AMENDED ANALYSIS

This bill:

I. Requires a public employer to provide written notice to a public employee of the cause of their suspension and its anticipated duration, if known, requires periodic updates to the public employee until a final decision is made, and exempts public employees covered by collective bargaining agreements that establish disciplinary procedures from the notice requirement.

II. Directs that certain positions in the department of corrections be recognized by the division of personnel in the department of administrative services in the official record as group II.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT relative to notice requirements regarding public employee suspensions and investigations and recognizing certain positions in the department of corrections as group II positions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Protective Legislation; Notice of Suspension of Public Employees. Amend RSA 275 by inserting after section 83 the following new subdivision:
Notice of Suspension of Public Employees
275:84 Suspension Notice and Investigation Updates to Public Employees.
I. If any public employee is suspended from duty, with or without pay, the public employee shall receive written notice, within 7 days of the suspension date, stating the cause of the suspension and anticipated duration, if known. The suspended public employee shall be provided with periodic updates regarding the status of their suspension every 90 days until a final decision is made.
II. This section shall apply to all public employees unless the public employee is employed under a collective bargaining agreement negotiated pursuant to RSA 273-A and that agreement establishes procedures related to disciplinary actions including suspension.
III. For the purposes of this section:
(a) “Employer" means the state of New Hampshire and any of its political subdivisions.
(b) "Public employee" or "employee" means any person employed by the state or any subdivision thereof, including, but not limited to counties, cities, towns, precincts, water districts, school districts, and school administrative units.

2 Department of Corrections; Group II Recognition.
Pursuant to the provision of RSA 100-A:3, IX, the following positions in the department of corrections classified as group I positions are deemed to have met the requirement of RSA 100-A:1, VII(b) and shall be recognized by the division of personnel in the department of administrative services in the official record as group II:

3 Effective Date.
I. Section 1 of this act shall take effect January 1, 2027.
II. The remainder of this act shall take effect June 30, 2026.
