AMENDED ANALYSIS

This bill limits the flags which may be displayed over the state house to only those flags officially recognized by the federal government by law, executive order, or an official agency regulation, with the exception of the Gold Star Flag, which the governor may authorize to display on state house grounds.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to the authorized display of flags on state house grounds.

Be it Enacted by the Senate and House of Representatives in General Court convened:

225:1 Gold Star Mother's and Family's Day. RSA 4:13-h, II is repealed and reenacted to read as follows:
II. Notwithstanding RSA 3:4-a, II, the governor may choose to honor Gold Star families by ordering the Gold Star Flag to be displayed on the grounds of the New Hampshire state house and at the New Hampshire state veterans cemetery in Boscawen on that day as described in paragraph I. The flag, if displayed, shall be flown in the most junior order of precedence. The flag shall be provided at no cost to the state of New Hampshire.

225:2 State Emblems, Flag, Etc.; Permitted Displays Modified. Amend RSA 3:4-a to read as follows:
3:4-a State Flag, United States Flag, POW-MIA Flag; Place of Manufacture;
Authorized Displays at State House

I.
Any state flag, United States flag, or POW-MIA flag purchased with state funds or displayed in a state facility shall be manufactured in the United States. This paragraph shall only apply to flags acquired after the effective date of this section.
II. Only those flags officially recognized by the United States federal government shall be flown over the state house. For purposes of this section, flags officially recognized by the United States federal government means only those flags that have been established by federal law, executive order, or an official agency regulation.

225:3 Effective Date. This act shall take effect 60 days after its passage.
