This bill clarifies that the statute authorizing the division of motor vehicles to establish electronic credentials does not grant the authority to compel a person to create, maintain, or display an electronic credential, nor to require any business to accept them.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to electronic credentials.

Be it Enacted by the Senate and House of Representatives in General Court convened:

178:1 New Paragraph; Mobile Drivers' Licenses and Non-Driver Identification Cards; Electronic Credential; Privacy. Amend RSA 263-A:5 by inserting after paragraph II the following new paragraph:
III. Nothing in this chapter shall be construed to
require a person to obtain an electronic credential, a
nd no person shall be compelled to create, maintain, or display an electronic credential.

178:2 New Paragraph; Acceptance of Electronic Credentials. Amend RSA 263-A:3 by inserting after paragraph IV the following new paragraph:
V. Nothing in this chapter shall be construed to require any business to accept an electronic credential.

178:3 Effective Date. This act shall take effect 60 days after its passage.
