An Act
concerning affordable housing municipal obligations and
supplementing P.L.1985, c.222 (C.52:27D-301 et al.).

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.��� As used in P.L.��� ,
c.��� (C.������� ) (pending before the Legislature as this bill:

���� "Public institution of
higher education" means the State colleges or universities established
pursuant to chapter 64 of Title 18A of the New Jersey Statutes, Rutgers, The
State University, New Jersey Institute of Technology, Rowan University, Montclair
State University, Kean University, all county colleges, and any other public
university or college now or hereafter established or authorized by law.

���� "Public transportation
authority" means the New Jersey Transit Corporation established pursuant
to section 4 of P.L.1979, c.150 (C.27:25-4), the New Jersey Turnpike Authority
established pursuant to section 3 of P.L.1948, c.454 (C.27:23-3), and the South
Jersey Transportation Authority established pursuant to section 4 of P.L.1991,
c.252 (C.27:25A-4).

���� 2.��� In the determination and
fulfillment of its municipal present and prospective obligations for the
development of affordable housing in accordance with the formulas established
in sections 6 and 7 of P.L.2024, c.2 (C.52:27D-304.2 and C.52:27D-304.3), and taking
into consideration the calculations in the report published by the Department
of Community Affairs in accordance with section 3 of P.L.2024, c.2
(C.52:27D-304.1), a municipal governing body may enter into an agreement with a
school district, a public institution of higher education, a public
transportation authority, or a public housing authority or redevelopment agency
located within the municipality, to develop affordable housing on property that
is owned by the public entity for the municipality to meet its municipal
obligation for affordable housing.

���� Nothing in this section shall
be construed to limit or negate any other requirements of State laws applicable
to the purchasing, leasing, or selling of property by or for these public
entities.

���� 3.��� This act shall take
effect immediately.

STATEMENT

���� This bill authorizes a municipal
governing body to enter into an agreement with a school district, a public
institution of higher education, a public transportation authority, or a public
housing authority or redevelopment agency located within the municipality, to
develop affordable housing on property that is owned by the public entity to
meet its municipal obligation for affordable housing.
