An Act
concerning motorbus shelters and supplementing
P.L.1979, c.150 (C.27:25-1 et al.).

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:
���� 1.��� a.� As used in this
section:�
���� �Bus stop� means a stop for motorbus
regular route service.
���� �Corporation� means the New
Jersey Transit Corporation.
���� �High-traffic area� means a
location along a public highway determined by the corporation to have an
increased danger to pedestrian and motorbus passenger safety.� When determining
whether a location is a high-traffic area, the corporation shall consider, at a
minimum, the location�s average traffic, frequency of traffic collisions,
frequency of injuries and fatalities to pedestrians, and proximity to schools,
hospitals, senior housing, or other areas with high pedestrian activity.
���� �Motorbus regular route
service� means and includes the operation of any motorbus or motorbuses on
streets, public highways or other facilities, over a fixed route and between
fixed termini on a regular schedule for the purpose of carrying passengers for
hire or otherwise, in this State or between points in this State and points in
other states.
���� �Pre-existing shelter� means a
shelter installed by the corporation prior to the enactment of
P.L. , c.
(C. ) (pending before the
Legislature as this bill).
���� �Shelter� means a structure
installed by the corporation at a bus stop to provide passengers with temporary
shelter while waiting for motorbus regular route service.
���� b.��� Subject to the
availability of funds appropriated or otherwise made available, when installing
a shelter at a bus stop in a high-traffic area, the corporation shall equip the
shelter with safety features, including, but not limited to, barriers and
lighting, to protect riders from traffic-related injuries and fatalities while
waiting for motorbus regular route service.
���� c.���� Upon the request of the
municipality or entity maintaining a pre-existing shelter at a bus stop in a
high-traffic area, the corporation shall install safety features, including,
but not limited to, barriers and lighting, to protect riders from
traffic-related injuries and fatalities while waiting for motorbus regular
route service.� The corporation may coordinate with a municipality or entity
maintaining a pre-existing shelter to install safety features, including
sharing costs.
���� 2.��� This act shall take
effect on the first day of the seventh month next following enactment.
STATEMENT
���� This bill requires the New
Jersey Transit Corporation (NJT) to install safety features when installing
shelters at bus stops in high-traffic areas.� The bill also requires NJT to
install safety features at pre-existing shelters at bus stops in high-traffic
areas upon the request of the municipality or entity maintaining the shelter.�
Under the bill, �safety features� include, but are not limited to, barriers and
lighting.
