STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
limiting the placement of out-of-state waste going into New Hampshire landfills.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Out-of-State Solid Waste; Limited. Amend RSA 149-M by inserting after section 9 the following new section:
149-M:9-a Out-of-State Solid Waste; Limited. By January 1, 2030, any landfill operator permitted under this chapter on or prior to December 31, 2025, shall accept out-of-state solid waste as no more than 30 percent of its total solid waste. Any landfill operator who receives a permit on or after January 1, 2026, under this chapter shall accept out-of-state solid waste as no more than 15 percent of its total solid waste.
2 Effective Date. This act shall take effect 60 days after its passage.
