This bill prohibits health care facilities from refusing referrals from independent and outside primary care providers so long as the health care facility and specialist accept the insurance of the patient, and establishes penalties for failure to comply.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to health care provider networks and referrals.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Health Care Referrals. Amend RSA 151 by inserting after section 9-b the following new section:
151:9-c Health Care Referrals.
I. No health care facility licensed under this chapter shall prohibit referrals from independent and outside primary care providers so long as the health care facility and specialist accept the insurance of the patient, pursuant to RSA 151:21, XXI.
II. The attorney general shall be empowered to enforce the provisions of this section. Any health care facility that violates this section shall be subject to:
(a) A $100,000 civil fine per violation.
(b) Loss of nonprofit status under state law, if the health care facility is a nonprofit.

2 Effective Date. This act shall take effect 60 days after its passage.
