An Act
requiring calculation
of affordable housing obligations on a Statewide basis, supplementing P.L.1985,
c.222 (C.52:27D-301 et al.), and repealing sections 6 and 7 of P.L.2024, c.2
(C.52:27D-304.2 and 52:27D-304.3).

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.��� a.� Statewide determination
of present and prospective fair share of the housing need in the Statewide
region shall be computed for a 10-year period based on a growth-share
calculation method determined by the growth of residential and non-residential
development in the State.� The State shall consist of one single housing region
for the purposes of determining regional need for low- and moderate-income
housing.

���� b.� The growth share
calculation method utilized pursuant to subsection a. of this section shall
include foreclosed and abandoned property, exclude new housing starts during
any administrative rules gap period or during prior round rules adopted by the
Council on Affordable Housing or the Department of Community Affairs, and shall
not exceed five percent of the Statewide housing stock existing when this
figure is calculated.

���� 2.��� The Commissioner of
Community Affairs shall adopt rules and regulations necessary, pursuant to the
"Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.),
to effectuate the purposes of P.L.��� , c.��� (C.������� ) (pending before the
Legislature as this bill), including, but not limited to, rules and regulations
to adjust the timeline established pursuant to subsection f. of section 3 of
P.L.2024, c.2 (C.52:27D-304.1), to ensure that the provisions of P.L.��� ,
c.��� (C.������� ) (pending before the Legislature as this bill) are
implemented as promptly as possible.

���� 3.��� The following sections
are repealed:

���� Section 6 of P.L.2024, c.2
(C.52:27D-304.2); and

���� Section 7 of P.L.2024, c.2
(C.52:27D-304.3).

���� 4.��� This act shall take
effect immediately.

STATEMENT

���� This bill establishes the
growth share calculation method to be used for the calculation of Statewide
present and prospective fair share of housing need in the Statewide region.�
The bill replaces certain calculation methods that were enacted pursuant to
P.L.2024, c.2 (C.52:27D-304.1 et al.) with a growth share calculation method.�
The bill requires the State to consist of one single housing region for the
purposes of determining regional need for low- and moderate-income housing.

���� The bill directs the Commissioner
of Community Affairs to adopt the rules and regulations necessary to effectuate
the purposes of the bill, including rules and regulations to adjust the
existing deadlines required by the "Fair Housing Act," P.L.1985,
c.222 (C.52:27D-301 et al.), to ensure that the provisions of the bill are
implemented as promptly as possible.

���� The bill repeals sections 6
and 7 of P.L.2024, c.2 (C.52:27D-304.2 and 52:27D-304.3), concerning municipal
present need and present and projected fair share housing obligations.� The
bill would take effect immediately.
