SYNOPSIS
���� Prohibits public institution of higher education from
entering into certain partnerships with institutions of higher education
located in Palestinian territories.

An Act
concerning partnerships of public institutions of higher
education with certain foreign entities and supplementing chapter 62 of Title
18A of the New Jersey Statutes.�

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:
���� 1.� a.� A public institution
of higher education shall be prohibited from:
���� (1)�� entering into a
contract, partnership, joint venture, memorandum of understanding,
collaborative arrangement, or association of any kind with an institution of
higher education located in Palestinian-controlled West Bank or Gaza
territories
; or
���� (2)�� engaging in the
transfer, license, or sublicense of intellectual property owned by the
institution with an institution of higher education located� in
Palestinian-controlled West Bank or Gaza territories
.
���� b.��� An institution of higher
education determined by the Secretary of Higher Education to not be in
compliance with the provisions of subsection a. of this section shall become
ineligible for any
State support for the operational
and capital costs of the institution.
���� c.���� As used in this
section, "intellectual property" means all original data, findings,
or other products of the mind or intellect commonly associated with claims,
interests, and rights that are protected under trade secret, patent, trademark,
copyright, or unfair competition law.
���� 2.��� This act shall take
effect immediately.�
STATEMENT
���� This bill prohibits a public
institution of higher education from:
�
entering into a
contract, partnership, joint venture, memorandum of understanding,
collaborative arrangement, or association of any kind with an institution of
higher education located in Palestinian-controlled West Bank or Gaza
territories
; or
�
engaging in the
transfer, license, or sublicense of intellectual property owned by the
institution with an institution of higher education located� in
Palestinian-controlled West Bank or Gaza territories
.
���� Under the bill, any
institution of higher education determined by the Secretary of Higher Education
to not be in compliance with the bill�s provisions is to become ineligible for
any
State support for the operational and capital
costs of the institution.
