An Act
concerning law enforcement and immigrant communities
and repealing P.L.2026, c.5.

Be It
Enacted
by the Senate and General Assembly of
the State of New Jersey:

���� 1.��� P.L.2026, c.5 (C.�������
) is repealed.

���� 2.��� This act shall take
effect immediately.

STATEMENT

���� This bill repeals the law
codifying Attorney General directive �Strengthening Trust Between Law
Enforcement and Immigrant Communities,� P.L.2026, c.5 (C.������� ).� The law
prohibits New Jersey�s law enforcement officers from engaging in conduct
constituting racially-influenced policing or providing certain types of
assistance to federal immigration authorities. �The law also requires the
Attorney General to annually publish instances of permitted assistance to
federal immigration authorities by the State�s law enforcement agencies. �The
law further requires law enforcement agencies and officials to: 1) notify detained
individuals of certain requests made by federal immigration authorities; and 2)
establish procedures for processing requests for certain visa certifications. ��

���� The law also sets forth
requirements for prosecutors regarding pretrial and trial procedures as well as
notification to defendants of possible immigration consequences related to
certain charges and convictions.

���� It is the sponsor�s view that
the statute hinders federal authority and undermines local policing and
prosecutorial discretion.
