An Act
concerning utility pole relocation and supplementing
Title 48 of the Revised Statutes.

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.��� a.� As used in this
section:

���� �Electric public utility� or
�utility� means a public utility, as that term is defined in R.S.48:2-13, that
transmits and distributes electricity to end users in the State.

���� �Pole� means, in addition to
its commonly accepted meaning, any wires or cable connected thereto, and any
replacements therefor which are similar in construction and use.

���� �Public entity� means a
county, municipality, district, public authority, public agency, and any other
political subdivision or public body in the State.

���� b.��� An electric public
utility shall not charge any public entity a fee for relocating a pole.

���� 2.��� This act shall take
effect immediately.

STATEMENT

���� This bill prohibits electric
public utilities from charging any public entity a fee for relocating a pole.
