AN ACT making appropriations to the Interim Finance Committee
for allocation to the State Public Charter School Authority
to provide money to charter schools for salary increases
for certain employees; and providing other matters
properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. 1. There is hereby appropriated from the State 1
General Fund to the Interim Finance Committee for allocation to the 2
State Public Charter School Authority to provide money to charter 3
schools for salary increases for tea chers and education support 4
professionals the following sums: 5
For the Fiscal Year 2025-2026 ............................. $19,314,297 6
For the Fiscal Year 2026-2027 ............................. $19,314,297 7
2. On or before June 15, 2025, each charter school in this State 8
shall submit to the State Public Charter School Authority a 9
statement of the number of teachers and education support 10
professionals employed by the charter school on October 1, 2024. 11
The State Public Charter School Authority shall compile this 12
information and, not later than July 15, 2025: 13

(a) Submit the compiled information to the Interim Finance 1
Committee. 2
(b) Estimate the total amount of money which the Authority will 3
be authorized to distribute to each charter school for Fiscal Year 4
2025-2026 pursuant to subsection 7 and provide this informa tion to 5
each charter school. 6
3. On or before June 15, 2026, each charter school in this State 7
shall submit to the State Public Charter School Authority a 8
statement of the number of teachers and education support 9
professionals employed by the charter scho ol on October 1, 2025. 10
The State Public Charter School Authority shall compile this 11
information and, not later than July 15, 2026: 12
(a) Submit the compiled information to the Interim Finance 13
Committee. 14
(b) Estimate the total amount of money which the Authority will 15
be authorized to distribute to each charter school for Fiscal Year 16
2026-2027 pursuant to subsection 7 and provide this information to 17
each charter school. 18
4. On or before August 15, 2025, and August 15, 2026, each 19
charter school in this State shall submit to the State Public Charter 20
School Authority a plan by the charter school to increase salaries for 21
teachers and education support professionals during the then-current 22
fiscal year which: 23
(a) Describes the manner in which money distributed to the 24
charter school will be allocated among the teachers and education 25
support professionals employed by the charter school; and 26
(b) Provides for an increase in salary for teachers and education 27
support professionals which does not replace or supplant any other 28
form of compensation which was provided to teachers or education 29
support professionals of the charter school before Fiscal Year 2025 -30
2026 or which was bargained for or planned for Fiscal Year 2025 -31
2026 or any succeeding fiscal year before the effecti ve date of this 32
act. 33
5. On or before September 15, 2025, and September 15, 2026, 34
the State Public Charter School Authority shall compile and submit 35
to the Interim Finance Committee the plans submitted by each 36
charter school for the then -current fiscal ye ar pursuant to 37
subsection 4. 38
6. Money appropriated by subsection 1 may only be allocated 39
to the State Public Charter School Authority by the Interim Finance 40
Committee upon request by the Authority after the Authority has 41
complied with the requirements of subsection 2 or 3, as applicable, 42
and subsection 5. 43

7. The amount of money distributed by the State Public Charter 1
School Authority to a charter school pursuant to this section must 2
not exceed an amount which is equal to: 3
(a) For Fiscal Year 2025 -2026, $19,314,297 multiplied by a 4
percentage which is the number of teachers and education support 5
professionals employed by the charter school on October 1, 2024, 6
expressed as a percentage of the total number of teachers and 7
education support professionals emp loyed in all of the charter 8
schools in this State on October 1, 2024. 9
(b) For Fiscal Year 2026 -2027, $19,314,297 multiplied by a 10
percentage which is the number of teachers and education support 11
professionals employed by the charter school on October 1, 20 25, 12
expressed as a percentage of the total number of teachers and 13
education support professionals employed in all of the charter 14
schools in this State on October 1, 2025. 15
8. Money appropriated by subsection 1 may only be distributed 16
by the Authority to a charter school which has complied with the 17
requirements of subsection 2 or 3, as applicable, and subsection 4. 18
9. The money appropriated by subsection 1 must be used to 19
supplement and not supplant or cause to be reduced any other source 20
of funding for t he support of charter schools or for the salary and 21
compensation of teachers or education support professionals 22
employed by any charter school. 23
10. On or before August 1, 2026, and August 1, 2027, each 24
charter school in this State that received a distrib ution from the 25
money appropriated by subsection 1 during Fiscal Year 2025 -2026 26
and Fiscal Year 2026-2027, respectively, shall submit a report to the 27
State Public Charter School Authority which includes, without 28
limitation: 29
(a) Detailed information on how all the money received pursuant 30
to this section was spent by the charter school during the 31
immediately preceding fiscal year; and 32
(b) The actual increase to the salary of teachers and education 33
support professionals employed by the charter school during t he 34
immediately preceding fiscal year and the amount of such an 35
increase for which the money received pursuant to this section was 36
spent. 37
11. On or before October 1, 2026, and October 1, 2027, the 38
State Public Charter School Authority shall compile and su bmit to 39
the Interim Finance Committee the reports received by the Authority 40
pursuant to subsection 10 with respect to the immediately preceding 41
fiscal year. 42
12. Any balance of the sums appropriated by subsection 1 43
remaining at the end of the respective fiscal years must not be 44
committed for expenditure after June 30 of the respective fiscal 45

years by the entity to which the appropriation is made or any entity 1
to which money from the appropriation is granted or otherwise 2
transferred in any manner, and any portion of the appropriated 3
money remaining must not be spent for any purpose after 4
September 18, 2026, and September 17, 2027, respectively, by 5
either the entity to which the money was appropriated or the entity 6
to which the money was subsequently granted or transferred, and 7
must be reverted to the State General Fund on or before 8
September 18, 2026, and September 17, 2027, respectively. 9
13. As used in this section: 10
(a) “Administrator” means a person who spends at least 50 11
percent of his or her work year supervising other staff or licensed 12
personnel, or both, and who is not classified by the governing body 13
of the charter school as a professional-technical employee. 14
(b) “Education support professional” means a person, other than 15
a teacher or administrator , who is employed to work at a charter 16
school, including, without limitation: 17
(1) Paraprofessionals; 18
(2) School police officers, school resource officers and other 19
providers of security services at a school; 20
(3) School nurses; 21
(4) School counselors; 22
(5) School psychologists; 23
(6) School social workers; 24
(7) Drivers of school buses; 25
(8) Secretaries; 26
(9) Members of the custodial or maintenance staff; and 27
(10) Workers in food services. 28
(c) “Teacher” means a person licensed pursuant to chapter 391 29
of NRS who is classified by the governing body of a charter school: 30
(1) As a teacher and who spends at least 50 percent of his or 31
her work year providing instruction or discipline to pupils; or 32
(2) As instructional support staff, who do es not hold a 33
supervisory position and who spends not more than 50 percent of 34
his or her work year providing instruction to pupils. Such 35
instructional support staff includes, without limitation, librarians 36
and persons who provide instructional support. 37
Sec. 2. This act becomes effective upon passage and approval. 38
