STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
establishing the right to provide educational instruction in municipally zoned and non-zoned areas.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Learning Pod Protection. Amend RSA 674 by inserting after section 76 the following new subdivision:
Learning Pod Protection
674:77 Definitions. In this subdivision:
I. "Learning pod" means providing educational instruction to voluntarily associated children in any designated or non-designated zone within a municipality.
II. "Municipally zoned area" means an area designated for specific uses through a local zoning ordinance.
III. "Non-zoned area" refers to any area within a municipality that is not subject to zoning ordinances or regulations.
674:78 Rights. Every voluntarily associated child shall have the right to be educated in any municipally zoned or non-zoned area within the municipality.
674:79 Implementation. Notwithstanding any other law to the contrary, no zoning ordinance or land use regulation shall restrict or prohibit the provision of educational instruction in any area within the municipality.

2 Effective Date. This act shall take effect 60 days after its passage.
