STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
establishing penalties for unauthorized parking in designated electric vehicle and motorcycle spaces.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Stopping, Standing or Parking Prohibited in Specified Places; Electric Vehicles; Mopeds of Motorcycles. Amend RSA 265:69, I(m) to read as follows:
(m) In or overlapping into any access aisle. Notwithstanding the provisions of title LXII or any other provision of law, a person who violates the provisions of this subparagraph shall be fined a minimum of $100 for a first offense and a minimum of $200 for each subsequent offense

(n) In any parking place, whether on public or private property, specially designated for an electric vehicle by means of a sign affixed to a post or a building, clearly visible to anyone directly approaching that particular parking place, meeting the Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD) requirements to show that the space is reserved for electric vehicle charging, unless the vehicle is being actively charged. Notwithstanding the provisions of title LXII or any other provision of law, a person who violates the provisions of this subparagraph shall be fined a minimum of $62 of which 20 percent is payable to the town or city where the violation occurred;
(o) In any parking place, whether on public or private property, specially designated for a moped or motorcycle by means of a sign affixed to a post or a building, clearly visible to anyone directly approaching that particular parking place, meeting the MUTCD requirements to show that the space is reserved for moped or motorcycle parking, unless the vehicle is a moped as defined by RSA 259:57 or motorcycle as defined by RSA 259:63. Notwithstanding the provisions of title LXII or any other provision of law, a person who violates the provisions of this subparagraph shall be fined a minimum of $62 of which 20 percent is payable to the town or city where the violation occurred

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill prohibits non-conforming vehicles from stopping, standing, or parking in a parking space properly designated for an electric vehicle, moped, or motorcycle, and establishes a minimum fine of $62, with 20% of the fine going to the local municipality where the violation occurred, and the remaining amount assumed to be credited to the state highway fund. The Department of Safety states it would incur a one-time system change cost of $116,000 to implement the provisions of this bill. As the number of violations cannot be predicted, this bill’s revenue impact on the state highway fund and local governments cannot be estimated.
