An Act

concerning hospital facility fees and
supplementing Title 26 of the Revised Statutes.

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.��� a. As used in this
section:

���� "Facility fee" means
any fee charged or billed by a hospital to a patient that is: (1) intended to
compensate the hospital for the operational expenses of the hospital, and (2)
separate and distinct from a professional fee.

���� �Hospital� means
a general acute care hospital that is licensed pursuant to
P.L.1971, c.136 (C.26:2H-1 et seq.).

���� b.��� No hospital shall bill,
or otherwise seek payment from, a patient for a facility fee for services rendered
to the patient at an outpatient facility affiliated with the hospital.

���� 2.��� This act shall take
effect immediately.

STATEMENT

���� This bill
prohibits a hospital
licensed in the State from billing, or otherwise seeking payment from, a
patient for a facility fee for services rendered to the patient at an
outpatient facility affiliated with the hospital.� The bill defines
"facility fee" to mean any fee charged or billed by a hospital to a
patient that is: (1) intended to compensate the hospital for the operational
expenses of the hospital, and (2) separate and distinct from a professional
fee.
