STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to seed laws.

Be it Enacted by the Senate and House of Representatives in General Court convened:

182:1 New Paragraph; Seeds, Plants and Nursery Stock; New Hampshire Seed Law; Definitions. Amend RSA 433:1 by inserting after paragraph XXIII the following new paragraph:
XXIII-a. “Production date” means the calendar month and year that a seed lot’s first germination test was completed.

182:2 New Subparagraph; Seeds, Plants and Nursery Stock; New Hampshire Seed Law; Label Requirements for Agricultural, Vegetable and Flower Seeds. Amend RSA 433:2, III by inserting after subparagraph (h) the following new subparagraph:
(i) The production date.

182:3 Seeds, Plants and Nursery Stock; New Hampshire Seed Law; Prohibitions. Amend RSA 433:4, II(g)-(h) to read as follows:
II. Within the state:
(g) To use relabeling stickers without having both the calendar month and year the germination test was completed, the sell by date, as stated in [
RSA 433:2, III(g),
] RSA 433:2, V(c)[

] and RSA 433:2, VII(a), and the lot number that matches the existing, original lot number. Relabeling shall not occur more than once.
(h) [
To alter or falsify any seed label, seed test, laboratory report, record, or other document to create a misleading impression as to kind, kind and variety, history, quality, or origin of seed.

To use relabeling stickers without having both the calendar month and year the germination test was completed, the sell by date, as stated in RSA 433:2, III(g), and the lot number that matches the existing, original lot number. Any relabeling sticker shall either:
(1) Not cover the original production date; or
(2) Carry forward the original production date.
(i) To sell seed more than 36 months after its production date.
(j) To alter or falsify any seed label, seed test, laboratory report, record, or other document to create a misleading impression as to kind, kind and variety, history, quality, or origin of seed.

182:4 Effective Date. This act shall take effect upon its passage.
