STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT
requiring disclosure of radiation levels emitted by smart meters.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Public Utilities; Smart Meter Radiation Disclosure. Amend RSA 374 by inserting after section 2-a the following new section:
374:2-b Smart Meter Radiation Disclosure.
I. Each electric utility operating in the state shall provide an annual written statement to each utility account holder that discloses the radiation levels emitted by any smart meter installed at the service location.
II. The statement required under paragraph I shall be provided in paper or electronic form and may be included with a regular billing statement or sent as a separate notice.
III. The public utilities commission shall oversee compliance with this section and may adopt rules under RSA 541-A as necessary to implement its provisions.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill requires electric utilities to annually disclose smart meter radiation levels to account holders and authorizes the Public Utilities Commission to oversee compliance and adopt implementing rules.
The Public Utilities Commission states this bill would require the Commission to oversee and enforce annual smart meter radiation disclosures by electric utilities and to conduct adjudicative proceedings and rulemaking to implement and monitor compliance with the new requirements. The Commission states its current utility analyst and attorney staffing levels are already working at or near full utilization and cannot absorb this additional workload. To meet the bill’s requirements, the Commission anticipates the need for one full-time Utility Analyst (13-1190 Miscellaneous Business Operations Specialist-5) and one full-time Attorney IV (23-1010 Lawyers and Judicial Law Clerks-4). The estimated cost for these two positions would be $254,000 in FY 2027, $266,000 in FY 2028, and $280,000 in FY 2029. These costs would be funded through the utility assessment under RSA 363-A.
