AN ACT

RELATING TO CRIME; CREATING THE CRIME OF UNLAWFUL INSTALLATION
OF A GLOBAL POSITIONING SYSTEM.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

SECTION 1.
A new section of the Criminal Code is enacted
to read:

"[
NEW MATERIAL
] UNLAWFUL INSTALLATION OF A GLOBAL
POSITIONING SYSTEM--EXEMPTIONS--PENALTIES.--

A. Unlawful installation of a global positioning
system consists of a person who knowingly installs, places or
causes to be installed or placed a global positioning system to
track the location of another person without that person's
knowledge, consent or permission.

B. A person who commits unlawful installation of a
global positioning system is guilty of a petty misdemeanor.

C. The provisions of this section do not apply to:

(1) a certified law enforcement officer acting
in the officer's official duties; or

(2) a private investigator licensed pursuant
to the Private Investigations Act.

D. As used in this section, "global positioning
system" means a device capable of transmitting location data of
a person, vehicle or property to remotely determine or track
the position and movement of another person or property."
