An Act

concerning older adults and supplementing Title
30 of the Revised Statutes.

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.� a.� Notwithstanding any
law, rule, or regulation to the contrary, the Division of Aging Services in the
Department of Human Services shall establish one application form that a
person, aged 65 or older or between the ages 18 and 64 and receiving Social Security
Disability, who is eligible to receive services from a federal and State-funded
program administered by the division shall use in applying for such services.�
The form shall provide for the inclusion of all information necessary to
determine eligibility for each program.

���� b.� The division shall
automatically process an application for, and enroll that person in, each of
the federal and State-funded programs administered by the division unless the
person affirmatively opts out of, or is ineligible to receive services from,
that program.

���� 2.� The Department of Human
Services shall adopt rules and regulations, pursuant to the provisions of the
"Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.),
to effectuate the purposes of this act.

���� 3.� This act shall take effect
on the first day of the third month next following enactment, except that
Department of Human Services may take any anticipatory administrative action in
advance as shall be necessary for the implementation of the act.

STATEMENT

This bill requires the Division of
Aging Services (the division) in the Department of Human Services to establish
one application form that a person aged 65 or older or between the ages of 18
and 64 and receiving Social Security Disability, and who is eligible to receive
services from a federal and State-funded program administered by the division
can use in applying for such services.� The form is to include all information
necessary to determine eligibility for all the programs administered by the division.

���� The bill also requires the
division to automatically process an application for, and enroll that person
in, each of the federal and state-funded programs administered by the division
unless the person affirmatively opts out of, or is ineligible to receive
services from, that program.
