An Act
concerning Statewide site improvement standards
for certain parking spaces and supplementing P.L.1993, c.32 (C.40:55D-40.1 et
seq.).

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:
���� 1.��� Notwithstanding any law,
rule, or regulation to the contrary, the Commissioner of Community Affairs
shall adopt regulations, pursuant to the �Administrative Procedure Act,�
P.L.1968, c.410 (C.52:14B-1 et seq.), for the purpose of calculating the number
of available parking spaces pursuant to the Statewide site improvement
standards as follows:
���� a.��� on-street parking spaces
developed after the effective date of P.L.��� , c.��� (C.������� ) (pending
before the Legislature as this bill) shall be a length of 20 feet; and
���� b.��� when determining the
required number of parking spaces in a development, if the number of parking
spaces results in a fractional space for the entire development, any fraction
shall be rounded down to the nearest whole number.�
���� 2.��� This act shall take
effect immediately.
STATEMENT
���� This bill directs the
Commissioner of Community Affairs (commissioner) to adopt regulations for the
purpose of calculating the number of available parking spaces in certain
situations.� Specifically, the bill directs the commissioner to require that
on-street parking spaces developed after the effective date of the bill are to
be a length of 20 feet, rather than the current standard of 23 feet established
pursuant to N.J.A.C.5:21-4.14.� The bill also directs the commissioner to, if
the number of parking spaces in a development results in a fractional space,
round down to the nearest whole number when determining the required number of
parking spaces in the development.
���� Adjusting the size and
calculation of parking spaces is intended to lower development construction
costs.� These adjustments are also intended to improve functional land use for
housing and public spaces, to encourage the use of public transit, and to improve
the walkability of the surrounding area.
