An Act
prohibiting cost recovery of certain smart grid
projects and supplementing Title 48 of the Revised Statutes.

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:
���� 1.��� This act shall be known
and may be cited as the �Stop Misappropriating Ratepayer Tariffs for Excessive
Resources Act.�
���� 2.��� a.� As used in this
section:
���� �Electric public utility�
means a public utility, as that term is defined in R.S.48:2-13, that transmits and
distributes electricity to end users within the State.
���� �Societal benefits charge�
means the same as that term is defined pursuant to section 3 of P.L.1999, c.23
(C.48:3-51).
���� b.��� Notwithstanding any law,
rule, regulation, or order to the contrary, after the effective date of this
section, an electric public utility shall not recover any cost associated with the
deployment of a smart grid system, including, but not limited to, capital
expenditures and operating expenditures, through any component of the rates
charged to the electric public utility�s ratepayers, including, but not limited
to, the societal benefits charge.
���� 3.��� This act shall take
effect immediately.
STATEMENT
���� This bill prohibits an electric
public utility from recovering costs related to the deployment of a smart grid
system through any component of the rates charged to the electric public
utility�s ratepayers, including, but not limited to, the societal benefits
charge.
