STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to the remediation of mold in rental housing.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Minimum Standards for Rental Housing; Mold. Amend RSA 48-A:14 by inserting after paragraph XI the following new paragraph:
XII. There is a significant infestation of mold such that it can be visibly seen or, with professional instrumentation, can be detected behind walls, under carpets, or in other areas not immediately visible.

2 Enforcement. Amend RSA 48-A:15, to read as follows:
48-A:15 Enforcement of Minimum Standards.

I.
In municipalities which have not established a public agency as described in RSA 48-A:3, a violation of the minimum standards set forth in RSA 48-A:14 shall be a violation, and each continuing day of violation after notice shall be a separate offense.

II. Municipal officers charged with the enforcement of minimum standards for rental housing may inspect, investigate, and enforce the provisions of RSA 48-A:14, XII, and may issue notices of violation, orders of remediation, and pursue remedies consistent with this section.

3 Effective Date. This act shall take effect 60 days after its passage.
