STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT
relative to fees to annul criminal records related to charges that do not result in conviction.

Be it Enacted by the Senate and House of Representatives in General Court convened:

105:1 Annulment of Criminal Records. Amend RSA 651:5, II-a(a) to read as follows:
II-a.(a)
(1)
For an offense disposed of on or after January 1, 2019, any person whose arrest has resulted in a finding of not guilty on all charges that resulted from the arrest, or whose case was dismissed or not prosecuted, shall have the arrest record and court record annulled:

Thirty days following the finding of dismissal if an appeal is not taken under RSA 606:10 or finding of not guilty; or

(2)

(B)
Upon final determination of the appeal affirming the finding of dismissal if an appeal is taken under RSA 606:10.

(2) No filing fee shall be charged for any petition to annul brought under subparagraph II-a(a).

105:2 Effective Date. This act shall take effect January 1, 2027.
