in those sections. 35
Sec. 20. NRS 672.779 is hereby amended to read as follows: 36
672.779 1. Each credit union shall designate a person or 37
persons to whom an employee of the credit union must report 38
known or suspected exploitation of an older person or vulnerable 39
person. 40
2. If an employee reports known or suspected exploitation of 41
an older person or vulnerable person to a designated reporter and, 42
based on such a report or based on his or her own observations or 43
knowledge, the designated reporter knows or has reasonable ca use 44

to believe that an older person or vulnerable person has been 1
exploited, the designated reporter : [shall:] 2
(a) Except as otherwise provided in subsection 3, shall report 3
the known or suspected exploitation of the older person or 4
vulnerable person to: 5
(1) The local office of the Aging and Disability Services 6
Division of the Department of Health and Human Services; 7
(2) A police department or sheriff’s office; 8
(3) The county’s office for protective services, if one exists 9
in the county where the suspected action occurred; or 10
(4) A toll-free telephone service designated by the Aging and 11
Disability Services Division of the Department of Health and 12
Human Services; [and] 13
(b) [Make] Shall make such a report as soon as reasonably 14
practicable [.] ; and 15
(c) May temporarily delay a requested disbursement from, or a 16
requested transaction involving, an account of an older person or 17
vulnerable person or an account to which an older person or 18
vulnerable person is a beneficiary , except that if the disbursement 19
or transaction is a covered transaction the designated reporter 20
shall temporarily delay the transaction. A designated reporter who 21
temporarily delays a disbursement or transaction pursuant to this 22
paragraph shall: 23
(1) Not later than 2 business days afte r the date on which 24
the requested disbursement or transaction is delayed: 25
(I) Provide written notification of the delay and the 26
reason for the delay to all parties authorized to transact business 27
on the account and an emergency financial contact, if app licable, 28
except a party or emergency financial contact who is reasonably 29
believed to have engaged in the suspected exploitation; and 30
(II) Notify the local office of the Aging and Disability 31
Services Division of the Department of Health and Human 32
Services and a local law enforcement agency of the delay; and 33
(2) Notify the local office of the Aging and Disability 34
Services Division of the Department of Health and Human 35
Services and the appropriate law enforcement agency of any new 36
information that is rele vant to the delay within a reasonable time 37
after becoming aware of the information. 38
3. If the designated reporter knows or has reasonable cause to 39
believe that the exploitation of the older person or vulnerable person 40
involves an act or omission of the A ging and Disability Services 41
Division, another division of the Department of Health and Human 42
Services or a law enforcement agency, the designated reporter shall 43
make the report to an agency other than the one alleged to have 44
committed the act or omission. 45

4. In accordance with the provisions of subsection 3 of NRS 1
239A.070, in making a report pursuant to this section, a designated 2
reporter may: 3
(a) Disclose any facts or information that form the basis of the 4
determination that the designated reporter kn ows or has reasonable 5
cause to believe that an older person or vulnerable person has been 6
exploited, including, without limitation, the identity of any person 7
believed to be involved in the exploitation of the older person or 8
vulnerable person; and 9
(b) Provide any financial records or other documentation 10
relating to the exploitation of the older person or vulnerable person. 11
5. [An employee] Except as otherwise provided in section 18 12
of this act, a credit union and any of its employees and [the] 13
designated [reporter] reporters are [entitled to the immunity ] 14
immune from civil, criminal and administrative liability [set forth 15
in NRS 200.5096 for making a report in good faith.] arising from: 16
(a) Making a report in good faith pursuant to this section or 17
section 17 of this act; 18
(b) Delaying a requested disbu rsement or transaction 19
involving the known or suspected exploitation of an older person 20
or vulnerable person pursuant to this section; 21
(c) Taking any action required by section 17 of this act; or 22
(d) Taking any reasonable action which is: 23
(1) Performed in furtherance of a duty or authorization 24
created by subsection 2, 3 or 4 or section 17 of this act; and 25
(2) Based upon a reasonable belief that an older person or 26
vulnerable person has been exploited. 27
6. Except as otherwise provided in this subsection and 28
subsections 7 and 8, a dela y in a requested disbursement or 29
transaction authorized or required by paragraph (c) of subsection 30
2 expires 15 business days after the date on which the requested 31
disbursement or transaction was delayed. If the local office of the 32
Aging and Disability Ser vices Division of the Department of 33
Health and Human Services or a local law enforcement agency 34
requests in writing that the designated reporter extend the delay, 35
the delay expires upon the earlier of: 36
(a) Twenty-five business days after the date on which the 37
requested disbursement or transaction was delayed; or 38
(b) Upon the written request of the local office of the Aging 39
and Disability Services Division of the Department of Health and 40
Human Services or the local law enforcement agency that 41
requested the extension of the delay or upon the order of a court 42
of competent jurisdiction. 43
7. A delay in a requested disbursement or transaction 44
authorized or required by paragraph (c) of subsection 2 may 45

expire before the period set forth in subsection 6 and the 1
designated reporter may proceed with the requested disbursement 2
or transaction if the designated reporter reasonably believes that 3
the requested disbursement or transaction will not result in 4
exploitation of the older person or vulnerable person. 5
8. A co urt of competent jurisdiction may issue an order 6
extending a delay of a requested disbursement or transaction 7
authorized or required by paragraph (c) of subsection 2 based on 8
the petition of the local office of the Aging and Disability Services 9
Division of the Department of Health and Human Services, a local 10
law enforcement agency or any other interested party. 11
9. When determining whether an older person or vulnerable 12
person has been exploited, a designated reporter may consider any 13
information received pursuant to section 17 of this act and any of 14
the following circumstances, if applicable and without limitation: 15
(a) A requested disbursement from, or a requested transaction 16
involving, an account of an older person or vulnerable person or 17
an account to which an older person or vulnerable person is a 18
beneficiary that the older person or vulnerable person cannot 19
explain; 20
(b) A request to close a certificate of deposit of an older person 21
or vulnerable person that is made: 22
(1) Before the date of maturity of the c ertificate of deposit; 23
and 24
(2) With apparent disregard for any penalty associated with 25
closing the certificate of deposit before the date of maturity of the 26
certificate of deposit; 27
(c) A check written by an older person or vulnerable person 28
under suspicious circumstances; 29
(d) An uncharacteristic attempt by an older person or 30
vulnerable person to initiate a wire transfer of a significant sum of 31
money; 32
(e) A suspicious signature on documentation relating to an 33
account of an older person or vulnerable person; 34
(f) A suspicious alteration to a: 35
(1) Trust to which an older person or vulnerable person is a 36
beneficiary; or 37
(2) Will or trust for which an older person or vulnerable 38
person is a testator or trustee; 39
(g) A suspicious alteration in a power of attorney relating to 40
an older person or a vulnerable person; and 41
(h) A person attempting to initiate a financial transaction on 42
behalf of an older person or vulnerable person without proper 43
documentation. 44

Sec. 21. Chapter 673 of NRS is hereby amended by adding 1
thereto the provisions set forth as sections 22 to 28, inclusive, of this 2
act. 3
Sec. 22. “Covered account” means an account which a 4
savings bank has actual knowledge is: 5
1. An account of an older person or vulnerable person; or 6
2. An account to which an older person or vulnerable person 7
is a beneficiary. 8
Sec. 23. “Covered transaction” means a requested 9
disbursement from or a requested transaction involving a covered 10
account that exceeds $5,000. 11
Sec. 24. “Emergency financial contact” means a person who 12
is designated as an emergency financial contact pursuant to 13
section 25 of this act. 14
Sec. 25. 1. Except as otherwise provided in subsection 3, a 15
savings bank shall, before opening a covered account, require the 16
prospective account holder to designate an emergency financial 17
contact by completing a form that contains: 18
(a) The name, address, electronic mail address and telephone 19
number of the account holder and any joint account holder; and 20
(b) The name and telephone number of a person to serve as 21
the emergency financial contact of the account holder. 22
2. A person designated an emergency financial contact 23
pursuant to subsection 1 must be over 18 years of age. 24
3. A savings bank may open a covered account without 25
complying with the provisions of subsection 1 if the prospective 26
account holder declines to designate an emergency financial 27
contact by completing a form acknowledging the declination. 28
Sec. 26. The account holder of a covered account that was 29
opened in a savings bank before October 1, 2025 , may, upon 30
request of the account holder, designate an emergency financial 31
contact in the manner set forth in subsection 1 of section 25 of this 32
act. A savings bank may notify and provide information to account 33
holders of covered accounts that were opened before October 1, 34
2025, concerning the provisions of this section. 35
Sec. 27. 1. If an account holder of a covered account has 36
designated an emergency financial contact pursuant to section 25 37
or 26 of this act, the savings bank: 38
(a) Shall attempt to contact the emergency financial contact 39
within 24 hours after a covered transaction is requested involving 40
the covered account of the account holder to request an opinion 41
from the emergency financial contact concerning whether the 42
covered transaction is the result of exploitation; and 43
(b) Shall not proceed with the covered transaction until the 44
later of 24 hours after the attempt to contact the emergency 45

financial contact or, if applicable, the expiration of any temporary 1
delay imposed pursuant to NRS 673.807. 2
2. If, after attempting to contact the emergency financial 3
contact pursuant to subsection 1, a director, officer or employee of 4
the savings bank knows or suspects that exploitation of an account 5
holder has occurred or is occurrin g, the officer or employee shall 6
report the known or suspected exploitation to the designated 7
reporter in accordance with NRS 673.807, who shall proceed in 8
accordance with the provisions of that section. 9
Sec. 28. 1. If a s avings bank violates the provisions of 10
section 27 of this act and that violation results in the exploitation 11
of the account holder, the account holder may bring an action 12
against the savings bank. In such an action, the account holder is 13
entitled to treble damages. 14
2. In any action brought pursuant to subsection 1, the 15
plaintiff must allege in the complaint, and prove at the trial, that, 16
as of the time of the violation, the plaintiff had designated an 17
emergency financial contact in the manner set forth in subsection 18
1 of section 25 of this act. 19
Sec. 29. NRS 673.773 is hereby amended to read as follows: 20
673.773 As used in NRS 673.773 to 673.807, inclusive, and 21
sections 22 to 28, inclusive, of this act, unless the context otherwise 22
requires, the words and terms defined in NRS 673.777 to 673.797, 23
inclusive, and sections 22, 23 and 24 of this act have the meanings 24
ascribed to them in those sections. 25
Sec. 30. NRS 673.807 is hereby amended to read as follows: 26
673.807 1. Each savings bank shall designate a person or 27
persons to whom a director, officer or employee of the savings bank 28
must report known or suspected exploitation of an older person or 29
vulnerable person. 30
2. If a director, officer or employee reports known or suspected 31
exploitation of an older person or vulnerable person to a designated 32
reporter and, based on such a report or based on his or her own 33
observations or knowledge, the de signated reporter knows or has 34
reasonable cause to believe that an older person or vulnerable 35
person has been exploited, the designated reporter [shall:] : 36
(a) Except as otherwise provided in subsection 3, shall report 37
the known or suspected exploitation of the older person or 38
vulnerable person to: 39
(1) The local office of the Aging and Disability Services 40
Division of the Department of Health and Human Services; 41
(2) A police department or sheriff’s office; 42
(3) The county’s office for protective servic es, if one exists 43
in the county where the suspected action occurred; or 44

(4) A toll-free telephone service designated by the Aging and 1
Disability Services Division of the Department of Health and 2
Human Services; [and] 3
(b) [Make] Shall make such a report as soon as reasonably 4
practicable [.] ; and 5
(c) May temporarily delay a requested disbursement from, or a 6
requested transaction involving, an account of an older person or 7
vulnerable person or an account to which an older person or 8
vulnerable person is a beneficiary, except that if the disbursement 9
or transaction is a covered transaction, the designated reporter 10
shall temporarily delay the transaction. A designated reporter who 11
temporarily delays a disbursement or transaction pursuant to this 12
paragraph shall: 13
(1) Not later than 2 business days after the date on which 14
the requested disbursement or transaction is delayed: 15
(I) Provide written notification of the delay and the 16
reason for the delay to all parties authorized to transact business 17
on the account and an emergency financial contact, if applicable, 18
except a party or emergency financial contact who is reasonably 19
believed to have engaged in the suspected exploitation; and 20
(II) Notify the local office of the Aging and Disability 21
Services Division of the Department of Health and Human 22
Services and a local law enforcement agency of the delay; and 23
(2) Notify the local office of the Aging and Disability 24
Services Division of the Department of Health and Human 25
Services and the appropriate law enforceme nt agency of any new 26
information that is relevant to the delay within a reasonable time 27
after becoming aware of the information. 28
3. If the designated reporter knows or has reasonable cause to 29
believe that the exploitation of the older person or vulnerable person 30
involves an act or omission of the Aging and Disability Services 31
Division, another division of the Department of Health and Human 32
Services or a law enforcement agency, the designated reporter shall 33
make the report to an agency other than the one alleged to have 34
committed the act or omission. 35
4. In accordance with the provisions of subsection 3 of NRS 36
239A.070, in making a report pursuant to this section, a designated 37
reporter may: 38
(a) Disclose any facts or information that form the basi s of the 39
determination that the designated reporter knows or has reasonable 40
cause to believe that an older person or vulnerable person has been 41
exploited, including, without limitation, the identity of any person 42
believed to be involved in the exploitation of the older person or 43
vulnerable person; and 44

(b) Provide any financial records or other documentation 1
relating to the exploitation of the older person or vulnerable person. 2
5. [A director, officer, employee ] Except as otherwise 3
provided in section 28 of this act, a savings bank and any of its 4
directors, officers, employees and [the] designated [reporter] 5
reporters are [entitled to the immunity ] immune from civil, 6
criminal and administrative liability [set forth in NRS 200.5096 for 7
making a report in good faith.] arising from: 8
(a) Making a report in good faith pursuant to this section or 9
section 27 of this act; 10
(b) Delaying a requested disbursement or transaction 11
involving the known or suspected exploitation of an older person 12
or vulnerable person pursuant to this section. 13
(c) Taking any action required by section 27 of this act; or 14
(d) Taking any reasonable action which is: 15
(1) Performed in furtherance of a duty or authorizat ion 16
created by subsection 2, 3 or 4 or section 27 of this act; and 17
(2) Based upon a reasonable belief that an older person or 18
vulnerable person has been exploited. 19
6. Except as otherwise provided in this subsection and 20
subsections 7 and 8, a delay in a requested disbursement or 21
transaction authorized or required by paragraph (c) of subsection 22
2 expires 15 business days after the date on which the reques ted 23
disbursement or transaction was delayed. If the local office of the 24
Aging and Disability Services Division of the Department of 25
Health and Human Services or a local law enforcement agency 26
requests in writing that the designated reporter extend the dela y, 27
the delay expires upon the earlier of: 28
(a) Twenty-five business days after the date on which the 29
requested disbursement or transaction was delayed; or 30
(b) Upon the written request of the local office of the Aging 31
and Disability Services Division of the Department of Health and 32
Human Services or the local law enforcement agency that 33
requested the extension of the delay or upon the order of a court 34
of competent jurisdiction. 35
7. A delay in a requested disbursement or transaction 36
authorized or required by paragraph (c) of subsection 2 may 37
expire before the period set forth in subsection 6 and the 38
designated reporter may proceed with the requested disbursem ent 39
or transaction if the designated reporter reasonably believes that 40
the requested disbursement or transaction will not result in 41
exploitation of the older person or vulnerable person. 42
8. A court of competent jurisdiction may issue an order 43
extending a delay of a requested disbursement or transaction 44
authorized or required by paragraph (c) of subsection 2 based on 45

the petition of the local office of the Aging and Disability Services 1
Division of the Department of Health and Human Services, a local 2
law enforcement agency or any other interested party. 3
9. When determining whether an older person or vulnerable 4

an account to which an older person or vulnerable person is a 10
beneficiary that the older person or vulnerable person cannot 11
explain; 12
(b) A request to close a certificate of deposit of an older person 13
or vulnerable person that is made: 14
(1) Before the date of maturity of the certificate of deposit; 15
and 16
(2) With apparent disregard for any penalty associated with 17
closing the certificate of deposit before the date of maturity of the 18
certificate of deposit; 19
(c) A check written by an older person or vulnerable person 20
under suspicious circumstances; 21
(d) An uncharacteristic attempt by an older person or 22
vulnerable person to initiate a wire transfer of a significant sum of 23
money; 24
(e) A suspicious signature on documentation relating t o an 25
account of an older person or vulnerable person; 26
(f) A suspicious alteration to a: 27
(1) Trust to which an older person or vulnerable person is a 28
beneficiary; or 29
(2) Will or trust for which an older person or vulnerable 30
person is a testator or trustee; 31
(g) A suspicious alteration in a power of attorney relating to 32
an older person or a vulnerable person; and 33
(h) A person attempting to initiate a financial transaction on 34
behalf of an older person or vulnerable person without proper 35
documentation. 36
Sec. 31. Chapter 677 of NRS is hereby amended by adding 37
thereto the provisions set forth as sections 32 to 38, inclusive, of this 38
act. 39
Sec. 32. “Covered account” means an account which a 40
licensee has actual knowledge is: 41
1. An account of an older person or vulnerable person; or 42
2. An account to which an older person or vulnerable person 43
is a beneficiary. 44

licensee may notify and provide information to account holders of 25
covered accounts that were opened before October 1, 2025 , 26
concerning the provisions of this section. 27
Sec. 37. 1. If an account holder of a covered account has 28
designated an emergency financial contact pursuant to section 35 29
or 36 of this act, the licensee: 30
(a) Shall attempt to contact the emergency financial contact 31
within 24 hours after a covered transaction is requested involving 32
the covered account of the account holder to request an opinion 33
from the emergency financial contact concerning whether the 34
covered transaction is the result of exploitation; and 35
(b) Shall n ot proceed with the covered transaction until the 36
later of 24 hours after the attempt to contact the emergency 37
financial contact or, if applicable, the expiration of any temporary 38
delay imposed pursuant to NRS 677.707. 39
2. If, after attempting to contact the emergency financial 40
contact pursuant to subsection 1, an officer or employee of the 41
licensee knows or suspects that exploitation of an account holder 42
has occurred or is occurring, the officer or employee shall report 43
the known or suspected exploitation to the designated reporter in 44

accordance with NRS 677.707, who shall proceed in accordance 1
with the provisions of that section. 2
Sec. 38. 1. If a licensee violates the provisions of section 37 3
of this act and that violation results in the exploitation of the 4
account holder, the account holder may bring an action against 5
the licensee. In such a n action, the account holder is entitled to 6
treble damages. 7
2. In any action brought pursuant to subsection 1, the 8
plaintiff must allege in the complaint, and prove at the trial, that, 9
as of the time of the violation, the plaintiff had designated an 10
emergency financial contact in the manner set forth in subsection 11
1 of section 35 of this act. 12
Sec. 39. NRS 677.673 is hereby amended to read as follows: 13
677.673 As used in NRS 677.673 to 677.707, inclusive, and 14
sections 32 to 38, inclusive, of this act, unless the context otherwise 15
requires, the words and terms defined in NRS 677.677 to 677.697, 16
inclusive, and sections 32, 33 and 34 of this act have the meanings 17
ascribed to them in those sections. 18
Sec. 40. NRS 677.707 is hereby amended to read as follows: 19
677.707 1. Each licensee shall designate a person or persons 20
to whom an officer or employee of the licensee must report known 21
or suspected exploitation of an older person or vulnerable person. 22
2. If an officer or employee reports known or suspected 23
exploitation of an older person or vulnerable person to a designated 24
reporter and, based on such a report or based on his or her own 25
observations or knowledge, the designated reporter knows or has 26
reasonable cause to believe that an older person or vulnerable 27
person has been exploited, the designated reporter : [shall:] 28
(a) Except as otherwi se provided in subsection 3, shall report 29
the known or suspected exploitation of the older person or 30
vulnerable person to: 31
(1) The local office of the Aging and Disability Services 32
Division of the Department of Health and Human Services; 33
(2) A police department or sheriff’s office; 34
(3) The county’s office for protective services, if one exists 35
in the county where the suspected action occurred; or 36
(4) A toll-free telephone service designated by the Aging and 37
Disability Services Division of the Depart ment of Health and 38
Human Services; [and] 39
(b) [Make] Shall make such a report as soon as reasonably 40
practicable [.] ; and 41
(c) May temporarily delay a requested disbursement from, or a 42
requested transaction involving, an account of an older person or 43
vulnerable person or an account to which an older person or 44
vulnerable person is a beneficiary , except that if the disbursement 45

shall temporarily delay the transaction. A designated reporter who 2
temporarily delays a disbursement or transaction pursuant to this 3
paragraph shall: 4

(I) Provide written notification of the delay and the 7
reason for the delay to all parties authorized to transact business 8
on the account and an emergency financial contact, if applicable, 9
except a party or emergency financial contact who is reasonably 10

after becoming aware of the information. 19
3. If the designated reporter knows or has reasonable cause to 20
believe that the exploitation of the older person or vulnerable person 21
involves an act or omission of the Aging and Disability Services 22
Division, another division of the Department of Health and Human 23
Services or a law enforcemen t agency, the designated reporter shall 24

(g) A suspicious alteration in a power of attorney relating to 22
an older person or a vulnerable person; and 23
(h) A person attempting to initiate a financial transaction on 24
behalf of an older person or vulnerable person without proper 25
documentation. 26
Sec. 41. NRS 162A.370 is hereby amended to read as follows: 27
162A.370 1. Except as otherwise provided in subsection 2: 28
(a) A person shall either accept an acknowledged power of 29
attorney, or request a certification, a translation or an opinion of 30
counsel pursuant to NRS 162A.360, not later than 10 business days 31
after presentation of the power of attorney for acceptance; 32
(b) If a person requests a certification, a translation or an 33
opinion of counsel pursuant to NRS 162A.360, the person shall 34
accept the power of attor ney not later than 5 business days after 35
receipt of the certification, translation or opinion of counsel; and 36
(c) A person may not require an additional or different form of 37
power of attorney for authority granted in the power of attorney 38
presented. 39
2. A person is not required to accept an acknowledged power 40
of attorney if: 41
(a) The person is not otherwise required to engage in a 42
transaction with the principal in the same circumstances; 43
(b) Engaging in a transaction with the agent or the principal in 44
the same circumstances would be inconsistent with federal law; 45

(c) The person has actual knowledge of the termination of the 1
agent’s authority or of the power of attorney before exercise of the 2
power; 3
(d) A request for a certification, a translation or an opinion of 4
counsel pursuant to NRS 162A.360 is refused; 5
(e) The person in good faith believes that the power is not valid 6
or that the agent does not have the authority to perform the act 7
requested, whether or not a certification, a translation or an opini on 8
of counsel has been requested or provided pursuant to 9
NRS 162A.360; 10
(f) The person makes, or has actual knowledge that another 11
person has made, a report pursuant to NRS 200.5093 stating a good 12
faith belief that the principal may be subject to abuse, n eglect, 13
exploitation, isolation or abandonment by the agent or a person 14
acting for or with the agent; or 15
(g) The person: 16
(1) Makes, or has actual knowledge that another person has 17
made, a report pursuant to NRS 657.290 , 672.779, 673.807, 18
677.707 or sec tions 7, 17, 27 or 37 of this act of the known or 19
suspected exploitation by the agent, or a person acting for or with 20
the agent, of the principal who is an older person or vulnerable 21
person; or 22
(2) Is a designated reporter of a financial institution , credit 23
union, savings bank or thrift company who, pursuant to NRS 24
657.290, 672.779, 673.807, 677.707 or sections 7, 17, 27 or 37 of 25
this act delays a requested disbursement or transaction involving a 26
principal who is an older person or vulnerable person whom the 27
designated reporter knows or has reasonable cause to believe is 28
being exploited. 29
3. A person that refuses in violation of this section to accept an 30
acknowledged power of attorney is subject to: 31
(a) A court order mandating acceptance of the power of 32
attorney; and 33
(b) Liability for reasonable attorney’s fees and costs incurred in 34
any action or proceeding that confirms the validity of the power of 35
attorney or mandates acceptance of the power of attorney. 36
4. As used in this section: 37
(a) “Designated reporter” has the meaning ascribed to it in NRS 38
657.230 [.] , 672.769, 673.777 or 677.677, as applicable. 39
(b) “Older person” has the meaning ascribed to it in 40
NRS [657.250.] 200.5092. 41
(c) “Vulnerable person” has the meaning ascribed to it in 42
NRS [657.270.] 200.5092. 43
