In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
repealing the statewide use of the multi-tiered system of supports for behavioral health and wellness relative to systems of care for children's mental health.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Repeal. RSA 135-F:3, III(l), relative to statewide use of the multi-tiered system of supports for behavioral health and wellness, or MTSS-B, in New Hampshire schools, is repealed.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill repeals RSA 135-F:3, relative to statewide use of the multi-tiered system of supports for behavioral health and wellness (MTSS-B) in NH schools. The Department of Health and Human Services states that, other than a requirement in the existing statute to provide "technical assistance to school districts and other education providers to support implementation of MTSS-B,” the Department plays no role in implementing the existing program. Existing services are potentially reimbursed through the Medicaid to Schools program, but this program is the financial responsibility of local school districts. Medicaid to Schools is included in the state operating budget only because the Department acts as a pass-through, as it is the agency designated for receiving federal Medicaid funds. The Department notes that theoretically, repeal may result in an increase in children needing higher levels of care, potentially leading to future costs for intensive behavioral health services. Any such costs, however, are unable to be quantified.

The Department of Education states that it is unable to determine the fiscal impact of the bill.
