An Act

prohibiting remote work for certain State and
local government employees and amending and supplementing Title 11A of the New
Jersey Statutes.

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.� N.J.S.11A:6-24 is amended
to read as follows:

���� 11A:6-24.� State employees in
the career, senior executive
,
and unclassified services in titles or
circumstances designated by the Civil Service Commission shall be eligible for
overtime compensation and holiday pay.� Overtime compensation and holiday pay
shall be either cash compensation at a rate representing 1 1/2 times the
employee's hourly rate of base salary or compensatory time off at a rate of 1
1/2 hours for each hour worked beyond the regular workweek, at the discretion
of the department head, with the approval of the commission.

���� The commission shall adopt
rules for the implementation of hours of work, overtime compensation and
holiday pay programs, which shall include but need not be limited to
application and eligibility procedures
, except that remote work shall not be
permitted for State employees in the career, senior executive, and unclassified
services
.

���� 2.� (New section) Remote work
shall not be permitted for any employees in the civil service of the State and
of any political subdivision that has adopted the provisions of Title 11A, Civil
Service, of the New Jersey Statutes.

���� 3.� This act shall take effect
immediately.

STATEMENT

���� This bill prohibits remote
work for employees of the State and of political subdivisions operating under
the �Civil Service Act.�

���� Under current law, the Civil
Service Commission is required to adopt rules for States employees� hours of
work.� In 2022, the Civil Service Commission approved and established the Model
Telework Pilot Program, which offers the option for State employees to work remotely
up to two working days per week.� A rule for the telework program was approved
in 2025.

���� Under the bill, remote work
will be prohibited for any employees in the civil service of the State and of any
political subdivision that has adopted the provisions of the �Civil Service Act.��
The commission will also be prohibited from establishing rules that permit
remote work for State employees.
