STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to the conditional release of delinquent minors and children in need of services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

57:1 Delinquent Children; Definition of Conditional Release. Amend RSA 169-B:2, VIII(d) to read as follows:
(d) Return to the court for violation of conditions of the release and change of disposition at any time during the term of conditional release.
The court may retain jurisdiction to hear violations of the conditions of release so long as the violation is filed within the period of conditional release.

57:2 New Paragraph; Delinquent Children; Jurisdiction. Amend RSA 169-B:4 by inserting after paragraph V the following new paragraph:

V-a. The court may retain jurisdiction to hear violations of conditions of release pursuant to RSA 169-B:2, VIII(d).

57:3 Children in Need of Services; Definition of Conditional Release. Amend RSA 169-D:2, III(d) to read as follows:
(d) Return to the court for violation of the conditions of the release and change of the disposition at any time during the term of the conditional release.
The court may retain jurisdiction to hear violations of the conditions of release so long as the violation is filed within the period of conditional release.

57:4 New Paragraph; Children in Need of Services; Jurisdiction. Amend RSA 169-D:3 by inserting after paragraph II the following new paragraph:

II-a. The court may retain jurisdiction to hear violations of conditions of release pursuant to RSA 169-D:2, III(d).

57:5 Effective Date. This act shall take effect January 1, 2027.
