delivery vehicles and supplementing Title 39 of the Revised Statutes.

Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.��� As used in
P.L. , c.
(C. ) (pending before the
Legislature as this bill):�

���� �Commission�
means the New Jersey Motor Vehicle Commission.

���� �Delivery driver� means any
individual who provides delivery services using a personal vehicle, including,
but not limited to, a delivery network driver.

���� �Delivery network company�
means a corporation, partnership, sole proprietorship, or other entity that
operates in this State and uses a digital network driver to provide delivery
services.

���� �Delivery network driver�
means an individual who provides delivery services through a delivery network
company�s digital network using a personal vehicle.

���� �Delivery services� means the
fulfillment of a delivery request made by a customer of a private entity,
including, but not limited to, a delivery request made through a digital
network.�

���� �Digital network� means any
online-enabled application, software, website, or system offered or utilized by
a delivery network company that arranges or otherwise facilitates deliveries by
delivery network drivers.

���� �Personal vehicle� means a
motor vehicle that is owned, leased, or otherwise authorized for use by a
delivery driver.� �Personal vehicle� shall not be considered: �an autocab or
taxi, as defined in R.S.48:16-1; a limousine, as defined in R.S.48:16-13 or
section 2 of P.L.1997, c.356 (C.48:16-13.1); an autobus or jitney, as defined
in R.S.48:16-23; a motor bus, as defined in section 1 of P.L.1991, c.154
(C.17:28-1.5); or any other for-hire vehicle.

���� �Private entity� means any
individual, corporation, company, partnership, firm, association, or other
entity, other than a public entity, and includes, but is not limited to, a
delivery network company.

���� �Public entity� means the
State or any county, municipality, district, public authority, public agency,
and any other political subdivision or public body in the State.

���� 2.��� a.� Any private entity
that employs, contracts with, or otherwise uses a delivery driver for the
provision of delivery services shall create an identifying marker, which shall
be reflective, capable of being illuminated, or both.� The identifying marker
shall be submitted to the commission, in a form and manner determined by the
commission, for recording.� Each private entity shall distribute two
identifying markers to each delivery driver that provides delivery services
for, or on behalf of, the private entity.

���� b.��� A delivery driver shall display
the identifying markers issued pursuant to subsection a. of this section on the
front windshield and rear window of the delivery driver�s personal vehicle
while the delivery driver is providing delivery services.� If the identifying
markers are capable of being illuminated, the delivery driver shall have the
identifying markers illuminated and visible from outside of the driver�s
personal vehicle while the delivery driver is providing delivery services
during times of darkness.

���� 3.��� The Chief Administrator
of the New Jersey Motor Vehicle Commission may adopt, pursuant to the
�Administrative Procedure Act,� P.L.1968, c.410 (C.52:14B-1 et seq.), rules and
regulations necessary to implement the provisions of this act.

���� 4.��� This act shall take
effect on the first day of the third month following enactment.� However, the
New Jersey Motor Vehicle Commission may take any anticipatory administrative action
necessary to implement the provisions of this act.

STATEMENT

���� This
bill requires any private entity that employs, contracts with, or otherwise
uses a delivery driver for the provision of delivery services to create an
identifying marker that is reflective, capable of being illuminated, or both.�
The identifying marker is to be submitted to the New Jersy Motor Vehicle
Commission (commission), in a form and manner determined by the commission, for
recording.� Each private entity is required to distribute two identifying
markers to each delivery driver that provides delivery services for, or on
behalf of, the private entity.

���� The bill requires a delivery
driver to display the identifying markers on the front windshield and rear
window of the delivery driver�s personal vehicle while the delivery driver is providing
delivery services.� If the identifying markers are capable of being
illuminated, the delivery driver is required to have the identifying markers
illuminated and visible from outside of the driver�s personal vehicle while the
delivery driver is providing delivery services during times of darkness.
