STATEMENT TO

ASSEMBLY,
No. 2558

with
committee amendments

STATE
OF NEW JERSEY

DATED:
MAY 7,
2026

The Assembly Education Committee reports favorably and
with committee amendments Assembly Bill No. 2558.

As amended, this bill permits retired school business
administrators to be reemployed part-time by a school district for longer than
a two-year period without approval by the Commissioner of Education.

Under current law, retired school business
administrators can be hired by school districts without having to be reenrolled
in the Teachers Pension and Annuity Fund, provided that their terms of
employment are subject to one-year contracts which cannot be extended for more
than a total of two-years without approval by the commissioner.

The bill permits the renewal of one-year contracts on
an annual basis without a limitation on the number of times the contract may be
renewed and without approval by the commissioner.

The bill stipulates that the ability to reemploy a
retired school business administrator is contingent upon the board of
educations ability to demonstrate a critical need for the position and the
commissioners determination that there is a critical need.

This bill does not permit a retired school business
administrator who is reemployed to obtain tenure in the position and any tenure
or seniority rights previously obtained will not apply to the period of
employment or reemployment.

This bill was pre-filed for introduction in the
2026-2027 session pending technical review. As reported, the bill includes the
changes required by technical review, which has been performed.

COMMITTEE AMENDMENTS
:

The committee amended the bill to apply solely to
school business administrators, instead of school superintendents,
administrators, and nurses, who are reemployed on a part-time basis. The
committee also amended the bill to provide that the ability to reemploy a
retired school business administrator is contingent upon the determination that
there is a critical need.
